Hi guys im so confused...

Can u help me clear it up...

simple question... Co-Sponser or Joint Sponser....

they need to make at least minimum sponsor limit for 1 person... which would be $18,387....

USCIS Process - CR-1 Visa

Service Center :: California Service Center

Consulate :: MUMBAI - INDIA

08 / 05 / 2010 :: I-130 Sent

02 / 10 / 2011 :: NOA-2 - TXT and Email ***After Senator Help Was Requested

02 / 19 / 2011 :: Hardcopy Received in Snail Mail

Total 185 Days For Approval

NVC Process - 19 Days to Reach NVC

02 / 28 / 2011 :: NVC Receive

05 / 16 / 2011 :: Sign in Failed

05 / 17 / 2011 :: NVC Case Complete

Total 78 Days for Completion At NVC

Medical / Interview / POE

05 / 26 / 2011 :: Interview Date Received - Packet 4

06 / 07 / 2011 :: Medical - DONE

07 / 05 / 2011 :: VFS Fees Paid

07 / 18 / 2011 :: Interview - APPROVED

07 / 18 / 2011 :: Picked up Visa in the Evening

07 / 23 / 2011 :: P.O.E - Washington DC - Dulles Airport

And will have to count joint sponsor's spouse, and any dependendents of the Joint sponsor on the Joint sponsor's I-864.

for two people it's 18,213.00 for three people it's 22,888. forfour people it's 27,563 for five it's 32,238 and 4,680 for each additional member of family

yeah i already know the poverty limits...

so here is the situation...

lets say i make $16,000 and my parents live with me (same address) they average around $14,000...

we file taxes individually and im not claimed on their tax returns...

so as we can see none of the sponsors make the minimum requirement which would be...$18,387

so in this case i will file I-864 and my parents will file I-864A...

now would NVC combine our income or will i need to get a sponsor who himself is making $18.387 or beyond....

i hope this clears it up...

Be ware sometimes NVC takes into account who is considered to be "Head of Household"

Primary sponsor you will have to provide an I-864..

Parent may try using an I-864A if they are dependent on you, however I have seen this get rejected if parent is considered to be "Head of household" And be requested to also provide an I-864 as a Joint, and in that case $14,000 wont cut it.

If it were me, I would seriously look for a solid Joint sponsor who's income more than satisfies income requirement to support self and intending immigrant.

If parents each earn $14K then you can use one of them as a joint sponsor who would complete the I-864A along with your I-864. If their combined in $14K they could both complete I-864A's to combine with your income.

Are there any other dependents in your parents' household?

Now the interviewing officer at the embassy/consulate may not accept the modest income that you mention. It does meet the requirement, but the CO does have some discretion.

Does one really need to have an employment at the time of filing I-864.

Here's the scenario , I am trying to get answered.

  • Petitioner had income way above poverty guidelines in last 5 years
  • Petitioner's income for the first 4 mos of current year have already exceeded poverty guidelines.
  • However , Petitioner loses the job after 4mos and is unemployed at the time of filing I-864.

What challenges does this pose ?

If parents each earn $14K then you can use one of them as a joint sponsor who would complete the I-864A along with your I-864. If their combined in $14K they could both complete I-864A's to combine with your income.

Unless you have substantial liquid assets, the challenge of finding a qualified joint sponsor due to current income either not enough or consisting only of temporary unemployment benefits.

quick clarification - Do you mean to say irrespective of meeting the income requirements for the current year, lack of employment at time of filing I-864 would make it necessary for me to find a co-sponsor or have substantial liquid assets ?

Unless you have substantial liquid assets, the challenge of finding a qualified joint sponsor due to current income either not enough or consisting only of temporary unemployment benefits.

Yes. The most important thing evaluated on the I-864 is your current situation. They ask about the past but the present rules.
