Timeline

Hello VJ peeps,

My wife just received a letter stating that she needs a medical examination but we sent in the one she got in Norway from the K-1 visa. Has anyone had this experience before? We need help on this!! How can I contact the USCIS about this matter? Any information would be great. We really don't want to spend the money again on one

When you said you sent the one she received from her K1 do you mean the complete package, or just the immunization record form G3025? Most K1s do not have a copy of the complete I693 medical from the K1 as it is in the sealed envelope that is surrendered to CBP upon arrival. Beyond that, you need to look at the date of the first medical done in Norway, it will only be good for 12 months (your timeline shows a K1 approval in November 2015, was the medical done right before the interview, or some time before that), or the possibility that the local USCIS office did not get the POE package with the K1 medical. If it is the latter, not sure what you can do other than to comply with the RFE, it can be a pain, but necessary.

We sent in her G3025 form and that examination was on Oct.5 2015 so it should still be okay...Do know a number that maybe i can contact regarding that RFE? Or once you get a RFE you basically have to do what they are asking for? Edited by Gina <3 Tina

Yes, basically if you get an RFE you have to comply. I don't know of a number you can contact, but others may now a better course of action. Also, did you review this pinned thread and compare it to your situation?

When adjusting from a K-1, you should not have to get another medical if your K-1 medical was done within a year of filing for AOS. However, some immigration officers do not seem to know the policies regarding AOS from a K-1. Some are asked for a new medical, and some are correctly not asked. You now have 2 choices: 1) Send them a copy of the USCIS policies, state your case that you are not required to get a new medical, and risk denial. 2) Comply, get the new medical and get your green card approved.

From what it looks like, it will be better just to get a new medical and send it in. I guess we are just one of the unlucky ones in this case. Thank you so much for your response! :)

I read another member's post that they got the same RFE requesting a medical exam... they posted how they replied, cover letter, etc. and they got approved right after. You can try responding the same way they did and avoid having to go thru another (costly) medical exam?

I read another member's post that they got the same RFE requesting a medical exam... they posted how they replied, cover letter, etc. and they got approved right after. You can try responding the same way they did and avoid having to go thru another (costly) medical exam?

Thanks for this! I have read the tread and when we sent in the AOS package we never sent in the I-693 form because her vaccination were complete. We are thinking of sending a letter and sending in a complete copy of her overseas medical examination. Then just wait and see.

My wife and her 2 boys got the DS-3025 copy but it was blank without anything filled out. So, unfortunately, we had to find a civil surgeon to transcribe the vaccines. Needless to say, couldn't find one that would do just the vaccines so we ended up having to do another full medical because I didn't want to keep calling around wasting more time. Plus, I figured, it could only help since it extends the medical validity another year from now.

We will come back with an update when we get one and hopefully this will work!! If not then i guess we will be doing a full medical examinations again because she's not going back home!! ?
