AOS case not approved because local office missing the I-130 documents

Hi Everyone, I had my interview on 25th November and before the interview started the IO mentioned that he can't approve the case today because the i-130 documents was not received by them. We had applied for i-130 on May and it got approved too and we had sent the approval notice with I-485 application. The IO told us that he will expedite the request for the getting the document from USCIS. Did anyone have the same experience? How long does it take to get the document back to the local office? Thanks.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

This is quite weird. They should have access to everything. But as a customer, we don't know what is behind the hard copies they are after. maybe some additional checks that are reflecting on the copies that uscis maintains.

They told me that they have two different alien numbers. And since they dont have an orginal documents of I-130 they dont know reason behind it. My lawyer told me that since they didnt have i-130 with them they might created temporary file which may have different alien number. I am still confused about this because the i-130 was approved in may and we had confirmation notice with us but he wanted all the i-130 documents.

i see. Quite possible this is kind of duplication which is why they want to make sure that they are approving the case for the right petition.

I also have a temporary file created... Previous case that I filed before i-485 with my husband. lIO told me their will request it & should be done in few days... and Im waiting over a month now. I think things like that can get expedited but that is up to USCIS how fast they are willing to work. It is fustrating and I got no answer from anyone (infopass, over the phone,nothing...)

I was told by the IO that he will expedite the request to get the document. But its been 3 weeks and i have no idea how long it takes. I tried tracking the I-130 document and found out that NVC had sent the document back to USCIS in Sept 4th. So i tried calling USCIS about the whereabouts of the documents and it is no use. They said they cant track the document through phone and the only way to find out is to get the Infopass to that particular USCIS local office and getting infopass there is second to impossible. So i dont know how to deal with this frustration.

At least give it a month from your interview day. If you don't hear about it, get an infopass & get your congressmen/senator involved too (if you don't have a lawyer). The best time to do an infopass is at midnight because there is not much traffic on the site (sometimes you get that message that there are no service appointments available at this time & that is not true). See if that helps.

Did you get any letter at the end of your interview? Was that marriage-based?

Yes it was marriage based. We didnt get any letter after interview only a paper to submit with copy of my wife passport(which we didn't bring during interview). I had lawyer with me during the interview too and the lawyer said that we cant give follow up until 90 days of interview but basically it only takes around a month to get the approval. Hope to get an early Christmas gift :D

How about urs? Was it marriage based? what document were you missing?

Yes, it was and we were not missing documents but IO needs that temporary file that was once created for me in one of the service centers (I applied for ead card and it was all under my old last name, everything was a mess and then I abandoned the intial case for the sake of i-485 since I filed for EAD card with i-485 anyways.)

Actually the IO was confused because there was two Alien Number for me on his file. So he wanted to get the original docs from I-130 to verify. I had applied for EAD back on May but it was denied around September not sure if that is the reason i had 2 alien numbers. May be we have the same case!!!!

I had an alien number assigned.. It is all that this file created for me never got merged with my main file. This can be really frustrating! Hopefully we hear something soon... :joy:
