Question about Domicile

Timeline

 We are still in USCIS processing .. My wife is living with me abroad and she is working remotly with US company .

But she dosn't have her own address in US  . Is that will be a aproblem with the visa

Does she need to travel and get alease before interview time

Her sister have an address there ,will that be okay .

we intend to get a lease when i get the visa and travel togther

Post is unclear.. the petitioner must travel either prior to or alongside the beneficiary. Sister's address is ok.

Timeline

I'm going through the same, as I have been living g in Mexico for the last 7 years. I will leave with my fiance when he gets approval. As US citizens, we will need to show proof of domicile when the interview happens. That shows you have ties to the us. I will have proof of my bank account, credit cards, and currant drivers license (already states the address where we will be living). I will also have email proof of job searches. I will hope to have proof that I will be having interviews upon my return. May also do searches for car insurance. Do searches on this site and maybe Google regarding provide domicile.

I meant .. should the petitioner travel before the interview to rent apartment to prove domicile , or we don't need that and petitioner sister's address can be enough for proving domicile

As noted earlier, sister's addr ok. No need to travel beforehand.

Glad to read this topic. We have been living Singapore as well and we wrote my husband's sisters address. He used to have his own apartment in Boston but he sold it to his other sister. We are planning to travel all together when we get the visa.

07/31/2014 : Married 

02/15/2017: Sent I-130 

02/22/2017: NOA1

03/30/2017: NOA2 YAYYYyyyyy  36 days after NOA1.. Blessed  

04/19/2017: Email from NVC

04/19/2017: DS-261 unlocked

04/21/2017: AOS paid

04/25/2017: IV paid

06/14/2017: Sent AOS Package

06/21/2017: Scan date

08/23/2017: Case Complete (9 weeks)

08/24/2017: Received automatic checklist via email from NVC to bring proof of domicile during interview. Still waiting for Interview Appointment.

08/30/2017: Received email from NVC telling that they will be schedule interview.

09/06/2017: Received email from NVC regarding Interview Date

10/25/2017: Interview Date

09/14/2017: Emailed US Embassy to cancel our interview and postpone as wife is pregnant. USEM mentioned to contact them 3 weeks prior to intended date of appointment.

Does she have other proofs that she's kept her US domicile? If she does, then she doesn't need to move back (or visit) to get a resident for domicile purposes. She can always use her sisters address, yes. If she does not have strong proofs that she kept her domicile, then she will need to re-establish it.

 

Follow this guide and look at Step 6 where it talks about what to do if the petitioner is living outside the US and needs to prove/re-establish domicile... Great and beneficial advice which I followed.

No need to have the petitioner go and lease a property beforehand but you will need to prove domicile.  My husband is the USC in our case and provided the following:
current drivers licence including details when it was renewed (we have been overseas for 6 years and he renewed while we were away)
* Mail showing his US address (currently his parents address) 

* Bank account in his name in the USA

* College transcrips (to show he lived there and wasn't just born there)

* Copies of temporary visas in Australia and NZ where he lives with me (to show his "away from the USA" was of a temporary nature)
* Enquiry emails we've sent to real estate agents over the past year

* Enquiry emails to HSBC bank about opening a joint account in the USA

If you look in the NVC wiki there are more examples also. And a cover letter explaing the above, and that the USC plans to return to the USA either prior to or with the principal applicant is always a good idea too :-)

Full expedite approved (bypass NVC to send file to embassy), however too late as I already had case complete 17th Apr 2017

P4 letter received: 26th April 2017 (expedite at embassy stage so this came from the consulate, not NVC)

Medical date: 26th April 2017

Interview date: 4th May 2017 APPROVED!!

Visa received: 8th May 2017
