Oh my Lord why bother, they are going to just pull it apart anyways. All you have to do is put your papers in order cheque on top and place it in a plastic sleeve and then put in a business envelope. We used paper clips. don't go stapling anything makes it harder for them to pull apart. Just make it simple. An inch think man what are you sending?

No one will be able to tell you on the phone what the RFE is for. Just wait for the letter.

You are wasting very valuable electrons, and while we are all here to help, at some point no one will read your posts at all since you don't seem to get it--how many times will you ask the same question and refuse to believe the answers which always come back the same?? I was actually hoping that your new post would be something new, but alas, here we are again.
You have regularly demonstrated that you don't have a clue--have you chased down a single approval that occurred in under 100 days to understand their unique circumstances?? Didn't think so !! If you ever do, post the results here and then compare their situation with yours to see if there is any direct comparison at all. Use your time wisely while you are waiting.
Someday you may actually need help, and by then no one will be reading your posts except newbies who can't help anyway. Do yourself a favor and think before you write.

My wife is a very traditional Vietnamese woman, and she tells me repeatedly that I'm the boss of the house. She also makes darn sure that I'm well aware of how she feels about each decision, and what the consequences will be for me if I don't decide the way she thinks I should.

I understand your frustration but it is this way because many people try to cheat the system. If there is anyone to blame, it is those who try to come here under false pretenses and not the government imho.
Also, illegal aliens are not exactly welcomed with open arms (although I agree it sometimes looks like that). But it is true that they don't do much to get the illegal ones out of the country again.
I'm just wondering, did you get your petition denied? And if so, on what grounds?

I agree that we should not judge. However, I agree with previous posts that we should not help people that committed crime of entering this country illegally. I live in California and I am tired of those illegals eating up my taxes!
They don't pay taxes and they receive all the benefits.

:thumbs::thumbs: Oh Gosh I so agree with you this is ####### telling her how to stay illegally or get back here. She broke the law and that's it.
She's not a bloody K1 visa client she broke that right when she did not marry the first guy.

Personally I'm against this change. The VWP clearly states it is not ok to change status while entering the US on a VWP, so imho they shouldn't even do this. People sign the VWP and it is basically a contract as such. Changing status on a VWP is a breach of contract.
I am from a VWP country myself and could've gone that way. Instead I've chosen several years ago to go for the expensive route, with a long wait time. That is how it should be for everyone, also those from VWP countries such as my own. Seriously, why bother even going through K1 or K3 if you can just go on VWP and change status without any consequences. It's just wrong.

Allowing VWPs to apply for AOS pretty much makes applying for all other visas before coming here irrelevant. Why bother applying for any other other visas if you can just come here as a tourist and adjust status if you feel like staying?
People who overstay their visa have broken the law, and once again the Government is looking to reward those people. Where is the incentive not to overstay if all you have to do to protect yourself (and eventually become a LPR) is apply for AOS?
Things like this annoy me. Most of us here did everything the legal way, put our lives on hold for months on end and paid the required costs, and now they will let anyone do it without a valid visa?
There is something seriously wrong with that.

The inconsistent answers to the questions about her kids is not the reason you are in this mess. They conducted a Stokes interview, which means they had serious doubts before those questions were asked. They didn't view any of the evidence you brought, so there is NO WAY that this suspicion arose at the interview. They had strong suspicions before the interview ever began.
I strongly suspect that her first husband is the reason for this. You said he got his citizenship through her. He also has custody of her kids. Fathers don't usually get sole custody of the kids in the US unless the mother is found unfit, or she simply has no emotional connection with the kids. If there are any other unusual circumstances with the first marriage, like if they divorced before he got his 10 year green card or if there was a VAWA claim involved, then that would only compound their suspicion.
They focused their questions on the kids because they want to know how a woman could live with her new husband for more than a year without having regular contact with her children, and without her new husband also having regular contact with them. This situation makes it look like she had no emotional investment in her previous marriage, and therefore no emotional attachment to the children produced from that marriage. In other words, they suspect that first marriage was a sham to help her first husband get a green card, and now she's interviewing to help her second husband get a green card. 2 + 2 = ???
Your attorney has failed you miserably. When she learned about the circumstances of the first marriage, and the fact that immigration was also involved in that marriage, she should have asked a million questions and collected as much information as possible about that marriage, the immigration benefits involved, and the circumstances surrounding the divorce. She should have also known that a second marriage to an immigrant would be scrutinized by USCIS, and she should have prepared both of you for the very real possibility of a Stokes interview.
You need a new attorney. This time, you need to grill the attorney about their experience and track record with similar cases before you write a check. Do a little basic research into the law, as it relates to your case, and you'll be better equipped to ask questions that will help you determine if your attorney knows what they are doing. A good attorney will be expensive, but it will mean the difference between success or deportation.
