Age Difference of 22years in Fiancé Visa

Hello everyone,
I am from Pakistan, I want to ask a question regarding fiancé visa of USA:

If the age difference between USA national woman and Pakistani national guy is 22 years. USA national woman is 22 years older than Pakistani national guy, can boy will be able to get USA fiancé visa? Both woman and guy have met in person in UAE & in Pakistan & in a relationship for last six months on (skype, emails, whatsapp etc.). Woman has also valid tax return and own house in USA. She have been living in USA since 1980s on family immigration. Once, that woman had married in Pakistan in 1990s and got the spouse visa of her ex husband but latter on her husband took separation from her in 1999 and since then she never married again.

Will USA immigration department issue fiancé visa with such a big age difference? or will immigration department rejects the case by considering their relationship is fake.
Can someone answer this question?

No one can tell you if you will be approved or not. All we can say is that age difference is not a problem in it self but it will raise a red flag that the guy is 22 years older then the woman and that you are from Pakistan.

Another option is to get married and apply for a spouse visa.

It would b difficult,plus another red flag she brought some one already from Pakistan and later gone spread.this will make consular think that same thing will be happen again useing for GC. Honestly nobody can tell.

Once, that woman had married in Pakistan in 1990s and got the spouse visa of her ex husband but latter on her husband took separation from her in 1999 and since then she never married again.

Is she separated or divorced from the previous husband?

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process

No one can tell you if you will be approved or not. All we can say is that age difference is not a problem in it self but it will raise a red flag that the guy is 22 years older then the woman and that you are from Pakistan.

Another option is to get married and apply for a spouse visa.

What is meant by red flag? That woman has said that I'll file a case through one of the best immigration lawayer in USA. Moreover, she said that it will happen and you'll get visa. She said that USA is not discrimination country but I am afraid what if I stuck in the middle or may be it will take too much lengthy process because of age difference & I am afraid of that. No, I don't want to apply for spouse visa.

Is she separated or divorced from the previous husband?

She herself has taken divorce from her previous husband in USA.

Agree with you, I have also asked her the same thing but she replied that women here even bring 2nd husband to USA if there 1st marriage doesn't work properly.

My husband got his visa and I am 20 years older than him. Every male that goes through the embassy in Pakistan must expect a long wait because of background checks. There is no such thing as normal time in Pakistan. Some males get the visa quickly and others have to wait months or years.

If you love this lady you will wait like my husband did if not marry with a Pakistani woman and live your life there.

Your visa will not be approved in the United States. It will be approved by the embassy in Pakistan. She will file a petition saying she is free to marry and has no criminal background. Once that is approved you must file a petition asking for the visa. All this paperwork takes time so don't be in such a hurry.

Red flag means they will stop up at look more through your case and need more evidens to prove that your relationship is real and not fake.

That you guys are spending money on a lawyer is NOT gonna make this process faster or guarantee that you will be approved! And she's a lawyer so of course she is telling you guys all of that she wants your money.

You just have to make sure that your have a very strong case with a lot of evidens.

She did marry a Pakistani guy and after GC thy most gone spread .what was there age difference at time of marry,she doing again and consular officer will think that it's goin to b again for GC .they msut b think that she bringing people for money .so like everybody say u have to b very strong ties.visa always issue from embassy .if they refuse ur petition will go back,if consular officer asked u will u do marry ur country woman who is divorce and 20 years older from u and ur family accpet it so what will b ur answers. We all know they can ask anybody anything.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

U never know befor u do.anything can b happen.consular have nothing to do with family reaction.they way of thought is different, if u read other fm member post who had there interview.u can read what kind of question they asked,then u will understand what we are trying to say,

If u would b consular and a couple come in that age diffrence in front of u .what will the the first thought will come on ur mind to see them and there ages, makes sense,obvesily GC.
