Hello all,

wWfe had an interview back in April 2016. to date,

they have not given her an approval, even though she passed all civic questions.

We've called them and even went to the local office. They just kept saying, waiting on a third party respond.

It cant be the background check, because background can't be that long.

So my question is, is it time for a lawyer? and what can they do, other than what we've already done. Call the USCIS, went to the local office with an appointment.(twice)

This is january 2017.

thanks for your respond.

Can't help you until you fill in your timeline.

You have three options:

1) Ask one of your congressional representatives to enquire on your behalf as to the status.

2) Enlist the aid of the CIS Ombudsman: https://cisomb.dhs.gov/oca/form7001.aspx

3) As it's been at least 120 days since your interview you can file suit in federal District court seeking to have a judge review your application. This lawsuit is provided for under INA 336(b), 8 USC 1447(b).

You can do one, two, or all of them.

Thank you all for responding.

Yes, she had her biometric before the interview. We're just in  limbo...waiting. and she's getting mad, blaming me. : (

i wrote a letter to our congressman last night.

I guess at the point all the lawyer will do is call them and ask the same questions as we did, and take our money..

how is this your fault?  I can see why she's annoyed, but taking it out on you isn't fair.  Be like "hey, I know yer frustrated, but this isn't my fault.  I'm supporting you, not holding anything back so be nice please!"
