    Let me summarize:
    1) you have a person that you have kids with from your home country;
    2) This person married USC and gained citizenship.
    3) this individual, once obtained USC divorces his wife, marries you, and is trying to get you and your kids to US.
    So far so good??
Now, you are asking why CO turned you down??
    I can only praise CO.

san diego got a reaction from milimelo in Is it legal to record the CR1 Interview with CO
This is not about labeling countries, etc. This is about protecting country as well as protecting USC petitioners from scammers. This is a very common scam in MENA, African countries, for young guys to reach-out to older women via social media, lure them into love, getting GC, and abandoning them once they get what they want. Thus, those measures are also set to protect petitioners. Not that there are no exceptions. I am sure there are few exceptions. However, COs trained to look for signs of fraud. This is not about them showing their power. They are just following their guidelines.

expiration date on visa foil is the last day she can enter the usa. any i-94 governs her stay in usa.
    scenario:
    visa expires 11 october.
    entry on 10 october.
cbp goon gives 120 days for i-94.
she must leave on day 120.

American fiancee cannot cancel his visa. However, she can provide evidence to the swiss authority that this guy is just fishing for ways to go to the first world country and that he was dishonest about his intentions with swiss authorities and thus they should cancel the visa.

This is some risk in this. There are number of cases that I read here that were denied from VWP for one or another reason. http://www.visajourney.com/forums/topic/292498-i-485-denied/. Unlike adjusting from other visas, there is no appeal for VWP. So, this is your risk, which you may or may not. If I were you, I would search "denied AOS VWP" here and make informed decision, deciding your level of risk tolerance. Peronally, while I would do AOS form B2, I would not do VWP AOS. This is just me.
You already near NOA2. The chances are that your K3 application will be changed to CR1. You are looking at 1 month at NVC and another 1-1.5 months till interview. Is this worth the risk? You are almost there...

Agree with previous poster. That is how my passports are at the moment and have been since 2007. I've never had and issue entering the US.

Tie old passport behind the new one with a rubberband thru the center of the booklets; carry them as one so they don't separate.

I know that expired passports might get holes to make them cancelled by appropriate authorities. Make sure that the visa doesn't have those holes if it does your father in law has to get a new visa. My grand mother had that problem before and CBP almost sent her back to my home country.

Don't be arrogant. That gets you nowhere on this site and in the world, period.
You, my friend, started this thread, shared your story (which has strange parts to say the least - 4 years jail for hair pulling), you asked for advice.
I do you a favor and make this my last reply. You tell us not to talk about your dad and not you. But you and your mom's situation has a LOT to do with your dad' chances of staying. So talking about your PTSD and depression is not off topic as you think. To get your dad back, you and your mom have to prove that without your dad you two would go through extreme hardship. Not to us, but to people in the legal system, who are more skeptical and brutal than us. But that won't work. You are an adult. PTSD and depression is not an excuse. Your mom's emotional distress and health problems are not an excuse either. You have to get yourself together and support your mom.

Personally, Under the circumstances I would try to answer the following questions yourself:
    1) Do I have enough resources to bring her and her daughter here based on the associated costs?
    2) Do I have enough resources to pay for the first several months of them being here and for medical insurance?
    3) Is your wife's profession marketable in US, how quickly she can find a job and what is anticipated salary?
Then I would create your own financial plan, which assures that you will no go under. Once you do that I would decide:
    1) Can I get Co-sponsor which will be safe from any financial liabilities based on my plan? If not, will this C-sponsor be willing to pay if there is a situation where financial assistance is needed?
    This is just my view.

Many countries including the US require those wishing to immigrate to do so with an immigrant visa.
Some countries it is OK to visit and change status, Different folks different strokes.
I would have thought most countries have a public charge requirement.
