Would bankruptcy effect a visa?

I am guessing it would i am just having financial problems right now and although i have been trying to avoid it bankruptcy does cross my mind as a likely end to the problem. Of course i don`t want that to then cause me a new problem because the last thing i want is to be stranded away from my wife.

I just wonder if you know of any cases of this happening.

23rd February 2005 Married.

10th May 2005 I130 packet sent to TEXAS forwarded to Cali.

12th May 2005 NOA1 Received date.

14th May 2005 delivered at 4:34 am LAGUNA NIGUEL, CA 92607.

23rd May 2005 NOA1 notice date.

27th May 2005 NOA1 hits the mailbox.

13th August 2005 po po form mailed off with £10 cheque.

2nd September 2005 po po letter arrives.

3rd September a 4 week visit to GA assuming i get allowed in.

30th september 130 days on I130 and counting.

(Hopefully i finally get a wedding ring today too)

30th November NOA2 date. woohoo

January 2006 case arrives at NVC finally(not sure about exact date)

17th February 2006 IV bill mailed back

21st April case complete (sorry i have missed some dates of forms going back and forth)

2nd May case forwarded to Embassy in London

10th July 2006 visa interview 10.30 a.m.

Neither bankruptcy nor bad credit, not even moneys owing etc will affect the petition or application for a visa. There is nowhere on any forms that even requests that information. Don't stress about it :)

It won't affect anything. I'm the USC and I had bankruptcy and it still all went okay.

Late November 2004 Sent out I-129 package

December 8, 2004 NOA2 approved

February 2005 Receives Pakcage 3

Late April, 2005 Sent back package 3

Early August 2005 Receives package 4

November 2, 2005 Medical

November 8, 2005 Interview... success!

November 9, 2005 Received Visa at 9am by courier

May 2 or 3,2006 He arrives in the USA

May 13, 2006 Wedding

July 3, 2006 Sent out for AOS, EAD, and AP

July 13, 2006 Received NOA's for all three

Sep. 21, 2006 Received AP

Sep. 23, 2006 Received EAD. YAY!

February 15, 2007 Approved without interview!! Card ordered for production

February 16, 2007 Mail notice sent welcoming new permanent resident

December 23, 2008 Sent in I-751 to remove conditions

January 5, 2009 Received NOA

February 6, 2009 Biometrics appt.

Well the USC and possibly co sponsor are fine. We don`t need a co-sponsor really but thought it would be better to be safe. I just wondered where i stood if i fell down because times are hard. I am really trying to avoid bankruptcy of course but it is hard right now unless something happens. It is all my own fault of course but i fell into a trap and now i have to get out of the rut somehow.

As the applicant for the visa.......a bankruptcy wont affect the visa either. I have some debts that are impossible to resolve due to my ex and I am 100% certain that it wont affect my application for a visa.

Hello there guys how’s everybody doing here? I have a few questions to ask guys.... I'm a us citizen went back to Philippines to get married... I got married July 16th 2005. My plan before was is to file a petition here in the Philippines for my husband. But I’m worried... I have debt which is not really my fault... while I’m back in the Philippines actually I stay for more than 2 years now. And going back to us this coming 28th sept 07 My big problem was my friend used my credit card and my social security to apply for credit card now my mom told me someone is calling me for my debt. But its not really my fault. Now I have no choice I have to go back to US and file bankruptcy but my problem was I don’t have a job and I cant afford to pay the debt that my friend fault.... so I’m going to file bankruptcy but I’m so scared that will affects my husband petition … can I still petition my husband if I file bankruptcy …Does the bankruptcy affects my spouse petition ... I really do appreciate your help guys and thanks a lot. mwahhhhhhhhhh

Sorry that this has happened to you.

As it has already been stated here, bad credit has no affect on your petition, however there are two things you have to take care of (1) Country of Domicile (need to read more on this since you have been away for 2 years and I am not too knowledgeable on the subject matter); (2) your ability to show that you can your support your spouse since they will ask for tax transcripts, W2s, etc (unless someone can co-sponsor with you for your husband).

I'm sure there will be good VJ pals that can share more information about what's the best course of action and or provide you with key pointers for your case.
