You are right M+M, it does say black ink.... I'm glad I read your message, I was about to use blue ink. I originally used one of those water-based gel inks, and I was able to see it smear when applied moisture to it ( I wonder if they thought of doing that at USCIS-a simple experiment). Anyway I have decided to use an oil-based ink (black) and I see it's not as fine as the original.
I also decided to add more evidence of our marriage (might not be necessary, but it wouldn't hurt). I hope the return was for a good reason at the end of the day.
Although I had read the instructions, I still used blue ink to sign and black to fill in form. I dont think that using blue ink for signature would be or should be a problem.
What bothered me was that if they are telling in the instructions to use black ink to fill the details in the form then most likely people will use blank ink to sign as well, and in that case its hard to tell whether its ink or photocopy, so why even check!
-
Sigh!!!! My package was returned today. USCIS claims my petition was a photocopy, and my original signature was not ink ... it was in black ink and original because I did not make photocopies ( all my documents were scanned and saved on my computer). I will use a blue or green or pink pen!!! so they know it's original signature ( no more black ink) . I will update once I mail it out.
Thats just ludicrous. The very first item on the Step-1 of the instructions says to fill out the form with Black ink. This is beyond idiotic because either its part of their normal review and they are wasting time to check whether black print is an ink or not (for all thousands of cases they process) or someone at USCIS made up his or her own rule to check this

Just mailed mine to VSC

I thought I read somewhere that you also need to include a copy of your passport...double check to be sure.
Thanks, I just looked at the instructions and it does not mention Passport anywhere.
Finally, sending today
-
I got the utility bills for selected month, will move that to the residence sections.
Thanks for the note on the medical bills, download the dental and medical claims for past few months (not able to get more than a 15 months).
-
Do you have any affidavits? If I were you I would get two affidavits and you are good to go.
No affidavits, our parents dont live near us and seems like an odd request for close friends. Can I get an RFE based without an affidavit?
-
Preparing my package and hoping to send it off tomorrow or the day after. Wanted to double check and see if anyone thinks I am missing any key items. What do you think?

Thats what they told us yesterday on the phone, wait time is 12-18 months...
What happens after the Conditional GC expires and you are waiting on application? Can you travel, stay legal, etc?
-
15 more days and we will all hit 6 month time period.
I am about an year away from ROC process but curious about the implications of this delay. If the window opens 3 months before the CGC expires then how does one stay legal or travel outside the country after CGC expires while ROC application is in progress.
Sorry for beating a dead horse, I just popped in VJ and wanted to see what was happening within the USCIS - things do not look good!
-
The length of stay in any country can change once you are there, no one will actually count how many days you were in any country and at the beginning of the trip, no one can tell for sure what will happen. Schengen visa can be used for entry in any country of the area. A walk-in to the Netherlands embassy is maybe the best shot, but, in case that does not work and it is possible to make some itinerary changes, You might be able to land in London and get the visa there, or in Switzerland (both not in the Schengen area)
And, extending the reservation in Amsterdam can get you through the rules if you happen to run into some stickler. You can always change reservations later.
Thanks, that was helpful. I got an interview appointment at French consulate for mid-August just in case.

Most of them dont assist Non-US Citizens. Already checked a couple

Wife (USC) and I (US Perm. Resident) are planning a Europe trip in September of this year. We land in Barcelona, spend 3 nights there then fly to Paris and spend 5 Nights there, then to Amsterdam and spend 5 Nights there. Fly from Amsterdam back to Barcelona to spend a night and catch the flight back to the US.
Originally I was planning to get visa from Spain but turns out there is a 2 month wait period to get the interview (and I fly early Sept this year), freaked out a little as we have already made all reservations including European travel and travel in less than 2 months. Did some research and found that I need to apply the Schengen Visa through the European country where I spend the most nights and if I can not determine that then obtain the visa from the country I enter through (Spain).
Since I dont have time to wait 2 months to get visa through Spain, I am planning to apply the Schengen Visa through the Netherlands embassy here in NYC that does Walk-ins everyday. Since we spend equal amount of nights in Paris and Amsterdam, would the Visa officer say that I apply through Spanish Embassy? Or would I have problem landing in Spain with the Visa issued by the Netherlands?
Although we have train tickets from Paris to Amsterdam, I extended the hotel reservation for a night in Amsterdam to show 6 nights. Would that help?

Thanks everyone! It was an eventful journey

You mean your ROC (I751) package got returned and NOT AOS (I485).. Its in a wrong section. But anyhow...
When my AOS got rejected due to wrong version of form, I sent everything as is, except for the new version of the form.
-
I really doubt the Camera use. There is too much cost and time associated to this activity. Also, this is too smart for the USCIS to implement

Hi everyone,
I am filling I-765, application for employment authorization, for extending my permission to work while waiting my green card. I am possessing a legal employment authorization card now but will expire in Aug 31, 2011, so in the very beginning, I should check the box of "permission to accept employment" or "renew of my permission to accept employment". Many thanks.
Paul
If this is your first time of getting an EAD while waiting for the GC then check the "permission to accept employment". The 2nd one is valid only when your CURRENT EAD Card expires and your AOS is pending.

What exam is it?
-
How did you go about doing your walk in for the Woodside, NY location?
Thanks
Waited for the actual Bio letter as it would have the location you need to go to - Brooklyn/Manhattan will probably be different, though some people have gone to a different ASC than what was in the letter. Showed them the Bio appointment letter, just said that I wanted to come in early and they didn't say anything. Worked out well.
-
Hopefully I am the exception and not the representation of the NYC cases. I had to get Congresswoman involved to get the interview letter. Some NYC people who filed around August 2010 also faced delays compare to the other locations but pretty much everyone had the interview letter by late November. So about 4 months. So I'd say that if you dont get by early April, you may want to reach out to the congressman's office. Most of the people on the phone, even the second level IO are clueless about how long it takes. If you tell them that most people get it in 4 months, their response would be that 'every case is different' - BS!
One thing you need to do is find out where your application is in the process. One of the second level IO told me that my case was marked as 'Ready for Interview' as of Sept 3rd by the NBC. Surprisingly when I called later and spoke to another second level IO, they refused to provide me this info, in fact told me that no such info can be looked at by any IO. When the congresswoman's office reached out to NBC, they mentioned the Sept 3rd date again ... so its really hit or a miss when calling but if you can find that your BG check is done then there really shouldn't be a reason for them to delay.
-
Got approved! Yayyy!
IO stamped the passport but didn't say anything about Condition but I am sure it will be on the card when it arrives.
-
Interview tomorrow
-
I don't have either in my husband's name either. Owned both prior to our marriage. Is there a huge age difference between the two of you?
I obviously could be wrong but I think its the race more so than the age, in this case.
Something I am worried for myself Wife is Caucasian.
-
congrats.... which Congresswoman did you contact?? how do you find out who yours is, and what do you say??
Good Luck
I found her through http://www.house.gov/zip/ZIP2Rep.html and they asked me to speak to a person in her office deals with the immigration related matters. I told the whole about history and delay, she wanted the copy of receipts and wrote to NBC and NY District office.

I agree, it should be the date when one receives the NOA1, because so many times these letters get printed early on and are never sent out or sent out really late. So the date the applicant receives it makes more sense than the date on NOA1
