Wrong Birthdate on EAD and GC... How Did You Fix This? [merged threads]

Hi VJers,

Well after a pretty smooth K-1 process I've finally hit a really great snag. My Canadian heritage messed me up and I put my date of birth in wrong on my EAD and GC applications. I noticed when I got my EAD in the mail today and my birthdate is reversed (8 Jun instead of 6 Aug). I double checked my documents and yep, it's my fault :(

Called USCIS and was told to send a letter to Lee's Summit with an explanation and correction letter. I also sent them a copy of my passport and visa with correct birthdates.

What do I do about the EAD? Can I work, or am I screwed up until my (hopefully correct) GC comes? I've made an infopass appointment just in case, but I worry time is running out and my GC will get approved before I can really fix it...

I guess my main question is:

Can I still work?

I have a lot of documentation about what my real birthdate is. USCIS says I should have a GC decision by May 8, so as long as my birthdate is correct by then can I start a job?

You need to call in USCIS and correct this matter ASAP. This mistake will haunt you later (time, money, headache...) if you don't take action immediately. Good luck.

Update to my EAD case online.

I called USCIS yesterday and told them about the error on my EAD and was given a reference number. My online case status was updated 3 times:

  • On April 6, 2015, your request to correct an error on your document or notice, referral number T****MSC, was assigned to an officer for response.
  • On April 6, 2015, we sent a response to your request to correct an error on your document or notice, referral number T****MSC.
  • On April 6, 2015, your request to correct an error on your document or notice, referral number T****MSC, was completed.

Hopefully those updates mean that they'll just issue a corrected card but it's probably a letter where I have to send my card back.

As for my I-485 correction, the overnighted letter was delivered today. We sent it to National Benefits Center in Lee's Summit, ATTN: Adjustment of Status, PO Box 648004. Let's hope that was the right place and the letter is going to fix the issue.

Hi there!

So I got my EAD last week with an error on it (details here http://www.visajourney.com/forums/topic/543641-wrong-birthdate-on-ead-and-gc-how-did-you-fix-this )

In the meantime, my Green Card interview has been booked for May 13. I am seeing that I will be expected to turn in my EAD at my interview? Should I send in my EAD card and hope it gets replaced, or should I keep it to return at the interview?

This process never gets less confusing!

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Your EAD card couldn't be corrected and sent back to you in a month's time, so hang on to it and be SURE that the correct information will appear on the green card, assuming its issuance. Good luck, and keep us informed.

:( That makes sense but I was hoping for better news... I'm so frustrated and angry that I was approved to work and now I can't anyway.

any update on the correction of your DOB on the EAD?
