NEED ADVICE ON DENIAL SITUATION!!!!!!!

After waiting so long to hear from uscis... I got a letter saying that I was denied because of an missed interview.

Mine you I have not received any interview  letter, everyday I check the mailbox religiously and nothing. I will have to be real stupid to knowing how important this is to miss that.

I'm going frantic now cause I really don't know what to do...

Has anyone been in this situation or similar ? What did you do ? and the outcome? Thanks

It wasn't the reason for my denial, but I missed an interview yes, as I didn't receive a letter they claim was sent, despite never missing a single other piece of USCIS mail...

I only discovered I had missed it at an infopass a few weeks later but they said it was ok as long as I didn't miss another....perhaps I caught it early enough?

 

Can you fill in your timeline? It makes helping somewhat difficult sometimes without knowing any timeline or circumstance. Was yours a joint filing or a divorce waiver?

 

Anyway don't panic too much - you can file another I-751, you can file a motion to re-open, or a few other things.

Don't leave the US at this time either.

 

 

Is your profile correct and you in NYC? I have an infopass appointment for later this week at federal plaza if you want it - I no longer need it. May help you out being able to actually speak to someone.

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

 I-751 Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

They said they sent me 2 letters one for the interview and another one stating that I have 30 days to respond why I didn't show up. This is so strange to me cause I didn't receive none of those 2. But I receive the DENIAL letter.

It was a joint filing and yes I am in MY.

I was looking online for info pass but none was available. What day and time is yours?

That an error ... I filed at VSC 

The only reason I can see it from here why you did not receive the interview letter is if you moved to another address and did not update your address, but if you did not move then its USPS fault and did not send to you the interview letter. As far as I know I hope I'm correct, your online status will change and update that they sent you interview notice. Well that's what I experienced for my AOS.

Nope.

For the I-751, online status does not update with interview scheduled either - it does not change until card production.

 

Hell, if I put in my first I-751 receipt number, despite three interview notices (one of which as above, never arrived), and a denial of that I-751 it still says

"On xxxxx, 2015, we received your Form CRI-89, Petition to Remove Conditions of Permanent Resident Status Received, Receipt Number EACxxxxxxxxxx, and sent you the receipt notice that describes how we will process your case. Please follow the instructions in the notice. If you do not receive your receipt notice by xxxxx, 2015, please call Customer Service at 1-800-375-5283. If you move, go to www.uscis.gov/addresschange to give us your new mailing address."

 

They certainly aren't the only one to have had interview notices or RFEs go walkies, or the suspicion that they were never actually sent in the first place. 

 

I didn't receive my second interview notice either (from the same office as well) despite having received every other single piece of USCIS mail, and USCIS doesn't really seem to care if it goes missing either.

 

 

 

OP, did you originally file at another address and subsequently do an AR-11, and if so, did you get confirmation by email or snail mail of the address change?

That's an uneasy thought. A benefit denied after years-long wait for something that began as germanely as not getting a piece of mail.

Happens more than you realise....usually with RFEs not received and the I-751 is denied as a result.

There are no updates 1751 , only when card is in production. Sucks huh..

Ok So my advice is: DO NOT FREAK OUT. 

Call USCIS and demand to talk to a tier 2 officer, tell them what happened and ask them if they could reschedule an interview. You could also schedule an infopass with USCIS if they are closed to you and take all paperwork you received from them and explain your situation and ask for a new date. 

It happens quite a bit and I think that USCIS need to change their postal services to a better company than USPS, since USPS will act like there was nothing wrong from their part. 

Sorry for the headache you have to go through, but make sure you do as I told you and don't wait for a long time give them 2 or 3 weeks and call again and ask if they scheduled your interview, if so ask for the date an time and than ask for a faxed copy if its close enough.

Consider filing a service request for expedited review of your I-751 because of a USCIS administrative error. See information below. Because of the serious adverse consequences you now face (including removal proceedings), I would write the service center that adjudicated your I-751, sending via certified mail so someone signs for it. I would also appeal to your representative in Congress for help.

 

In your letter to USCIS:

  • Ask for expedited review because of a USCIS administrative error;
  • Explain that you did not receive an invitation to interview.
  • Include the potential adverse consequences you face as a result of this USCIS decision (loss of employment eligibility, initiation of removal proceedings, separation from spouse, health?, etc.)
  • Attach any relevant evidence.

Hi @mindthegap... i know you know abit about how this immigration stuff goes. Well I refile the i751, they sent me the NOA  with one year extension. My question to you is when will the year start). The first time I file it was for until March 2017. Then I got a stamp for it to expire March 2018. So now that I have refile, I'm not sure on the dates.
