Marriage in the US to Uk citizen

I was wondering if my UK Fiance and I (US cit.) would be able to get married in the US prior to submitting any of the CR-1 paperwork? She has to work the remainder of the year and would go home as soon as we were married but is trying to live in the US in the future. We were thinking about getting married in the UK and then filing for the CR-1 visa but there is also paperwork to fill out just to do that. Can she just visit the states on a tourist/ESTA visa, get married and then file for the CR-1 visa? Or is it easier to get married in the UK?

Given that non-EU nationals require a special visa to be able to marry in the UK, it is probably easier to marry in anotherr country; certainly it's easier to do that in the US.

You can certainly have her enter on ESTA to get married in the US as long as she leaves after that and then you both file for the CR-1 visa with her back home. I got married in the US after entering on ESTA because if we were to get married in Singapore instead, my husband would need to have been physically present in my country for a certain number of days before we can get married and we didn't have the time for that.

I'm from the U.K. and we got married when I was visiting on the VWP.  Perfectly fine. What's not fine is entering on the VWP with the intention of staying (married or otherwise).

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Timeline

The US Citizen is the person who "files" the I-130 petition along with the I-130a and supporting documentation.  When the US Citizen's "petition" is approved, the foreign spouse then "applies for" a CR1 visa.

As others have said, it is perfectly fine for your UK fiance to come to the US to get married on the VWP... we just did it this January! Then we began the CR-1/I-130 process when he arrived back.

After getting the CR-1 visa and being admitted into the US, yes. Just note that you are looking at a 12-14 month wait after filing the i130 petition for that to happen.

Yes. He will be able to work from the minute his passport is stamped with the I-551 stamp at the airport when he arrives. I was working less than 2 weeks after I arrived (and it would have been sooner had I not arrived 6 days before Christmas and my line manager was on vacation for Christmas and decided to delay my start date until she returned).
