I know there are tons of threads on these topics but I'm abit confused so I want to understand my options if any.

Here is my situation - recently got engaged in the last 30 days to a person in India. I'm a US Citizen and although my assets are limited my salary is sufficient to meet Affidavit of Support requirements. We plan to get married in India early next year in a religious ceremony (not registering it). Trying to figure out the best legal option to bring my fiancee here as soon as possible.

Was thinking of applying for a K1 now and then hopefully it would be approved by the time we have our wedding and bring her here shortly thereafter. However after reading the K1 thread someone else posted, I realize that is a very bad idea as religious ceremonies in India are in fact legally binding. From a time standpoint, it would be great to bring her here and have a legal marriage and then go back to India and have a ceremony for families but culturally this is not going to be acceptable. We probably will end being engaged for 8 or so months.

So then I realize my options shrink to K3 or IR1/CR1 - I'm trying to figure out if K3 gives any tangible benefit vs IR1/CR1 and also how long the K3 or IR1/CR1 process would take approximetely. 8 or 9 months after we get married seems like so long from now as then from now it ends being 17 or so months....

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

even marrying here on a K-1, she cannot return to USA after arriving in India for the religious ceremony

until Advanced Parole OR the greencard is in hand,

so

plan accordingly.

regarding K3 vs CR1.

The K3 is obsolete and rarely granted. I would stick with just the CR1. You do not have to adjust status. You can work and travel asap. And the wait is the same or shorter for the CR1.

If you want to have the ceremony in India, you would pursue the CR1 visa path.

8 - 12 months from filing to visa decision. Is the beneficiary male or female? I only ask because in India it is not uncommon for a male to be put into AP (administrative processing) for an unknown amount of time.

Beneficiary is female

Would it be possible for her to come here while the IR1/CR1 is processing on a tourist visa?

it is totally dependent on her to prove ties to her country that she will return.. there is no guarantee.. some get approved for tourist visas some don't .. mine was not approved :(
