Hello

I have been married since 2005, my husband was deported in 2007. He had no legal residency. He got a 10 year ban, he has a criminal record of buying and selling stolen property.

We have 2 children and have waited out the 10 years. I know i need to file new I-130. Do i also need 212 and 601. If 10 years has passed.

probably not, he won't need a waiver, but the 10 years aren't up yet, if he was deported in 2007, the ban will be up in 2017

you can send the i130 a few months before the ban is up, he will have to prove at the interview, that he has been out of the country for 10 years

I'd say he needs I-601 because of the criminal record. However, he needs to go to the consular interview and be denied before it can be filed.
