I-134 No tax return- claimed as a dependent

Hi all,

I am doing the I-134 and they ask that the petitioner send last tax return as well as the joint sponsor. The only thing is, for 2014 my mother filed me as a dependent because I am under 24, a student, with little to no income for that year.

1) Should I send that tax return with a note explaining why I didn't file myself?

2) Should I just send a letter explaining that I didn't file?

August 21, 2015: NOA1 "Received Date"


August 25, 2015: NOA1 Notice Date


September 14, 2015: USCIS website says "my case was approved"! :wub:


**STILL NO NOA2 HARD COPY**


October 4, 2015 NVC Received case around 10:00pm EST


October 5, 2015 Called and received case number. CAEC website shows "At NVC"


October 8, 2015 CAEC Website showed "In transit"


October 14, 2015 Received email from U.S. Consulate General in Sydney saying they had received our approved petition and they would be contacting my fiance; CAEC website shows "Ready"


October 19, 2015 Packet 3 & 4 received by my fiance


November 20, 2015 Interview date. APPROVED!!


December 3, 2015 POE


February 15, 2016 Marriage!

I was under the impression you only had to send a tax return if you were self-employed?

The rules on the I-134 paper differ a bit from the rules each consulate uses, but it's almost baseline for all consulates to require a tax return unless you don't have one.

If you don't have one, you simply write a statement saying why you didn't or weren't required to file your taxes.

In your case, the Austrailia Packet 4 shows that you just use the rules on the I-134. In my case, Canada Packet 4 lists Tax return as the first source of proof for income that they want.

Do not take this as dogma, but for our case, I submitted the following:

I-134 (me and cosponsor)

Letters/statements of economic support and work history (me and cosponsor)

Paystubs, Employment verification

2 tax returns (me)

1 tax return (cosponsor)

2 w2s (mine. 2 because I didn't work in 2014)

3 w2s (cosponsor)

Bank statement (me)

I don't know what your consulate requires, but at our's it was sufficient.

9/4/2014 - Met online to practice language together.
10/5/2014 - Officially became a couple after tons of time talking and flirting. *laughs*
12/26/2014 - First meeting in Atlanta. Spent close to 2 weeks together.
02/16/2015 - Second meeting. I went to Mexico City for an amazing week and met her mom and sisters. Saw lucha libre CMLL at Arena México with her on my birthday that week! Obvious keeper! *laughs*
03/29/2015 - Third meeting. Proposed at The airport in Atlanta. Spent an amazing two weeks together.
04/16/2015 - Sent I-129F.

Include a signed letter (along with your own I-134) explaining that your income for 2014 was less than the required filing amount.

If mom is your joint sponsor then you (and anyone else claimed as a dependent) are included in the family count for her affidavit of support.

I'm a student and have no income at all. How does that change your recommendation? Specifically, I'm wondering if I check the box that says I do not intend to make contributions to the support of my fiance' will that be a problem? We have a sponsor that meets the eligibility requirements as far as annual salary. His I-134 says he DOES intend to make specific contributions, so will that be okay?

You don't have to check any box. You should write "N/A. K-1 VISA." That space is not applicable for a K-1 Visa as the form is used by over Visa types.

Thank you for your help. :) I've got a continuation sheet that explains why I haven't included a 1040 form or W-2. Should I mention anything about that item (#11), re. contributing to his support, or is "N/A K-1 VISA" sufficient?

If your consponsor includes a letter (which ours did) then it should be okay as stated, but it's not required to put anything there except that. If you want to be specific though, I don't think it would be a bad idea to put something like "to provide support as needed to ensure that the beneficiary doesn't become a public charge".

Ok, thanks. I really appreciate your help.

You mention that your co-sponsor included a letter. What was the gist of it?

Also, did you have your/co-sponsor's I-134s notarized? I found an interview checklist here on VJ where they mention taking notarized I-134s. If it's necessary, I can get it done but don't want to have to jump through that hoop if we don't have to!

Our cosponsor notarized both the letter and the I-134. The gist of the letter was just stating that the who the cosponsor was, cosponsor made ______ amount annually, agreed to provide help in case we needed it (I work and go to school so I don't have a complete lack of income), contact information and what they included with the I-134. May have been a little more than that but that was the important stuff that I remember. Hope that helps :)

Hi everyone! I decided to send my mothers tax return from 2014 (I am claimed as a dependent) along with a letter stating that in 2014 I was a full-time student earning below the min requiered to file, therefore never filed. I paired it with a co-sponsor and their w-s/tax returns which is more than enough so hopefully they wont look into mine too much :)

Will update if we get any bad news, lets hope not!!!
