Help for i-130 Form fill up

Hello Everyone,

I am looking for applying CR-1 Visa and I am having some doubt on the information that I need to fill.

Before that i will give you a brief on my story, initially i filed K-1 visa ( Fiancee visa) after getting engaged to my fiancee during May 2016, but that time i was unaware of the fact that i cannot marry her with Hindu ritual outside US before marrying her in US. And we had already planned for a Hindu marriage during the month of December 2016 . And because of this I have to draw back her K-1 visa petition, right now I am traveling to India in some days and then will marry her so that i can apply for her CR-1 visa for her and expedite the process.

Also to give you details on my K1 visa petition status:- we received only NOA-1 and we got a REF for intention of marriage evidence from my Fiancee and during that time i got to know that i cannot marry her outside USA before marrying her in US and then i send a letter to USCIS for withdrawing my K-1 petition ).

But now i am facing some problems while looking at i-130 form for the below options. :-

FORM i-130

16. Has your relative ever been under immigration proceedings

No Yes

Do i have to say yes her as earlier i have applied for K1 visa for her but for K1 visa we only received NOA-1 and REF and then I mailed them that i want to drawback my petition as I mentioned earlier.

21. If filing for your spouse, give last address at which you lived together (include street, city, province, if any, and country)

We are having an arranged marriage so we never lived together at any time (I have just visited her 2-3 times), my fiancee lives in India and I live in United State and that why we never got a chance to live together . ( -- than what i can mention here)

D. Other Information

2. Have you ever before filed a petition for this or any other alien

yes No

If "Yes" give name, place and date of filing and result.

Similar to question 16. And I am not sure what i have to mention here

You cannot file an I-130 until after the wedding. There is no 'expediting the process'.

It is fine to prepare, but as mentioned, do not fill in anything (or date it!) until after the legal wedding.

16 Not sure. I would say "no" because you never got to the stage where she applies for a visa, just you filing the petition.

21. That is fine; they are used to people not living together as they are in different countries.

D. "Yes" because you field a K1 petition; mention the date you withdrew it. In your cover letter, you can explain why.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

as said, you can't file the i130 until you've married, the i130 is for spousal visa, so marry first, then you fill out the i130

For question 16 they want to know if your wife has ever been deported or subject to a removal procedure. Has she ever overstayed in the USA and been removed from the country by the authorities? I'm thinking she probably hasn't been to the USA at all yet (so the answer would definitely be "no"), but I could feel wrong.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

As lots of other have said you can not file I130 before marriage. You can prepare all and take it with you to India once you get marriage certificate and other joint proofs you can send out that i130 to US from India and enjoy Indian trip

As for expedite

No You CaN Not expedite your partition unless medical emergency or country's political instability ( that dose not apply to India as its stable )

For 16 I would say No

For 21 address you can open Indian bank account to gather ( NRI account under USC and joint Indian spouse I did same pass books are sent in India as address proof as well as joint bank account )

As for other question

D Yes. As you filed K1 and withdraw partition

Explain with letter about your situation will be fine

Check Guides From Guide section for doccuments and list of stuff and follow this steps


Step 1 After USCIS NOA2 Gather all AOS / IV Package Documents In 3 weeks


Between USCIS Approving and NVC Case Number you have 2 to 3 weeks gather all AOS and IV Documents Get package ready.


Step 2 Obtain NVC Invoice and Case number.


​After 2 weeks of NOA2 Keep on Calling NVC every day to get case number And Invoice number


Step 3 Pay First Fee and DS261


After getting NVC Case Number and Invoice Number Log in to webpage Pay First Fee and Fill out DS261 Takes 24 to 38 Hr to get fee status paid.


Step 4 Conform Agent / Ds261 Over Phone and Sent out Documents


Once First fee turns Paid Online ( Usualy 24 to 48 hr) Call NVC And conform choice of agent over Phone If they won't keep on calling them Until someone will Or other fee won't be unlocked.Also Once you get Welcome letter on email Print out Document Checklist sheet And Sent in your documents to NVC


Step 5 Pay Other Fee and Fill out DS260 (Total time from DS 261 to here should be no longer then 15 days )


​Step 6 Conform Document delivery AT NVC And Ask them Processing Time..


Step 7 Check For CC ( Hopefully no REF )


Call them every other day 2 weeks from DS260 and Check status.. Also Check Online NVC Page If you have 3 N/A your case Complete! Congratulation you are almost done.


Step 8 48 Hr After CC Conformation Call NVC For appointment for interview


Congratulation On your NVC CC AND Good Luck with Interview
