Hi.

I sent my AOS documents 2 weeks ago, and yesterday I got an RFE for I485.

There are two things that they are requesting:

- In order to process your application further, the petitioner/sponsor on Form I-864, Affidavit of Support must submit all Federal income tax documentation submitted to the IRS for the most recent tax year.

- In order to process your application further, the joint sponsor on Form I-864, Affidavit of Support must submit all Federal income tax documentation submitted to the IRS for the most recent tax year.

When I sent the AOS papers, I only sent the W-2 forms from my petitioner & joint sponsor thinking that those would be enough. I guess I was wrong.

So what else do I have to send them so they are satisfied this time? Thanks.

btw. Will they put my EAD application on hold until they get these requested documents?

As the RFE states, they want to see a copy of tax return filings...You can order tax transcripts from the IRS

Check the directions page - when submitting income tax returns(s) you must submit any/all supporting documents (such as W-2's).. submitting only w-2's is not good either (without the corresponding year's tax return). :thumbs:

What year of the w2 forms did u send?

We submitted everything we had for 2007, and yet we got the same RFE. Me and my wife did our tax quickly after receiving RFE, and our sponsors(my wife's parents) couldn't file the tax in time, so we sent our tax return and all the supporting forms and our sponsors w2 for 2008. No update so far, so I don't know if what we submitted was enough.

Rest assured.. submitting only W-2's is not enough.

Is it just the 1040 that needs to be submitted or do any attachments (1099, Schedule EIC, etc) need to included as well? We're going to take our latest tax return to the interview, should we take the whole lot?

But my income combined with my wife's income is already over the poverty line a lot. We added a sponsor cuz our income of 2007 was just around the line. So far, USCIS hasn't complained about it yet, but I don't see any updates either.

You have to have the Tax return and supportind documents, one is no good without the other. (So yes, the whole lot.) :thumbs:

When my petitioner and joint sponsor did their taxes, they kept all the copies that they were given by H&R Block person who did the taxes for them.

So if my sponsor and joint sponsor have their own Federal individual income tax returns, can I just photocopy those and send them to USCIS and I do not have to call IRS, right?
