Holiday with possibility of finding work

Hi guys,

I'm from England and going to Nashville for at least 3 months from Feb 2015, I was hoping to get a work visa for this but was clearly far to naive about the work visa situation. Just wondering if I was to find work out there and the employer was willing to sponsor me for a visa would this be a realistic way of getting a work visa? or am i being naive again? The impression I get from research is that the only way to get one is for me to find an employer before I go who is willing to sponsor me, but even then it's unlikely to be ready by february...?

Sorry if this is vague but i'd just like to know my options (If i have any that is...)

Unless you've got a B2 visa then you won't be going to Nashville for 'at least 3 months'

It'll be a maximum of 3 months (90 days)

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

Yes but if that's how long i'm allowed then i will be going for the full 90 days.. So at least 90 days, more if I was to find a way of working and being able to stay longer..

If you're looking for H-1B, yes - it's fairly naive. Application period starts in April and quota typically runs out in few days so in February, most people have already their employers found and paperwork ready. Now, visas are given out starting October 1st so you'll have to go back anyway since you have to be in status to change it to H-1B.

Then it would be a good idea to make sure you have proof of how you'll support yourself for 3 months

You don't provide enough information to answer your question. What work visa, if any, you might be eventually eligible for, depends on what sort of work you're looking for, and your qualifications. What were you hoping to do?

I also wonder if there is something else you're not telling us. Is there a girlfriend in Nashville?


But, in any case: yes it was naive to think that you'd be able to find work and get a working visa and then extend the trip. That's not legally possible.

Hi Owen,

i'm a junior buyer for a clothing boutique and Nashville is full of some amazing clothing boutiques so I was hoping to work in that field. after A-levels in the usual science, maths and english I don't have any relevant qualifications (didn't go to university).

Haha no there is no Nashville girlfriend I promise, just love the music and lifestyle after previously having visited and always wanted to live and work there for a bit ... thought i'd do it now before i'm no longer in the position to. But it sounds like it's not possible for me to work there which is a shame..

Then there is no working visa for you, sorry. That's not a suitable position.

The reason I ask about a girlfriend is that marrying a US citizen is a way that many people move to the USA who wouldn't have otherwise been able to.

Oh, and the usual advice is not to book your flights for the full 90 days. If your return flight is cancelled, USCIS still expects you to leave the country within the 90 days, or they will penalise you for overstaying.

Heya James.

It sounds like you're asking if the US has something like a working holiday VISA that Australia, the UK, and other countries have. The short of it is, nope. There isn't really any way to do a working holiday in the US. What a lot of people in their 20s do is get a summer camp job (obviously the wrong time of year for that), which gets them an appropriate J VISA for work, and after that, they leave the US for a bit and then re-enter on an ESTA/VWP. It's sketchy, I'm not sure how actually legal it is, but I know folks do it all the time (to the point that summer camps have instruction forms for it).

Anyhow, yeah, nothing exists to help you do what you want to do. It's going to be 90 days, maximum, touristing. If you want a working holiday, I'd suggest looking into countries that have the working holiday VISAs.

We do have the work and travel programs in the U.S.--I'm guessing they are J-1's but I'm not sure.

They don't function in the same way as the Aussie or Brit work/travel programs, and won't let the OP do what he wants.

@OP: chances are minimal at best that you would get a work visa...but if you still want to hope for that, you're way better off searching it from home then just come here, waste a lots of money, and hope that in three magical months you'll find one. Highly unlikely....lie super highly unlikely. Now, don't get surprised from people who post how you could marry a girflriend of yours and come here to get PR. 99% of the people on this site are immigrating to the US via marriage....just so that you're not surprised if you keep getting that type of advice. LOL :) All the best!

I'm Canadian and have been to Nashville, and just looking at your post in wonder: you're a fashion-savvy Brit and your dream is to live in...Nashville? I swear, this forum provides SUCH an education in world culture!
