My wife came here on a K1 visa. She entered the USA on September 18th 2014 we were married within the 90 days. Wish I had known more I would have gotten her a social security number, but that time has long since passed. So now when I sent in our tax forms I had to apply for a tax ID number, the IRS is taking forever plus H&R block completely screwed up my taxes and refunded me my money. I know to send in for the AOS I must provide tax transcripts, I however don't have last years due to all the negligence on H&R blocks part and the slowness of the IRS. I sent in my taxes on January 21st!!!!!!!!!! So I know I have read it here before that it is ok to not file AOS immediately, all is forgiven as long as I married in the 90 days. I have no idea when I will get my taxes acknowledged by the IRS for 2014 since they wont even process till a tax ID number is assigned. How long before I should really start worrying about not adjusting my wifes status????? thanks for any helpful reliable knowledge in this matter.......

Why don't you just send a copy of the tax return that you did send in for now and give them the transcripts if you have an interview ?

NVC Received : some dinkelsberry yehoo in the house of clingons send our petition to the wrong consulate.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Interview Date : Oct 22, 2014

Interview Result : AP , requesting another PC (not expired) and certified divorce decree (was submitted)Stokes interview via phone for petitioner 4 hrs after interview.

Oct 23 email notification visa approved.
Visa Received : Nov. 3 , 2014 VISA IN HAND.

US Entry : Nov. 21, 2014

Marriage : Dec 27, 2014

AOS send : May 12, 2015, received May 14, 2015 USPS priority

Email &text : May 18, 2015, check cashed May 19,2015, return receipt May 21, 2015 stamped USCIS Lockbox, NOA1 (3x) May 22,2015

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

I-797 EAD/AP approval notice received : Aug 27, 2015

EAD/AP combo card mailed : Aug 27, 2015, EAD/AP combo card received: Aug 31, 2015

Renewal EAD in production notification text and online, expedite successful 4 days after RFE request response was faxed, Aug25mailed,Aug29received.

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I dont have an interview, like I said I have not even sent in the AOS package yet. I dont want to send it in and get the almost for sure RFE. I want to send in a 100% complete and accurate package. Just wondering how long before it starts becoming a problem that I have not filed. Thanks

I meant that IF you will be called for an interview you can then submit it and if you get a waiver interview then there is nothing to worry about.

An RFE is better than being out of status.

Call the IRS and ask them how long they estimate until you can get a transcript.

My 2014 transcript is not available due to identity theft, someone filed under my SSN so I send the tax return copy.

The IRS said it can take many months until my transcript is ready.

Transcripts are more crucial evidence for me since I am self employed and don't have W2 and employer letter etc.

You can include a statement from H&R or the IRS that your transcript isn't currently available.

You don't have to have transcripts and can send in a tax return copy, transcripts are ideal but not necessary.

In your case I would go ahead and file as your wife is out of status.

Which is forgivable as you know and there is no date I can give you that says until this or that date she is fine.

Don't have her travel on the border and stay put and file with the tax return copy.

Send a complete copy of your return, everything you would have needed to mail your return the IRS instead of e-filing. If the want something more from you, they will send an RFE asking for it.

There is no time limit/deadline in which to file for AOS. As long as you married within 90 days then you are eligible to file based on your approved I-129F petition and fulling the requirements of the K-1 visa. However, you will be out of status and begin to accrue unlawful presence between your I-94 expiring and filing for AOS. Once you file for AOS, you then enter a period of authorized stay while waiting for your green card approval.

I did the same thing as you. Got married within the 90 days, but didn't file till about 45 days after the 90 days. Like you I didn't get the social security card for my wife. I do my taxes myself, so I got all of that stuff together, then filled out the form for the ITIN. Had to take all of that to the IRS to get approved and sent off. They gave me a stamped copy of my tax return back and I used that for the tax return proof. The other returns I submitted were just copies I had submitted. No problems with that. We got the ITIN Number back the same day we got our appointment. Never had any problems with the paperwork at all.
