TAX documents at Embassy Interview (worked outside USA and have not filed)

Hello,
I am the US Citizen applying for a spouse visa. We have been through all the loops (uscis, nvc) and made it to the embassy interview, which is in a month.
I have been living and working in Turkey for the last 4.5 years. And have not filed taxes. We have been married for 1.5 years and living together in Turkey since marriage. We plan to move ASAP after the visa is given.

I stated to the NVC that I will backfile my taxes when I return to the USA. They approved my affidavid of support with my income in Turkey. (I know this since they passed me to the Embassy)

My question is for proving domicile at the interview. In USA I have 2 active bank accounts, credit card, stock trading account and emails proving I am applying for jobs in The USA. Will not having filed US taxes be a problem? (I stated I will back-file with support of US tax attorney when I return to USA since no one here in Turkey knows how to do them.) I do not owe any money in my taxes.

When we applied for my immigration (IR-1), my husband had been living in Canada for several years and had not filed his U.S. taxes during that time. I am unsure whether you will run in to problems with not having filed. In our case, I filed my husband's taxes for 2013-2016 shortly before my interview. I kept copies of the returns, as well as the FedEx receipt for having shipped them to the IRS. The taxes had not been processed by the IRS by the time of my interview, but the copies of the returns were sufficient -- even with my husband owing money that had not yet been paid.  I'm not sure whether you will have trouble with not having filed, but I can tell you that filing myself was pretty easy. You may want to consider filing to put your mind at ease.

You are 100% confident you do not have any prior year tax liabilities?

 

If a taxpayer has no tax liability, a tax return is not required to be submitted.  The only thing you need to have is proof of no liability

Can you please direct me to where it states this: No Liability = Tax return not required
I made around $38K per year and stayed in Turkey the whole time. with no other income. Yeah so I have no liabilities.

 

Filing them and sending them in and keeping receipts sounds like a good idea, I just dont want to make any mistakes when filing though. I am counting on Turbotax.
There is also the "Foreign Account Tax Compliance Act FATCA" forms for every tax year I did not file for 4 years. :/
