U.S. police clearance but living in Germany

Hello everyone,

I've been starting to collect all my papers that I will need as it says on the USCIS site that our NOA2 got approved three days ago. I read that I need a police clearance/check from all countries that I've been living in for longer than 6 months after the age of 16. Unfortunately that is besides my birth country, Germany, also Australia and the U.S..

I already sent all the documents needed for the Australian clearance which was fairly easy as I was able to do it online. Now I am struggling with the American one, as I am currently living in Germany.

First of all I saw in a German K1 forum where someone had the same issue that people answered that you don't have to get one from the U.S. because they have their own system to check you and that they didn't get asked for a police clearance for the U.S. when they had their interview... sounds kind of strange to me and I don't really want to rely on a thread that was from five years ago. Does anyone made experiences with this?!

Also, are these the right steps to get the police clearance:

1)Download this form and fill it out: https://forms.fbi.gov/identity-history-summary-checks-review/q384893984839334.pdf

2) get this finger print card printed out http://myfbireport.com/pdf/applicant_fd_258.pdf

3) Fill out credit card form (we don't use checks or money orders in Germany)

3) Then go with the papers to the local police station (I've tried to find out through googling where they do that but I couldn't find out anything about it. I guess it's not something common here in Germany... that people willingly go to the police to get their fingerprints but I guess it should be possible)

Thank you so so much in advance!

I am sorry if this is a stupid question but was I really a resident of the U.S. if I was on a B1 visa there (9 months)? I wasn't registered there, I stayed registered in Germany.

The point is that the US & Mexico are the two countries that no police clearance is needed from for the purposes of US immigration. Edited by EM_Vandaveer

That is great to hear! Spares me a lot of time. I am just surprised that I haven't read this anywhere else. THANK YOU SO MUCH!

However I just found this on the "i m m ihelp" (it doesn't let me post the name in a whole) page under police certificates :

"Please note that these police certificates are required only if you are getting an immigrant visa or other immigrant visas such as K, V. They are not required if you are doing an Adjustment of Status."

I am so confused now :(

Ignore what you saw. You've ordered the Australian police certificate; now get one from Germany. After you have both, just prepare yourself as anyone would for the consular interview.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

No police certificates from US, but yes for Mexico.
