    Having a conditional LPR card vs the "10 year" has no bearing on his eligibility to apply. The law states that if the application is based on marriage to a US Citizen, he or she is able to apply 90 days prior to the 3 year anniversary of being admitted as a Legal Permanent Resident (date on card).

    If the 2 kids are your blood relatives (you have the same dad), you can apply for them as well. And technically, yes, you are responsible for the relatives that you bring in (see second link I posted). But, once your dad is a LPR, and can bring his wife, he will be responsible for her...thus putting you on the hook by association if you catch my drift.
    Also, your dad's visa won't take as much as his petition for your stepmom will, because citizen petitions vs. LPR petitions do have different wait times (citizens have higher priority).

    Wow, scare tactics and misinterpretation of the TOS are bliss for some people here. Then I started thinking, why is there a forum about AOS from multiple visas, B2 included?
    As Valerie has said, it is possible, I am another example of this. We had no problems whatsoever, and we are now done for 2 years...
    To the person that said you cannot get into the US and marry, you are wrong. My now wife stayed with me in Mexico, we got married, and came back to Mexico. Adding to this, a couple of inspectors talked with us about how we'd go about living together. Back then we were planning to go for the CR-1, but after a couple of weeks with her in Tampa, and a talk with my lawyer, we made the decision, without breaking any rules.
    An IO needs to have a really terrible day in my opinion, to start arguing about intent. This is very subjective, unlike other red flags out there. If the OP, like many of us, DID NOT intend to stay permanently, and then changed his mind, and has the means, it is an option.
    Having said that, it all falls on the intent to immigrate. If you enter the US to stay for good, you are toast. If you decided to stay after planning to be with your wife, you are good to go.

    I wouldn't place the entire blame on the folk labeled as bigots, they have deep rooted views that come from the times when there was little to no diversity. It's funny though, because when told that their country is a land of immigrants, they say that it's a prehistoric view...
    With telecommunications booming over the last 20 years, a lot of people have explored different cultures, customs and other factors of societies around the world. Today, the only reason not to be in the know, is lack of interest, because it is more comfy to don't give a #######.
    It's way more easy to hate a whole bunch of people, then to stop and just hate the extremists in this case. Don't worry, that's the extremist view as well, so what makes you better than them? That you didn't destroy a part of their house? Think again. That you are not trying to force your views or way of life into them, just like they force theirs into ours? Nope...
    By this reasoning, the terrorists have won, I think it would be way more American (note that there's a difference between American and redneck) to say, ok, you screwed us over, but guess what? It doesn't change who we are or what we stand for. Just sayin'

    The thing here is that he wouldn't be eligible for one, based on his illegal presence in the US, for such a long time. He is paying for his parents' mistake, because he was brought here illegally. That makes him a criminal? Wow people, you really impress me. How dare that 4 year old stay with his parents? Why didn't he go back to Mexico when he was 18 and independent? It's very easy to judge and deal justice when something is not happening directly to you.
    A whole lot of "if's" can be taken out from this and similar cases, but truth is, he won't be able to stay unless someone like a Senator steps in for him. It's sad really, because regardless of him being illegally here or not, he is way smarter than a lot of people here. Oh well, life stinks sometimes...

    Dude, I don't mind a smart talk, but this is everything but. Double standards? How did that kangaroo poop-filled fishbowl of a cranium come up with that? I have stated that I am against illegal immigration multiple times, but I am also against, yes, again, EXCESSIVE force. Ever crossed the border on multiple times? Didn't think so. My wife happens to think some of the CBP agents were just... bad, and she is an American friggin' citizen! Imagine what they can do to an illegal.
    Anastasio Hernandez was shocked and beaten to death by 20 agents, 20 to 1... if you think that is justified, you are a sad, sad person.

    As far as SB1070, it depends. There is a huge gap, similar to the one between your neurons, between arresting people and checking their immigration status based on an offense (DUI, robbery, etc.) and stopping Jose the plumber on his way to work because his skin is brown, regardless of the fact he was born there.
