k1 ROC success after divorce?

Hey everyone,

 

Sadly my American husband and I are getting a divorce :( I have 6 weeks left until my 2 years permanent green expires. I am okay going back to my country, but if I wanted to stay, how successful would it be for me to try to adjust my status and remove conditionS if I do this alone once we get a divorce decree.

 

I love this country and it's people and it would be great to stay, I would love to know if anyone knows a successful case doing this after a divorce.  Thank you so much!!

You will be fine as long as you can show proof of bonafide marriage.

 

Do you have financial documents from your marriage together. like joint tax returns, bank statements in both names, credit cards in both name, insurance together and so on? If yes then you should be fine people do this all the time file ROC with divorce wavier.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Nice that he will help. Also if not since it's also your stuff you can always get a copy of it from the places.

If you have proof of a bonafide marriage, then it will not be difficult for you to stay. However, you need to apply to remove conditions before your 2-year green card expires. You can tick the box for divorce waiver and write an attachment saying your divorce is in process. They will send you a RFE for a divorce decree later.
