On the topic of not treating their citizens well, I agree. As soon as I entered the NYC consulate, which is located at one of the most expensive area of the city, I could feel that I was in a different place. The doors are unpainted, door knobs broken and jammed and worst of all, they did not have heater on the floor where all the applicants come to. There was an air condition blowing room air temrature which was odd. The receptionist, like everyone else working there, was wearing winter (furr) jacket, with her hands in her pockets. And the temperature these days was -3C.
In a room where they were processing Passport application, a gentlemen sitting on a desk had a name plate 'Manager', was reading Jang News, while the room was full of applicants waiting to get their applications reviews.

Thanks for the info. I have my mother and sister there but if this process is a hassle, I dont want them to go through this. The only reason I am getting NICOP is because I needed a Machine Readable Passport so I could visit my sister in Dubai. Though my current Passport is valid, its hand-written and apparently Dubai does not take take hand-written PAKISTANI passport - another benefit of being a Pakistani citizen

I just got my Biometric letter, notice date 1/28/2013 and i will have them take my fingerprint : 02/22/2013.
But, what i wanted to know if i get an info pass then go to my local USCIS, and if i ask them if i can get my fingerprint taken that day and i wanna know if that will work?
I want to have my fingerprint, taken before 02/22/2013.

If you want to get finger printing done early, you can stop by at the Service Center address on your bio letter and try your luck to see if they would allow early bio. You DONT need infopass for that.
Early biometrics/finger-printing happens all the time, I did mine earlier today at NYC, but it depends on the service center you are asked to go

I applied for the NICOP here in NYC Consulate, so to get the Machine Readable Passport. Does anyone know how long its taking these days to process the application? Website says 8-10 weeks, and there is no way to expedite. On top of this, the email notification says the online tracker will not work for at least a month after the filing - I doubt it will work at all.

There would be no impact on your ROC petition if they dont call you for interview. The only consequence would that you wont be able to apply for Citizenship on 3 year program
Just hope that they dont call you for interview in case you might be divorced by your interview date - I am not sure what would happen if they do call you for interview and you are no longer married to the USC you filed with.

with me, my wife came into the states on november 27th, 2010. we got marry on december 18th, 2010. my wife wasn't working not until the year 2011. becaused of us getting marry in december, 2010, of course we did not file a joint tax return. i change my status from being single to marry. becaused of being marry in december, 2010, i don't have to send a copy of tax return for 2010. am i right or wrong?
I think you should still send it since you filed it as 'married'

Hey, you're filing the N400 in November?? I thought it's 3 years after green card? May got her first green card in March 2011, so we were planning to file March 2014. Do I have that wrong?
Your window opens 90 days prior to your 3 year LPR anniversary (Provided you have met other requirements: Stay and Marriage). I got my conditional on March 15, 2011 so planning to apply later December this year
Agree with the others, looking forward to the N-400 more than the adjudication of I-751. Wish they had given the conditional card for 3 years instead of 2.

No pictures? You need evidence showing living together and co-mingling finances etc.
Read the guide - it even lists family pictures.
I assumed the OP is referring to Passport-Size picture. If not, I take it back because I sent our family pictures as an evidence.

Walk-in Biometrics also Successful! Got the letter today, appointment was for 3 weeks from now at an inconvenient time so I decided to try my luck.
Where was your bio appointment in NYC? I have mine coming up in Queens, thinking to go early.

Yeah, no pictures required this time.
I didnt go too fancy this time, had sections separated by binder clips with removable post-it notes. I avoid stapling, instead use paperclips for small stacks and binder clip(s) to bind the whole thing to the cover paper.

I dont think they have a new form published yet.
I am not sure whether it would be OK if you ship it by the expiration date but I had a bad experience with an expired I-485, back when I was going through AOS. They took a while to send it back. Unless someone here is absolutely sure that you'd fine as long as you send it by expiration date (tomorrow), it wouldn't hurt to wait a few days to see if USCIS publishes a new form. You could also call USCIS to confirm.

My husband, his mother and two sisters all had green cards about 20 years ago. But they where stolen, a police report was filed but no further action was taken to get them renewed. Can anything be done at this ponit? or is it to late? I have already filed a I-130 but if there is anythign i can do to get him here sooner because of the fact he had a green card before, I am all for it. Anyone can help me with this????
You dont mention whether they left the US after obtaining green card or if they have been living in the US for past 20 years.

You should get a divorce and apply i-751 waiver on good faith marriage.
Beg to differ from this suggestion.
You should do whatever you need to straighten out your marriage may that be getting back together or divorce, and this decision should NOT be based on ROC approach. If your card expires in August you have a few months before your window to apply opens, and hopefully by that time you and your wife can sort out the marriage - till then work on figuring out the solution to your marriage

Crazymazy, I know exactly what you meant by not having to deal with immigration sh*t for two years. They need to modernize the process. We should be able to file everything online and they need to automate a lot of the steps. Things would get done a lot quicker.
Although I agree with you on modernizing the process, my recent experience dealing with my country's immigration authorities reminded me that USCIS is still far better than we give them them credit for.
For example, to renew my national ID card, I had to provide the authorities with the left thumb print on the application form. The person I borrowed the stamp pad from, was laughing (rightly so) at the fact that I need to take my thumb print to place it on an application form. I was initially glad to find that I can track the progress of the process that takes 3 months but then was utterly disappointed when they told me that the online tracking will work 2 months after I file my application.
So yes, I think USCIS is still far better than majority of immigration authorities across the globe

Surprised how long this thread has become. Given the possibly of fraud, I believe the adjudication of marriage based residencies (conditional or ROC) is highly subjective. I am sure there are some check boxes to establish minimum requirements for the evidence however, each case and respective evidence are different. My wife and I are an interracial and inter-faith couple - something not too common given my nationality and background, I felt compelled to send pictures of us together with her and my family - pictures say a thousand words! On the other hand, sending pictures would appear redundant and needless for a Pakistani who married some from Pakistan - a very common occurrence.

What about your tax returns/transcripts from 2010 and 2011? I dont see those in your list, they are more important than 2012 given they two year history. If you are sending 2010 and 2011 tax transcripts/returns, you really dont need to send 2012. My take on 2012 returns is that unless you are filing after April 15 2012 (Tax filing deadline), you have a very valid case of not sending 2012.
Also, on your other evidences, did you take any trips together in the past 2 years? If so, I would add copy of itinerary showing both your names. Any common cards suchs as Costco, Sams Club, etc could also help. Utility bills showing both your names also helpful.

The delays are simply due to poor planning from USCIS. I believe they raised the fees recently so to hire more resources but doesn't seem like the plan was to stay atop or on target to meet the defined deadlines. Eventually things will go back to normal when they realize that the backlog is building up but till then, as they say in Queen's land, Keep Calm and Carry On.
The bureaucratic culture inherently supports poor planning and resulting delays, and this isn't just USCIS, its pervasive in almost all governmental organizations across the world.

Poll is applicable to LPR who got their residence through CR-1 (Marriage to USC) and had to file for ROC to get 10-year GC. Seems like some people meet the 3-year residence requirement for the Citizenship while waiting for ROC approval, curious how many didnt wait for the approval before applying for N-400.

If you have two years of joint returns, then that probably is sufficient as an evidence from tax perspective. You can file the third year (this year) separate and not send third year tax return as an evidence since tax returns are only one of many other supporting documents.
If this year is your second year filing as married then you should file the way it makes financial sense (separate in your case) and send it along with a note that you filed separate as it was financially better option than to file jointly, and that the returns indicate you live in the same household nonetheless.

So, since they sent back your package to you and they no longer assign you to a NOA1? I see that you received NOA2 for Biometric
I was replying to someone's post whose package was returned because they signed with black ink. My ROC package was never returned

A very strange and crude comment. OP wants a GC and/or Citizenship, just like everyone else on this forum does. The difference here is that the OP doesn't know that he can get a GC even after getting a divorce by filing for Waiver. I am sure you wouldn't have liked to be judged, so why judge others.
@OP - your evidence is fairly good and on par with others, you need to apply for ROC with Waiver (since you are getting divorce), no need for your to look for other avenues. If your divorce ends with good terms with spouse, get a letter from her stating that the marriage was in good faith. Tax transcripts are one of the main evidences that gets reviewed during ROC, and its OK if you didnt work but your spouse should have files it as 'Married' and therefore can be used as an evidence.
