    I called them. Talked to a guy. Gave him our 2 case numbers (AOS & EAD)

    1) AOS-- looked up our local office said they're currently interviewing those from March 27/2010.

    He said we're getting an interview since Family AOS is dealt w/ the local offices and we aren't getting transfered.

    2) EAD-- Said it went to the National Benefits Center and right now they're taking 3 months to process.

    Since you are filing AOS from K1, there is a good chance that you will be transferred to CSC and may not have an interview. But even if you do, I can't imagine it taking more than 90 days from the AOS filing date, to get the interview. NYC is one of the busiest place and last I checked NYC is interviewing IR1 cases from July 2010, he might be referring to some other category and no Marriage Based.

  2. Since you filed 10 days before me, I should presume (depending on your local office), you would get your interview letter in the next week, positively. IIRC, you are adjusting from a non-immigrant visa too?

    Yes, from H-1. I know I should use the other forum but this is more popular :) besides I dont think there is a huge difference in the timeline, if any, between people filing from K1 and the ones from non-immigrant visa.

    based on what I have seen and heard NYC is slow but some people have gotten it. Keeping my fingers crossed that the interview is for the end of October or after 1st week of November.

  3. I just spoke to the congressman office to see if they received my paperwork and they advised they have already contacted USCIS and to call them back in a week if they don't call me beforehand..

    On my letter of offer I was due to start work today.. I desperately need to accept this role and worried the company will not wait any longer.

    Fingers crossed.. Does anyone know normally if the personnel at the congressman's office does make an impact when roughly I could get some movement or approval on the EAD? Does it take weeks, days?

    From what I have seen here, it can happen fairly quickly, as quickly as the next business day. BUT the issue with your case is that you have not received the Bio letter, so I would say about a week or week and a half - just my guess...as it takes about 4-5 days to receive the bio letter, from the date they issue it. Then one or 2 days for post bio and then EAD will be issues in about 4 - 5 days.

    Sorry, this probably doesn't help but perhaps you can negotiate with the company so they can understand the limitations.

    I am a 'July 2010 Filer' but no interview for me yet :(

    I am getting worried now. Looks like the process was much faster in 2009....

    also, it looks like Southern California is taking a longer time on average.

    Took you over 2.5 months to get the interview letter. That tells me I will have to wait for another 3 weeks for the letter :(

    By the way, how come you got NOA2 for I-485, 12 days after you filed the application? Also, did you get NOA2 for I-130?

  5. To be fair to the I/Os on the phone - since they receive hundreds of calls with vague questions with no urgency, they tend to speak whatever comes to their mind. I called USCIS up, and talked to a 2nd tier officer yesterday to enquire about the status of my AOS case, I was told it takes 9-10 months for interview letters! I had called because my cases are not available online yet.

    You don't have to be worried anytime soon. As long as you get your EAD on time, a couple of months here or there with the interview should not be an alarming situation. Best of luck for your immigration journey :)

    I am actually travelling during the first week of November and then for 2 weeks in December so hoping that they dont schedule interview during those days. More concerned about the travel in December as its our Honeymoon and have significant financial committment for that trip.

    PS: Couldn't resist calling again to get a better response :bonk: This time a very knowledgeable and patient gentlemen explained said that my AP has also been approved (Website does NOT indicate this) on the same day my EAD was approved and since its all going so well without any RFE, he expects to have the letter soon.

  6. No interview letter yet. Turns out my case has been in queue for interview date but has been cleared for Name and Background check. Need to travel and hope it wont have any conflicts with the interview date.

    Saw some people from NYC already got their interview dates, so as long as my NOA1 history doesn't repeat hope it will come by the end of the week.

    Not sure what got into my head and decided to call USCIS to find out if they have scheduled an interview for me. This time a very assertive lady tells me that I am 'way ahead' in my expectations from USCIS. She said the interview can take about 1 year and my case has not been transferred to the Local Field Office and until it does, I wont get an interview letter. In fact she said 'you will not get an interview letter anytime soon'. By the way, this was the second level IO.

    When I referenced my earlier call where I was informed that I am in line to get an interview as of Sept 7th or 9th (I forgot the exact date), this lady told me that whoever I was speaking with was wrong as she 'knows this process very well' and I should not have my hope high. :angry:

    I am almost positive that this lady is wrong as its not taking anyone 1 year (when applied for marriage based GC), unless some significant issues with the case but its still nerve wrecking to find out that my case has not been transferred to the local field office (NYC) and she is probably right on this part as if it had, I would have received the interview letter.

    Not fair that people with Receipt date past mine are getting interview letters and not me :angry:

  7. Thanks for the advice, I have contacted the congressman's office and they asked I complete a privacy release form.

    My question is will they still look to expedite the employment authorization even though I am still within the normal processing times?

    Well, if biometrics is between you getting the EAD then they'll make sure you get that. Your objective is EAD, which is what you should emphasis on when speaking to the Congressman personnel. I would not focus too much on Biometrics, from what I have heard people have gotten EAD approval email a day after biometrics. Not sure if that was the result of escalation but it can happen.

  8. I am in exactly the same situation. My notice date was the 17th of August and still no biometrics appointment. I called last week to log a service request and was told I need to wait the 30 days. Today I received an email from USCIS stating I had called them and logged the service request and that my case is suspended until I complete my biometrics. Its really starting to bother me as my case hasn't even yet been transferred to the CSC office.

    I also have a job offer and they are now starting to lose hope as this process has taken so long and I am still far away from an approval.

    I sent an email to the local congressman for assistance but haven't heard back if they will be able to help.

    Its also starting to cause strain on my relationship. I am just so over the whole process

    Please go to the congressman's office ... if this is causing all these types of issues. USCIS has to respond to congressional inquiry so it will expedite the process significantly.

  9. I just called USCIS now (or better, I let my wife call because I can't stand talking to them) and we didn't pass drone level 1. Anyway, they sent a request to figure out why I didn't receive the bio appointment yet, and it's going to take other 30 months. In all this, I have a job offer pending that I cannot take until I receive my EAD.

    Should I wait, or should I go straight to my Congressman's office this afternoon?

    If you have a job pending I would go directly to the Congressman ASAP. Even if you had gotten to the Level 2, they probably would have done the same. Going to the congressman would definitely expedite the process of EAD. Take all the documents showing pending offer.

    I am waiting for the interview letter as well. If you check this link, and filter by interview location (New York City), you'll see some from August have already gotten their interview letters while some are still waiting. So weird the way NYC office works, dont think they follow 'First Come First Serve'.

  11. p.s. someone told me to expect the interview letter approximately 2 weeks after my original biometrics appointment scheduled date-- not the walk-in date. And i remember that being fairly correct. Good luck at Federal Plaza! You'll probably get the I-551 stamp on the spot, which is great. But be prepared to wait for the interview (there is a snack machine in the hall)!

    Interesting! Some people who filed after me have already received their letters, some even from NYC. But I guess 2 weeks is a good benchmark, I'll wait a bit longer. Heard NYC is a bit slower then other offices, I guess probably more busy than others too.

    Thanks for the heads up on the wait and vending machine, I definitely would have thought that it'd be a 2 hours ordeal at most but definitely isnt for NYC.

  12. hi M+M. Me too, i still don't have an interview letter, but i just received an email for my ead (card production). How did you know that your interview date is already in queue? did you call them or something? :innocent: Some people said the NY office is kinda slow...

    Yes, I called to see if I can expedite the interview but I didn't quite met the criteria. Anyhow, they said the case has been in queue for interview schedule since Sept 9th.

    Was informed that my AP hasnt been approved, not sure about EAD as none of my cases have been touched in a month.

    To your point, yes NYC office is slow but I am seeing majority of NYC people who filed around my date, some after me, has received the interview letter. Well, except you but lets hope it come soon for us both :)

That is the problem I am seeing many members already getting their biometrics appointment and we having similar time lines I still do not have mine… I work on a Federal Agency and when I see our workflow and how long it takes for us to process cases…. I cannot imagine being in a similar situation having to wait so long…

    Having similar timeline gives a good reference point but does doest guarentee that you'll have similar timeline. There are always outliers, just like you.
