    Why would she lose LPR status? If they travel every year or have re-entry permit for 1+ years and show intend to return, like having a house in US, filing US tax return for both. Isn't that allowed in green card?

    I am a legal permanent resident of the U.S. but I wish to remain outside the U.S. for over one year. Is it possible to do so?
    Under current regulations a legal permanent resident of the United States (i.e. a person holding a green card) must return to the U.S. within 364 days of the last departure in order to retain status as a permanent resident. If the person has obtained a reentry permit (form I-327), the person must return to the United States within the validity of the reentry permit in order to retain status as a permanent resident. Reentry permits cannot be extended, and applications are only accepted in the U.S. by the U.S. Citizenship and Immigration Services. See www.uscis.gov for more information.
    Having said that, staying few days every year and going back might be frowned by CBP about the intent to be an LPR.
    She can apply for re-entry permit at first. Apply for 2-3 years and if she is lucky, she can get what was asked or something close to that. Before the re-entry permit expires she can come and possibly try one more time before she leaves. While it is pending she can go back and if it is granted, fine, if not, just come back in an year.
    My mother did like this to take care of an aging parent and there was never a problem. She never applied for citizenship, since she abandoned her GC and took a 10 year multiple.
    The main point is to show intend to return. As a GC holder she should file tax returns every year. If you have a house, add her name and maintain financial and other ties to the US.

    Affidavits will not help. You need independent 3rd party evidence. Get credit card bills showing putrchases across the border. This is the only thing that will help under the circumstances. Don't bother with affidavits at this point. You can ask friends to write whatever. Focus on 3rd independent party evidence.

    As far as I understand, 10 year ban is and deportation is not an issue. It is over and you should not focus on this. What will be hard to accomplish is prior criminal history. Assault with a deadly weapon is a VERY serious crime and will be nearly impossible to wave. Under the circumstances I would make sure you have a very good lawyer and that he can make good arguments. This is the only chance. Very slim though. Counting on what people say here is not right. The only thing I would use visa journey members advises under the circumstances is getting a good attorney. Good luck!

    I do not think applying for student visa is the cause for denial while having relationship. I think the likely cause is that he failed to disclose that he applied for visa in the form before the interview. Did he indicated that he applied for visa and get denied in the form DS-156? If he did not this will definitely be a problem.

    Actually, you misread my post. I am not necessarily eluding to the scam. What I am trying to say is that you need to know exactly what happened. I mean precisely. This way you can address. it. If she is 100% truthful about it, it is easy to fix: just show that it was abandoned or withdrawn. If petition is abandoned (not withdrawn) it expires automatically within 4 months, noe exceptions. If this is the case than this is simple computer error that needs to be stratified. However, if in fact there is another petitioner with approved I129F with less than 4 month you have to know it to stratify it in a different manner, i.e try to make it work other way, like re-applying.

    So that everyone calms down. There are only hand full of reasons why someone can get denied at I129F stage:
    1) Not free to marry
    2) No meeting within last 2 years
    3) Not responded to RFE (to prove above two points)
    4) Already married to the beneficiary
    There is no other possible reason for denial. I am sure it is one of the 4 above. Others: please, calm down.

    To make long story short - it is absolutely feasible. My wife is a blonde and lived in mexico (Tijuana) for 3 months, no problem. OP, it is not as bad as you think. You just need to make sure she lives in a safe area. I cannot say about Juarez (it may be worse then TJ) but I feel on the news it sounds worse then it is. We spent wonderful 3 months in Mexico. BTW, our situation was not as desperate as yours: we met 5 times in different countries and Moscow before moving together and living in Mexico. Actually, it was fun, we felt people were very welcoming. The only problem is if you plan to cross the Border daily to go to work (Natural. certificate/birth Will not even cause them to ask question. Promise) you will encounter long lines. Let me know if you need pointers on living/renting/crossing border with less line and less wait. I can give a lot of tips on it just contact me directly.

    This is incorrect for Mexico. As a US citizen you can ravel on your DL up to 50 miles into Mexico absolutely legally. You can also return carrying your either Birth or Naturalization Certificate back to US. I traveled back and force into Tijuana and back into San Diego every day just on naturalization certificate as I did not have passport - I was making Russian visa for 2 years at he moment. No problem and totally legal. Now, regarding Mexico: while my fiancee and I were waiting for NOA1, I rented apartment in TJ and commuted very day to work o San Diego. NO PROBLEM. I highly recommend meeting in Mexico. It is extremely easy to get Mexican visa in Russia. I recommend this route.
