Does anyone know how long we have to wait to get a social security number after my fiancé and I were married? We had our wedding in October and applied for AOS, then had his biometric screening done. He needs a job desperately but he can't apply anywhere without a social. Any help with this would be greatly appreciated!

When does his I-94 expire? My husband got his social security number and card 2 weeks after he arrived in the US on his K1 visa. You can go to your local social security office and apply as long as he has a few weeks of validity left on the I-94. If it is expired or close to expiring, he will need to wait until he gets his EAD card. He needs the EAD before he is able to work anyway.

You must have at least 14 days of legal status remaining to apply for an SSN.

 

They may or may not issue it in the married name...fight for the married name for simplicity if you can, but don't be surprised if they want an EAD (or green card) before allowing that. Really, you should have applied for an SSN right after arrival in the US (even before marriage).

 

Why can't he apply for a job without an SSN? Keep in mind he cannot work until he gets the work permit...which takes ~4 months from I-765 filing right now.

From what I understand, the beneficiary can now apply for an SSN right after entering the US, even before the wedding. He is a man so no name change is involved. Is this accurate?

 

Also, even with a social security number, the beneficiary can not work until receiving the EAD card.

True. SAVE updates right away nowadays (it used to take a week or 2), but I'd still give it a couple days after entry just to be safe anyway. A man can change their name the same way as a woman due to marriage (in the US), or no name change can be done (also applies to both genders).

 

Exactly. The card itself will say "Valid for work only with DHS authorization". The EAD is DHS authorization. A new, "unrestricted" card can be obtained after getting the green card.

I waited 2 weeks after POE just to be sure. Took about 15minutes at the SSN office, only asked for passport and SS5 form , went in on a Wednesday, got my SSN card in the mail the following Tuesday.
