    Well, no more complaining from my part, that's for sure.... this morning the Consulate emailed me the invitation for my interview: Next Thursday!!! And when I read the invitation, it mentioned guests, dress code and that it takes from 0830 until about 1300.... So I just emailed the lady again and - the oath will be done right after the test!!!!!!!

    So I gave in and finally called the military help line to check on my status My paperwork was received at Frankfurt Consulate on 28 February and I should be hearing from them within 30 days. The VERY nice person on the phone told me that our military mail addresses here are sometimes slow to receive mail (very true, unfortunately) and to maybe check back with the military help line to double-check the status and make sure I'm not missing an interview invitation because of it. I will also email the consulate again and make sure they still have my email address on file as well as our physical address in Germany so they can send an invitation there. I guess things ARE actually moving along... Wooot woot!

    You say school hasn't started yet- you may want to try to move back to the college in California. He cannot threaten your F1 status, and he cannot get you deported.

    Look for a new college for the summer term, anyone who uses your immigration status as a threat is not being true to you. This term will be over in 3 months, don't allow someone to derail your education

    Doesn't sound like a relationship you should continue. Good thing you found out before getting married. Don't try and make this abusive and controlling relationship work. Find a church, or a woman's shelter, or talk to the police, and get out of this situation as soon as possible.

    Immigration officer are people too. As such, some of them are more friendly than others, and some of them may have a bad day once in a while. The I.O. you encountered may not have liked you very much, but there's nothing you can do about it. Your "job" is it to prove -- somehow -- that your marriage is legit. If you failed to do that, they will either send you an RFE, or invite you to a stokes interview, or deny your AOS petition outright.
    I.O.s are a bit like cops. They won't like you more if you file a complaint about one of them. Your main objective should be to gather the evidence needed to make your case. Fill up a joint bank account; put your car title in both your names, buy insurance in both your names, get AAA cards, a joint credit card, stuff boring and normal couples have. If you felt uneasy about the way you were treated at the past interview, I can't even imagine how you may feel after they put you though a stokes interview.
    If you want to win this fight, it's going to be by their rules. They have all the power, you have almost none.

    I see what you are saying but he didn't come back with the intent to marry but to just re visit me again . but it turned out for the best for both of us. The marriage was just a spur of the moment thing and from then on we did what we had to do, initially we just tried to see if he can get an extended visa but they didn't say we could so we went with the AOS and I-130 route.
    You can't help who you fall in love with and when, and that is why it happened and we couldn't be any happier, just like the rest of you all!

    I doubt paul or anyone else thinks all Muslims are terrorists but like it or not, it's getting harder and harder to sell "it's just a few bad apples messing up our Peaceful religion".
    IN the USA we have been fortunate with our Muslim Citizens, I heard today something like 75% of attacks in the UK were from UK born Muslims.... now THAT is a serious problem especially if it is a sign of things to come.

    It is a fact that adultery in Islam is punishable by stoning. This is something that every Muslim knows and by virtue of belief in Islam accepts. The process for proving adultery is not as easy as it seems. Four witnesses have to physically see the actual act with their eyes. They have to be truthful people and known to be truthful. This is Islamic law. Its clear that in practice it would be very hard for adultery to be proven unless a) the couple were intimate in the street or b) either party confesses freely.
    In these countries that claim to follow the shariah there are always glaring problems with the execution of the punishments. Either there is no real proof or its just hear say so women are killed unjustly. Islam isn't unjust.
    I think it is ironic that the Catholic church who spent years shoving their own systematic abuse of children by Priests under the rug has a need to speak out against a practice that, again, should be extremely difficult to execute if the proper rules were followed.

    I think you mean "elite" and out of touch, right? Because god forbid anybody call out stupidity or fail to recognize the legitimacy of these people's wack world view. Whatever happens, the most important thing is to pretend every voice is as meaningful and worthy of respect as every other. The average is king.
    One of the most embarrassing things about the recent political climate is this tyranny of the mediocre, this agreement that we have to prove our regular-guy cred and go to any lengths to obscure all evidence of "elitism": anything that might point to a distance between ourselves and the Average American--the average American being intellectually unengaged and chronically ignorant, poor and angry and insulated from the rest of the world.

    I'm not just like the people in that video. And as I'm not a politician, I don't have to pretend I am. The right has successfully put smart and educated people on the defensive about being smart and educated. Even blueblood legacy ivy leaguers on the right like Bush must dig holes and wear cowboy boots and remind you that they are Just Like You. Bullsh*t. But everybody understands: you must pretend you grew up with a 37-toed cat and one shoe to share around a family of 8, no chance at college and you must hunt your own dinner.
    I noticed one of the things in the list of Tea Partier principles or whatever that It's a Madhouse posted was that average people should be in political office more or something. Please no. Are we officially to the point in our collective worship of the mediocre that we are willing to sacrifice our own well-being? I demand that our office holders and leaders be the cream of the f*cking crop, the smartest, wisest, most aware and dynamic people we can get. Smart people are still capable of compassion and common sense, still capable of acting in the interests of the stupid, the ignorant, and the less advantaged, all. They just do it with fewer misspellings.

    oh i hope the OP hasnt done anythign yet!!
    the worst thing you can do (other than default on a loan) is to get a "secured card" because on your credit report it will read like you are bad credit risk.
    go to a store you shop regularly, a grocery or something, and apply for store card. once you have that in hand, use it responsibly! dont buy anything extra, only needed items you would have purchased with cash... keep the money for it in your checking acct (keep track of your charges against what you have in bill paying checking acct)
    you will begin to get offers in mail... ignore these. you want one or two GOOD cards, not a bunch of junk ones. contact discover card and citibank and apply over the phone. you may get turned down first time but once you get one (or both) of these you're golden. same with store card, only use for needed items and make sure to pay balance off each month - NEVER carry a balance.
    once you have had this for awhile call them and tell them you need a higher credit limit. dont try to bump up too high too quickly but if you dont have at least $1500 at first, bump it to that now. if you have several thousand then bump to over 10k.
    you're best bet is to tell them you have several purchases in mind and leave it up to them how far they will bump it -they will usually give you more than what you would have asked but this is best saved for last good bump up.
    your credit score is based on what type credit you have, how much credit is extended to you, how you have paid, how long you have had that credit - so you want GOOD cards, not a lot of them (2 good ones with high limit and a store card in any amount are perfect, dont want a lot of small no good cards), pay these cards off in full every month, and keep them forever (dont get then cancel crappy cards).
    in a year your credit will be awesome and in 2yrs you will be untouchable. check your credit report every 2yrs minimum (yearly is best, especially if you have a common name!) and this is MOST IMPORTANT = never never never share your credit with anyone. even husband wife, each of you need your own cards and put other as authorized user. sometimes it is necessary to have a joint card, in this situation ONLY is it ok to apply for an additional card whihc is joint, but stick with citi and discover. and make sure the limit is low (i.e. $500)... they may try to start you out much higher if your credit is good by that time but do NOT take that, call them and lower it.

    Congrats to all getting their EAD's, AP's and GC's approved, we're nearing the end of our journey's, at least for now For those still waiting, keep your chin up, it won't be long now

    Let's not be so quick to write off the OP's suspicions as vindictiveness or sour grapes. The quoted line here warrants more exploration, and he also said that the wife's sister did the same thing. Elaboration is needed.

    Well folks there are always two sides to every story, two lawyers in every court case, two people in every divorce case, and two parties for every immigrant visa.
    People seek a GC not because they want or don't want to live in the US, but some people seek a GC for the privilege of entering when they want.
    The mere fact that a person from Cambodia wants to return to Cambodia does not mean that person intend to stay permanently in Cambodia. Thus it is possible the marriage started out as a sham and ended up a sham.
    On the other side, women in Cambodia typically marry by consensus of their parents while deeply influenced by the better life offerred in America. And it's not just Cambodia, I bet this applies to most countries with low GDPs and third world status. Do women marry for a better life? Of course they do, particularly, if the immigrant comes from poverty or lack of education. And being in America for some is an oppotunity to that better life. I have seen many Cambodian cases where the petitioners in the U.S. make big promises on the quality of life in America, inflate financial earnings and assets, and present a bigger than life picture to the intending immigrant. Of course such bubble will pop in time. It's a tough decision for both sides and I have seen many cases where people have married from a few months to several years with children, yet still end in divorce. This is not fraud, this is poor choices.
    Based on my personal observations, I have come to recognize that it isn't so much a case of fraud but more or less a culture shock. Depending on the incoming immigrant's background, it could be a simple case whereby the intending immigrant was not able to properly and timely adapt to the new culture. As a U.S. citizen born in Cambodia myself and current consultant and advisor for companies engaged in development work in Cambodia, I can attest to the fact that many Cambodians whom have lived a major part of their lives in Cambodia seldom get used to the working hours, working ethics, and social order in America. It is difficult to take a person from a country like Cambodia and expect to adapt and adopt the American way of life in such a short time.
    This could be a simple case of the petitioner failing to understand the needs of the immigrant, and as much, a possible failure on the immigrant's part to adopt a new culture. But I don't see this as a case of fraud, but a case where both sides having made poor decisions.
    Next time know the person you plan to marry more before rushing to get that person a greencard.

    "Commonwealth" is a ceremonial term that four states apply to themselves to celebrate the fact that they have a certain amount of autonomy from the federal government. The fact that Pennsylvania refers to itself as a "commonwealth" does not make it any different from any other state. Puerto Rico also refers to itself as a commonwealth, and it is NOT a state like Pennsylvania.
    A legal annulment in Pennsylvania can only be obtained if there are grounds that the marriage was never legal, and should never have been granted. Any one of those grounds would have made it practically impossible for the OP's wife to get a K1 visa. For example, if either of them were under the age of 16 when the marriage took place, or they were close blood relatives, or either had a mental defect that made it impossible for them to legally consent to the marriage, or either of them were still legally married to someone else. It would be pointless for the OP to even investigate getting an annulment, much less actually trying to get one. Even if it WERE possible to get an annulment, it would not be any different from a divorce for the purposes of the OP's wife's immigration status.
    When something is a matter of opinion, then it's perfectly fine to offer your opinion. When something is a matter of fact, then you make sure you know the facts before offering advice. Following advice based on faulty information may not do any harm, or it may end up being a huge waste of time, but in the worst case it could end up being devastating.

    Amen Jim. I'm a lawyer but crucially not an immigration lawyer so I never, ever offer anything in the way of advice under the guise of being a lawyer because I could very well be wrong. When I'm sure of my facts, I offer them as such (and never in a professional capacity); when I have an opinion I make sure it's clear that's all that it is. Dabblers in laws covering the validity of marriage, and whose knowledge is gained from a quick google, really should think twice and maybe fifteen times before posting things that could be of real consequence.
