Only if they live with you full time and you support them. Otherwise, it is tax fraud.

Call the IRS, they will walk you through a series of questions, then transfer you to the international tax department, ask you a few more questions and then you'll have your answer. The whole process for my own confirmation took about 35 minutes.

The answer is: Married filing separately using "NRA" as the SSN. Here's the thing, you can't enter "NRA" if you or your accountant is using software... so you complete the return, print it out and hand write in the letters, "NRA" where it asks for the spouse's SSN.

If you do married filing jointly, your spouse's international income has to be accounted for and they need either a SSN or an ITIN.

If you are still confused, have your spouse call the IRS.

Just FYI, someone here DID successfully file HoH claiming their husband as a dependant w/o a SSN or W7.

They fully disclosed that it was their husband they were claiming.

I believe there was a hiccup in the middle of the process, but the IRS eventually accepted it.

However you claimed (2) dependents. One of which is obviously not your husband so you have a problem.

I am the husband. I will discuss the issue with my tax preparer and 2 dependents are my relations which he stated where ok to use. I will resolve the issue.

The TurboTax software will actually file HOH with husband not having a SS#. But I caution whoever does this. You being married doesn't make you HOH. You still have to have a qualifier. You may have had return accepted but they have 7 years to come back and correct themselves. And well its the IRS.

Your husband isn't your dependent. Be safe and file MFS until they get here.

Look at me filing MFS I owe $1456. Filing Jointly (and will when he gets here and I amen). I get $345.

Exactly. Probably the taxes were the same amount as HoH or Married filing jointly.
