AOS Spouse - Concurrent filing of I-130, I-485, I-131, I-765

Hi There,

I have prepared (hopefully!) everything I need to send my package away for AOS. I have not sent it yet, but need to very soon! I just wanted to double check I have everything I need. I have used a lot of tips and advice from these forums before registering, so I want to say thank you for that!

Here is what I have:

- Married for 6 months (Married in the US)

- UK Citizen (Me) currently in the US on VWP

- Copy of petitioners Birth Certificate

- Copy of petitioners US Passport Page

Prove Relationship

- Copy of marriage certificate

- Passport photo of US Citizen - Written name in felt pen on the back

- Passport photo of beneficiary - Written name in felt pen on the back

- G-325A by US Citizen (Biographic Info)

- G-325A by beneficiary (Biographic Info)

- Affidavits by three Third Party US Citizens (Affidavits - Condition I)

- Photos, tickets for plane trips, wedding invites (Prove on-going marital union - Condition J)

I-94/VWP (I don't have I-94 - I was going to include the entry stamp in passport when arriving)

- Copy of passport entry stamp for I-94 section. Attach continuation sheet, date, sign and add item number.

- ESTA info

The fee for AOS is $1,070, and you don't need copies of passport or G325 for U S citizen. Also don't forget most recent taxes for I864.

08/12/2015-ROC Approved. Got letter in the mail.

08/29/2015-received new card in the mail.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

- Are you sure you don't need G-325a for petitioner? The I-130 states that it is required.

- I included a copy of the passport just in case, I didnt know if the birth certificate was enough on its own. Thanks for that.

- The I-864 states that the previous 3 year tax figures are required, but the copies of the tax returns are optional??

Hi,

- yes, you need the G-325a for the petitioner for the I-130 (make sure it's signed)

- birth certificate is enough, adding passport won't hurt

- Copies of last year taxes (including W-2 or 1099s) or IRS transcript is mandatory, for the other two years is optional (not including the W-2/1099s or IRS transcript would likely lead to a RFE)

I added a G-1145 (Receive notification of progress) as first page to each application (in your case four total), not sure if needed but I did receive a NOA1 for each one

10/18/12 - (Day 16) Received letter of biometric appointment for November

11/02/12 - (Day 31) Biometrics done

12/20/12 - (Day 79) Interview day .... Approved

12/26/12 - (Day 85) Green card mailed ...

Note that the EAD was never processed.... case number for EAD only showed "Initial Review" ...

No need for the extra statements (about your intent and current situation), imo. Don't forget complete tax returns for both the sponsor and your co-sponsor, current letters of employment for them both (if available for the sponsor), and proof of either USC or LPR for the co-sponsor.

The fee for the I-485 if $1070. The fee for the I-130 is $420. Total is $1490. The OP has it right.

8/07/2012 - Second GC production email

8/07/2012 - EAD received.

8/08/2012 - GC mailed.

8/09/2012 - Welcome letter and I-130 approval letter received.

Thanks for the info on the most recent tax returns! I'm going to include the most recent years returns for sponsor and co-sponsor (I left all assets blank in the sponsors I-864, despite not meeting the threshold - I assumed they would notice the co-sponsors I-864)

I read someplace that one G-1145 for the whole application is okay, I can't recall where, but I suppose it doesnt hurt, thanks!

Harpa - Thanks for info on proof of US Citizenship for co-sponsor! Missed that one! We don't have a letter from the co-sponsors employer, he works as part of a union. We do however, have 6 months pay stubs. The form does say it 'may' be required, but I was hoping this was enough to prove employment.

Affidavits will help with proof of bonafide marriage. Photos of the wedding yes, tickets for plane trips not really, wedding invites can be faked.

You will need proof of current employment, which can be either paystubs or a letter from an employer. You have paystubs so you are fine. USCIS understands that newlyweds don't have a lot of evidence of financial comingling yet, so personally I think your proof of bona fide marriage is just fine. "Proof of relationship" and "proof of bona fide marriage" are interchangeable for a marriage based case; there is no difference.
