Question about after I-129F is accepted and my fiance is in the U.S.

After we've married, what will my fiance need to do to be able to work in the U.S.? My dad has offered him a job at a Marina he manages, but we're not sure what we will need so that he can work? Or is we even need anything at all? Also, are there any other forms we need once he's over here??? If anyone could let me know, it'd be greatly appreciated!!! Thanks.

And one more thing: I know before he goes for his interview at the U.S. Embassy that he needs someone to sponser him. My dad has agreed to fill out the I-134F and I was wondering if I would also need to fill that form out? Or is my dad enough?

You have to file for AOS for him to get an EAD, AP and greencard.

He has to have the EAD or greencard before he can work.

Check out the guide section for a full step by step guide on filing for AOS after K-1. Cost is now 1070$.

You must fill out an I-134 regardless of if you make income or not. Because you are the one petitioning him, your dad is only going to help you with the income requirement part.

Your I-129f was approved in 5 days from your NOA1 date.

Your interview took 67 days from your I-129F NOA1 date.

AOS was approved in 2 months and 8 days without interview.

ROC was approved in 3 months and 2 days without interview.

After you marry, you need to apply for AOS (GC) and for the free (when submitted along with the 485 form) the EAD. Either the EAD or the GC allows him to legally work.

You both send in a 134 form and documents.

There are a lot of forms you're going to need once he's there!

With regard to work, the K-1 visa is accompanied by an EAD (Employment Authorization Document) which you need to apply for on the I-765, and allows you to work for 90 days. For tax purposes, he will also need to apply for a SSN, which can be done 10 days after entering on the K-1 (to allow for processing), but no later than 76 days.

Once married, you will also want to file for Adjustment of Status, in order that he may become a Permanent Resident (with conditions). This is not the end of it, either. He will have to apply to lift those conditions at a later date.

PS. How far along are you with the K-1 process? There are also stages to go through and forms to complete after submitting the I-129F.

$1070. You mention using a cosponsor but don't mention the country. It makes a difference. Some consulates do not often accept cosponsors for K1 visa applicants.

Please fill in your timeline and your fiance's (beneficiary) country. In this way, we can better help you and answer your questions in that the answers may be country specific. Also, please read the GUIDES (available as the 4th link at the top of the page) so that you are entirely familiar with the whole process. Sending the I-129 F petition is only the first step...

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

Sorry about that. My fiance is from Australia & I'm just trying to get all the information I can so I don't have to stress over all this later on.

NOV. 30, 2010 - Sent the I-129 Form

DEC. 8, 2010 - USCIS received application

DEC. 9, 2010 - Received I-797C, NOA

But upon reading all of your replies, plus the Guides, I think I have everything I wanted to know.

My dad & I need to fill out I-134 for my Fiance's interview.

Copy of Passport, biographical page (G-325A - I already filled that out with the I-129f, so I don't know if I need to again?), Entry Stamps

Copy of valid I-94??? I tried looking for this form, but no luck?

Copy of birth certificate

Copy of marriage certificate

2 Passport-style photos

Affidavit of Support (I-864)

You need two photos for each document, two for the 485 & two for EAD plus addl copies of the passport info page and the I-94page. Another G325A is required partly because now his permanent address will be different,meaning yours.

The I-94 form is stapled in his Passport. Also you didn't include inyour list a copy of his DS-3025 vaccination summary and the sealed I693 that you had. Local CS transcribe the vaccinations records into. You need to go to the AOS Guides and follow them.

Adjustment of Status is a separate immigration process. Provide everything asked for in the form instructions regardless of whether you submitted something similar with your petition.
