  1. Just an FYI...I never got ANY emails even though the form was included. I ended up only getting the hardcopies in the mailbox. I must be one of those 'lucky' ones....my case status still isn't online either.

I won't mind if I don't get the emails, I just want the darn application to be accepted. We are going to honeymoon in beginning December so if anything else happens I will probably wait a month or two before filing. Otherwise interview could fall during the honeymoon.

Strange that your case hasn't come up online, I guess till it does, you don't have to worry about the 'touches' :)

  2. Wow, that's good! I sent our package certified mail with return receipt and we received Friday the return receipt from the Postal Service, but that's it so far. The receipt was stamped "USCIS CHICAGO LOCKBOX" and stamped "Aug-3 2010". No emails yet from USCIS and check still not cashed.

I don't know either why there aren't more August filers. Hard to believe there are only 3 of us.

Mine was also delivered on the 3rd. We have the same date/time line and you are officially my 'AOS pal' :)

  3. Hey all!

I'm writting to you cause I'm so confused right now. My I-485 has been returned with an I-797 C that says

"Based on the information you provided, your priority date could not be established. Please resubmit your application with the proper documentation to the address listed on the bottom of this notice"

I haven't heard anything from my I-130 but it hasn't been returned either. Can someone explain what this means and what am I supposed to do?

    I'd appreciate a prompt reply. :)

Which box did you check where it says "Part 2 - Application Type"? ... on I-485

  4. I haven't yet received the letter for my Biometrics appointment, but it has only been 17 days since USCIS received my stuff. Can I go and try to do my Biometrics early before getting the letter which states the date of my appointment or do I have to wait for the letter before trying to do my Biometrics early?

    Thanks

Were your checks cashed? Did you sign-up for acceptance through G-1145 form?

You need to wait for the hard-copy letter from USCIS to even try a walk-in Biometrics. It appears that it has been taking about 2 weeks for people to get that letter, provided the application has been accepted.

Yours should be coming any day now.

  5. We have been living together for the past 4 years, all of our docuents, lease, etc is joint and pics and witnesses are available. My bigger concern is should I change my lawyer and should i be prepared for anything besides what the court charged me with : OVERSTAY.??? Just so I am not blind sided by the court.

Also, PLEASE CORRECT THIS FOR ME if im wrong: does immigration NEED TO KNOW about my forms of relief applied for on the FIRST master hearing and can not file after the removal proceedings start?

What makes you think that your lawyer does not support interracial marriages? If you really believe that then you should have left him long time ago, the second you sensed this.

Though I am not familiar with the overstays but by reading immigration forums I think that overstaying a few months should not be huge problem. And given that you have gotten rejection on AOS enforces the fact that your lawyer didn't do his job! I would consult with a good lawyer, probably through some reference (here or some other forum/community). Pay him and present your case and see what he has to say on how you should proceed. Do some research and if his advice makes sense, leave your lawyer.

  6. Thanks for the encouraging note

USPS just came to deliver the package ... finally!!! The rejection notice was as of July 16th and was post marked on July 21. So, I have absolutely no idea why it took sooooo long to get to me. Anyway, I am glad its back. Here is what I saw on the 797C:

    1) Other than the outdated form, they said to "submit form with the appropriate fees to the address listed on the bottom of this notice". On my check, I had "US Department of Homeland Security" and they put a stamp of

    US Department of Homeland Security

    Citizen and Immigration Services

Do I need change anything on my check?

    2) They stapled a lot of things that I may have clipped together using paperclips. Should I remove these staples? I am thinking to add a couple things (Tax Transcripts) in addition, wonder if that would cause any issue since they have numbers on each of the document.

  7. As you can tell from my timeline, I filled out the outdated I-485 and realized 2 days after sending the AOS package. Based on recent similar instance here at VJ, I thought my application will also be returned in about a weeks or so...

...Well, its been over 2 weeks since their have had my application and I have not received my application rejection letter/package. I even filed G-1145 but no updates, no checks were cashed, no NOAs, etc.

So here is what I am wondering... should I just start preparing a new AOS package? I have a copy of what I sent, other than the I-693 (Medical) I have everything. So the medical might be the only hardest thing to get. I can have my bank cancel the checks.

What do people here think? I have tried calling USCIS but they have this '30-day wait' response no matter what, I contacted local Post Office but no avail...

Any suggestions will be much appreciated!!

  8. I have not received mine either, I also filled the wrong version on the form so already know I should be getting mine back soon. Its just that I have NOT, yet. I even filled G1145 for email and nothing. I called USCIS customer support who said that 'it takes 30 days for them to record this in computer' and that point I realized that talking to that person was useless as it isnt true. They also said that even when they return they record information on computer before returning and so far she could not see anything under my A-number.

    Hope yours NOA comes through!

Still have not received the returned application or the notification of any kind. Wondering if I should just start creating my package again and send it off ... without waiting for the previous one to return.

Dont know why they are taking soooo long. Its been over 2 weeks!!!!

  9. Sheesh....they are getting slower then. I received mine back exactly 10 days later. You should be getting it any day now. Yeah calling them is pointless, they just give you the 'wait 30 days' #######. After that they give you 'wait 45 days" and then after THAT its 'wait 60 days". Have more luck banging your head against the wall then talking to them. I'm sure everybody will probably end up getting theirs by the end of the week. I think they just have a huge pile on their desks and they are only 'sorta' in order. I'm waiting after 6 days for my NOA1, so are 2 others I believe and another from 8 days...yet one got theirs today. The average is 10 days so I guess anywhere from 6-14 days would be normal.

Did you fill out G-1145 when you sent back again? Not that it tells you any sooner than the cashed checks.

  10. Wowww! good for you! At least yours is moving....Mine was received July 19 and signed by L.Box....but until as of today no Texts, No emails from USCIS....and i am getting worried :(

    AOS TIMELINE:

    Sent AOS Package --------------------- 07/15/10

    AOS delivered & received ------------- 07/19/10 (signed by L.BOX)

    still waiting..................

Hope yours NOA comes through!

  11. Still have not received the anticipated rejection letter (neither the NOA), hoping it comes tomorrow so I can refile. Ready with an updated form.

By the way, I made the check of "One Thousand & Ten Only". Do you think thats the way to right it? I hope it doesnt matter but curious...

Just spoke to the mailman, still no returned-package. Its been soooooo long since I sent and they received it. They really need to send it back to me so I can submit the correct forms.

I guess no point calling anyone as my application is probably not in the system either :(

  12. We got a rejection letter because our "check amount is incorrect or has not been provided"

I made the check out to "U.S. Department of Homeland Security" for 1010.00 and then wrote "One thousand ten dollars and 00/100 ------". The check has "Carla MaidenName" at the top and then I signed "Carla MarriedName" at the end. What is wrong with the amount? Or it just that the check was in my maiden name and I signed in my married name? :help:

What about the check of $355.00 for I-130 form, did you include that in there too?

Did they send the whole package back? I sent mine the day after yours and expecting mine back too as I had used outdated I-485. Wondering when will it come.

  13. oh no! which form I-485 did you use? The one for download on USCIS website expires 12/31/2010....

Did you get your form from elsewhere? Sorry to hear!!!!

I used the one that expires 11/30/2011 with Revision date of 12/16/08. The latest one has a revision of 12/03/09, I am pretty sure I downloaded from USCIS website but doesn't matter at this point.

  14. thanks lil mermaid... right now i'm just checking my bank acct incessantly.. waiting for those checks to cash!!! :D i've never wanted money to leave my account as bad as i do now! LOL!

Noticed your filing and Chicago's receiving date is the same as mine. It would have been nice to have a same-date-mate but alas, mine is coming back due to out-dated I-485 :bonk:

  15. Thanks for the updates and suggestions. I think am going to follow what FrostyMist did and LiLMermaid suggested. Also, I posted a new thread asking the same question and someone also recommendedthe same thing to send just the updated form.

I noticed AP and EAD forms also have an updated version but they are acceptable. Since forms are easy, I will send the updated EAD and AP form but will keep the other documents as is. Its just too much work to re-collect all supporting documents.

    PDF is a good idea!
