    Yes, you made a mistake by saying 'No' to that question. You should've selected 'Yes' because you committed a crime for which you were not arrested. You say you didn't get arrested but at the court house you were charged a felony. Now felony is a serious crime, a troubled thing for this good moral character rule for applying to citizenship. I don't get it though, judge shouldn't have decided something until you were properly counseled by a lawyer. Now remember I basing my opinion that you did commit a crime by the '5 years of unsupervised probation' that you got. If you weren't committed you would be scot-free without anything.
    Also your citizenship application would've denied (my guess) if you were within that 5 year period but since probation is long over, all should be good. If you have all court dispositions, I would say don't worry about it. Just remember USCIS have all the info, expunged or not, they know everything.
    For traffic violation, you don't have to tell them anything about it, it's a civil matter. Only you're citizenship won't be approved if there's an unpaid ticket etc. Since you paid for it, don't worry about it. My guess that traffic violation won't even come up

    With that age difference, in one of the highest fraud countries, the chances are just about zero of getting a K-1. There is no need for anyone to sugar coat the fact that it won't happen. Even if you get married and file for cr-1 you will still have a very HARD uphill battle. Good luck.

    did you guys ever think that, what immigration is asking sometimes is not even done by many USC marrying an USC, I don't think everybody has a shared account, but they expect you to do this when you're an immigrant lol

    You can still travel normally while the ROC is pending. You will be given a one-year extension of the greencard that allows you to travel and work normally when you submit ROC.

    It was at 7:30am and we got there at 7:45am. We were called in around 8:30. Interview took around 10 minutes. It was with an asian guy (with accent). He didn't ask me any questions. He asked couple questions to my wife and that basically was it. I still remember the questions he asked my wife.
    1. how did you two meet?
    2. he finished school?
    3. seen his family members?
    4. has he seen your family?
    and that's it.
    He then asked me those classical questions on the 485 form, to see if I am a terrorist. He was really nice, he smiled often made jokes. He said he would've approve me right there if I didn't have my F1 status problem back in 2006 (a little background info for you guys... I lost my status once, was called in to federal plaza to give statement) so he said therefore he'll have to review the case and I should get a response soon.
    It was a pleasant experience, I should receive the card production soon. I am sure.

    lol we had somewhat same experiences, He wrote something on my passport with a pen lol same same thing. it reads 7/27/2011 I485 pending section 245 cr6 lol like you say anybody can write this.

    we applied on the same date i did my biometric earlier than you but it is what it is you just never know how it turns out.

    Ok so this really doesn't apply to me but I believe this is a mistake and VWPs shouldn't be allowed to adjust status, period.
    Why? coz like many have said you are a tourist you came here with a special program and you don't even own a visa, visit the country and go back. On that notion a B1/B2 tourist visas shouldn't be allowed to adjust status too, they are too are tourists.
    It shouldn't/doesn't matter if you had intent or not, it shouldn't be allowed.
    On the other hand work and student visa should be able to adjust, now i am not saying this coz i am an F1 but because...
    an F1 student or an individual holding an H1B is living here for many years. A student roughly lives in the States for 4 years. Learning the cultures etc.etc. his/her mind adjusting to the country... same goes for an H1B person, they can carry it for 6 consecutive years... so adjusting from student and work visas MAKES SENSE.
    But allowing a VWP or B1/B2 to adjust status is just doesn't make any sense. and even should be considered fraud/illegal from the start. Like i said before, so called `intent` is irrelavent. You can't have a sudden change of hearts once you are in the country! `Oh i guess i like it here i am gonna stay...`. No no this is just wrong, what's worse is it is not FAIR to those on IR1/CR1.
    but you know what guys... yes current system doesn't MAKE SENSE but since it is approved, I think we should all shxx the hell up, including me

    Personally I think they should either allow any spouse who can legally enter the US to adjust status from within (whether they enter on VWP or obtain a tourist visa) or they should allow no-one to adjust status from VWP/visitor visa (I'm not including work/study visas here), except for some extreme situation such as after travelling to visit one's spouse the home country said they would kill you if you returned or, you know, something. Or you have some accident in the US and cannot travel. As for fiances, the K1 should also be changed, which would have to depend on what they do for the spousal visas. But I really don't like the current double tiered system, in which ignorant and/or criminal-minded people win out over everyone else. (By which I'm not referring to the adjusting of status on VWP, but rather the entering on VWP with the intention of immigrating. And don't anyone take this too personally. If someone is ignorant of the rules/processes governing immigration that is not a slur or insult to them, it's just a fact. It's pretty hard to avoid being ignorant about at least some of the immigration laws ) The current system isn't fair and just doesn't make any sense. Someone who visits their boyfriend on VWP and spontaneously decides to marry can remain in the country, but I who decide on the day before travelling to marry once I arrive am then supposed to leave? But can visit again and again whilst waiting for the visa? Not that anyone seems to care what my intentions are after the fact, but I do. Plus if one just reads the instructions for the AOS forms one doesn't know that there is actually no need to prove that one did not have intentions when they entered on VWP.
    If AOS is something USCIS like, then they should be even more open about that and just change the rules so more people do it. I could actually have AOS'd "legally" at one point. I had returned to the US to visit my husband, with NO intention of staying longer than 90 days and only intending to file the I-130. After filing the I-130 I did look at the AOS process though. Of course, it would have cost more. But I was also concerned that I had no way of proving that I had not intended to AOS when I entered the country, despite that being the truth. (Anyhow, I had things to do in the UK.)
    My main point: the current system just doesn't make sense.

    Interesting ruling. I'm a little surprised and don't believe that adjustment should be allowed from VWP, makes those who spend months apart feel cheated.

    just receive my internet update on my wife case for RFE. I think it will be th Fingerprinting.
    Now the question is for those who already had earlly Fingerprinting at the Newark ASC. is it true that they do walkins only on Wednesday?

    Submitting the 3 most recent tax transcripts does offer firm proof that the sponsor has complied with the requirement to have filed those returns. If you've got them, send them.
    Current and continuing income is what is most important. Don't worry if the income in those years is low if the current income (2010 and present) meets the requirement.

    Put 00 on 21.© because you are already listed as 01 in 21.(a)
    You are suppose to fill the 2nd and 3rd most recent Total Income. You are only required to show the most recent tax transcript only. The 2nd and 3rd tax transcript are optional but would be helpful.
    Don't forget to include the recent W-2.

    While i don't know still telling her `time's running out` wouldn't solve anything. she might act the way you want, say things that you wanna hear to ease the things, just to gain some time, so she could get her permanent residency.
    I mean how you are going to live through your lives together, knowing that all this issues, it's just doesn't make sense to me, I just believe there are certain things a couple should never experience, or say to each other, some things are irreversible.
