I totally agree. I read through USCIS and I don't see anything that makes her eligible. Ultimately it all comes down to be petitioning her which is a lot to ask.

PS I have never heard of the form or terminology you refer to and I am sure if that was the case then hundreds of thousands if not millions of illegals would be using this route,

She send this to me and say base on this she would be eligible to file and after I read it I don't see how it applies to her. I come here to clarify because even though she claim she can petition to adjust her status on her own she asking me to complete the I-130 form which would make me petition her. So am just trying to make sense of things.

The requirements are on page 43 of the I-485 that she's referring to. Please see attachment.

A family member could petition but the interview would be at a consulate and the lifetime bar that had accrued due to the overstay would have to be overcome.

Usually in these cases there are additional items such as work under a false SSN or claiming to be a USC.

 

Probably time to get a lawyer.

Yeah, am confuse cause that's what I thought. I have a sibling with overstayed. But they were told they could adjust their status on their own after being here for quiet some time by completing the I-184 along with the other documentation. But she would be eligible under Continuous residency  (registry) under the I-184 but when I read it, it doesn't appear that way to me.

If someone enters the U.S on a tourist visa and decided to overstayed their visa and remain in the U.S 5 or 6 years. Can they file to adjust their status to permanent resident? Would they be able to petition for themselves or they would a family member to file the petition on their behalf?

My status isn't updated yet and I have received the approval letter this week,so am hoping in a week or 2 to get the actual card.well I do hope that you will get the physical card soon but the letter is good enough like you said.

I received my approval letter in the mail today.It is dated September 06,just 1 year and 1 week from my NOA  date.by the way am VSC filer.

FINALLY got my letter in the mail yesterday. I don't have the card in hand as of yet however it says I have been approved and the card should be in the mail within the next 60 days. I know it will probably make it to me by Monday of next week latest.

The NOA was dated 8/30/17 and received the letter 9/6/17.

We went to the USCIS local office on 8/3/17 and they said they wouldn't look in the system to check the status because it can take up to 2 years... I called the USCIS Service Center after and the two people we spoke to said that the case wasn't assigned to an officer and that there wasn't an acceptance or any update. 

 

Wanted to share that info, because clearly what was actually happening was different. There is hope for all of us! Wish everyone the best- cheers to another chapter in the books!

Does anyone know what the notice date on the I-797C (biometrics letter) for I751 means?

My I-797C notice date is September 17,2016 but my-I797 (Extension letter) receipt date is August 30,2016.Just want to know what's the difference and if the priority date means anything?

i have everything ready aside from the N400 filled out - which is a 30 minute job.. still debating..

I want to become a citizen and to put immigration behind me but apart from Jury duties what else is there to worry about after becoming a citizen?

my agent stamp was wrong cause she stamp me for something else..so she did some writing and explaining on it and then stamp again (reseal it).

If I didn't go in for the I551 stamp I wouldn't have known that my file is in Nebraska service center.The agent didn't say it was transferred either and she said  that she don't know why it's there cause NSC don't adjudicate I751 which makes me worried.I wish it was sent to CSC even though they are behind but at lease I would know it's gonna get adjudicate and I could check processing times for it.NSC don't adjudicate I751 so there's no way for me to check processing times.so am just gonna be waiting and waiting and waiting and don't know what's going on.Like you am dying to get this process over with.I can't wait for the day I no longer have to deal with immigration (USCIS and all these service centers).Being that yours were transferred to CSC maybe you will soon get a notice in the mail or you lawyer can do an inquiry.

Sounds like your in similar situation to me.My agent did messed up the stamp and had to make jottings and then reseal it.Hopefully it won't be an issue when I have to present it to DMV. did you receive anything in the mail about your file being transferred to CSC?

Thanks for letting me so,so the agent could have me panicking all for nothing..I just wish there was away to check I751 processing time for NSC but since they don't normally adjudicate them there's no way to check.I am just hoping I will get my approval soon.

Thank you and I certainly will do the infopass..I probably won't be doing any kind of followup until if my case is out of normal processing time.Been waiting almost a year now and had been patient, so will continue to do so and hope I will get my approval soon..Good luck to you as well.

There is a reason why they transferred your file somewhere else, and you will never be able to find out why, so I would just relax without assuming for the worst part. I have been waiting for 11 months and 6 days, i filed to CSC that is processing very slowly. I am focusing now on 400 preparation. You need to manage your stress, otherwise, it will drive u insane, you will keep assuming the worst case scenario. Try not to panic, they most likely are probably just vetting your application. I would not lose sleep over this. If they really want to let it sit at that center without processing it, then I have heard you wait for 1.5 years or 2, and you file a class action lawsuit against the government, but I think it is highly unlikely it is going to happen. well I thought that's what would happen if it's the wrong place.Like I was thinking if VSC sent other files that isn't I751 mines could got misplace in that box and sitting among pile and won't get looked at.I am  concern cause of how the agent reacts as she's very concern about it.She never said it was transferred either.so it doesn't sound like it was transferred at all.I am wondering if the info could be an error but like you said I will never know why it got there in the first place.Before I got this information i was planning on sending off my N400 this month and that's still the plan.

Yeah,I know that but that doesn't mean am gonna sit back and let is sit at NSC and don't get process.so am definitely gonna be doing infopass.I am waiting for VSC to pass my NOA date and put in a service request.

I hope so but am still worried since I file I751 with Vermont and now being told it's in NSC that doesn't process I751,Not only that I didn't get a transfer notice and my status doesn't reflect it.I also see where I751 were transferred from VSC to CSC,there's nothing about I751 being transferred to NSC.I just feel like my I751 has taken a detour.I am really hoping the agent will investigate so they it can get some sort of attention and get to the right center.

I went to my infopass appointment today.They took my state ID,passport,extension letter and green card,all were returned to me at the end and I got my I551 stamp. Anyhow I was told by the agent that my I751 is in Nebraska.She told me that Nebraska don't adjudicate I751 so she don't know why it is there.She cannot see if security clearance was done or anything being done to it.I know when I file my I751 I sent it directly to vermont service center so I don't know how my file ended up in Nebraska.The agent said she will do some research and If she finds any information she will contact me,But I highly doubt she will look into it.This was not the news I was hoping to hear.I'm in panic mode and don't even know how to proceed.Does anyone know if VSC would transfer workload to NSC?any feedbacks?
