  1. What does it mean when the consular give you back all your original documents back, and said they will contact you, and how long they might take to contact us back?

hi sonson_lady its mean consular officer satisfy your interview and your document and they have no doubt about your document that why they return your document and its mean you are in admin process what is meaning of admin process its mean you are in name check and your recorded voice matching check with other criminal minded person and when FBI or any other usa agency satisfy with your investigation that every things is ok in your case and then FBI OR any investigation agency give green signal to DOS department of state that every things is ok in benifecery and petationer case and then DOS issue and approved benifecery visa

  2. hi on 15 nov my interview was held in USE islamabad....in the end co says everything is fine we will issue visa in two weeks now you wait we will call you then u colleact ur passport on nearst amrican express ....and kept my passport..not give me any type of sheet green or blue.... so i wana know is everything is fine or take more time for via AP....

hi asif mehmood first please update your timeline and second please tell me about interview details because their is a lots of vjers whos is waiting for their interview including me return to your question please tell me consular officer return your original document or not if not after your interview this is not a good sign for you if consular officer return your original document after your interview and cannot give you any type of different colour slip its mean consular officer satisfy your interview and your document and soon they will issue you visa with passport inshallaha and please give me details about your interview

  3. My wife never received any of our original documents back from Manila Embassy or USA Gov't ... thats why I always get 5 to 10 copies each of everything whenever we go to NSO or to my City Hall in USA

hi james&julie if consular officer cannot return your wife document after your wife interview this is not a good sign for you and your wife because its mean your wife is in back ground check as i mention above post your wife is in field investigation in her home town or country its mean they will investigate your wife document its this real or fake and your wife whereabouts if we take benefecery interview with consular officer example here 100 out of 95 beneficery consular officer return their docuument after beneficery interview its mean consular officer cannot doubtful about beneficery document and they satisfy with their document that why consular officer return beneficery document after interview if consular officer cannot satisfy beneficery document or they doubtful about beneficery document they cannot return after interview and this type of AP is a different type of AP which have different type of peroid and time

  4. I am puzzled ... My parents did their interview on 11/1/2010 and was blue slipped so that my mom can take in her old passpost so that the u.s. visa could be cancelled. they are set to go back on tues. nov. 23 do that get/ask for the orginals at that time BEFORE going to the DHL counter to pay the shipping fee.. or will the passpost will be returned and all the documents inside and to finish final processing in the usa and then they will be returned at POE..?

hi RICARDO4EVA2 its mean if consular officer cannot return your parents original document after your parents interview your parents is in back ground check or in other words your parents is in field investigation in their home town and your parents is in AP

  5. Thank you for your input.....where are other VJ members...can we get more opinions here????

hi rashid first of all i must say dont panic about passport include last name as i mention in my above post this is not a big issue for NVC DOS or uscis because as Joannav said in her post your daughter is infant child and NVC have no problem with infant child if your wife make another birth certificate collect evidence and proof about include last name in passport which mean why you include last name of your daughter after filed i-130 so here is a question which kind of prove and evidence you have to collect here is the simple answer so rashid your father write a affit daffit which is something like that let suppose for example my name is xyz iam a father of mr rashid and my ID CARD NO IS THAT-----------------i give name my son new born baby iam registerd my son infant daughter who born last year who first and middel name is dash dash dash date of birth is dash dash in birth registerer dept when i obtain birth certificate of my son infant new born baby daughter in the certificate mention only first and middel name and after that my son filed i-130 petation for his wife and childern including infant new born baby who birth certificate is mention only first and middel name but sometime later i decide to give my son new born baby daughter last name and then i decide to go again birth registerer department to include her last name in her birth certificate and obtain new birth certificate my son new born baby so that why my son new born baby passport have include last name and remember when you obtain affit daffit of your father write whole detail in goverment of pakistan stamp paper and then notrazied and stamp grade 1 officer these type of stamp paper easily available in any lawer office and out side the civil court and this affit daffit is the rock solid proof or evidence during your wife interview with consular officer when consular officer ask to your wife about your new born baby last name and your wife easily give the proof to consular officer about name change

  6. I just found out a problem over the weekend. My wife was scheduled for an interview in Islamabad on the 19th,then they re-scheduled for 16th of Nov. and now Dec. 10......Look at the discipline.

My wife and I alongwith my two older kids (5 & 3) share the same last name (Sulehri). When my youngest daughter was born last year, my father registered her first and middle name but did not give her last name. I filed I-130 for everyone alongwith my youngest (eventhough) she did not have a last name. I just followed the birth certificate thinking that I will correct the name when my family comes to the US and apply for US passports. Meanwhile, my wife got a passport for my youngest in Pakistan and added last name for my youngest.I never knew about the last name's addition. Now the NVC does not have a last name on the petitions/forms/DS-230 but the passport has a last name.

So Embassay is expecting to interview Maria Khurshid but her passport is going to show Maria Khurshid Sulehri.....Sulehri being our last name. This is the problem. I asked my wife to get a new Birth Certificate with the same name as on passport which she did. What do you think I should do in this case besides e mailing the embassy.

hi oki26rashid this is not a big issue please do not change any thing because your wife document process has been complete and you got your interview schedule if you change any thing this things delay your wife visa process because your children name and date of birth already in NVC &DOS AND USCIS usa immigration data base and during your wife interview with consular officer . consular officer doubtful about this kind of change so in that case you have another option left when your wife give interview to consular officer and consular officer ask about name change your wife give explaination to consular officer about her son or daughter about name change what ever your story is if consular officer ask about prove and evidence about name change just provide at the time of your wife interview

  8. Hi everyone, I have a few questions (okay, several, actually) about the I-864. I am still two months or so away from my I-130 approval, but I want to make sure that I am prepared when the time comes so that we can get through the rest of the process as quickly as possible. I really appreciate any and all input you can give me!

First of all, I'll be filing my Affidavit of Support in early 2011, but obviously I will not have done my taxes for 2010 by that point. I already have tax transcripts for 2009, 2008, and 2007 – are those still the three most recent tax years, if I'm filing around January/February 2011?

As for my current annual income, I work part time at a job that I didn't begin until April 2010, and my pay has varied widely from one pay period to the next (at least in the beginning). However, in the past few months, I have become much more involved with the company and make a more steady amount now (although it still varies depending on the actual work I do). I was going to estimate my yearly salary by taking the average of what I now usually make in a two-week period and multiplying that by 24 (two paychecks per month). To get that average amount, should I use my gross pay or net pay from my pay stubs? Is it necessary explain somewhere how I arrived at that number (i.e. my current annual income)? I am going to submit a few pay stubs from the past couple of months, but on them you can see that my year to date earnings are nowhere near the income requirements. This is because I didn't start the job until April, and I was working very little at first. However, my manager is happy to write a letter explaining that I pretty much work full time now to provide evidence that I am gainfully employed. Do you think this is acceptable?

In case they decide that all this is not good enough, my mother has also agreed to be a joint sponsor. She used to be a business owner but sold the business over 10 years ago. She does not work anymore but has income from rental properties and investments (stocks, etc.). Does this mean she is self-employed? Her tax transcripts do show her Schedule D (capital gains) and Schedule E (rent/royalty/partnership/estate) forms. Should she also write a letter explaining her income, and do we need to include statements, say for example from her property manager showing incoming rent payments?

To summarize, here is everything that I am thinking of including in my Affidavit of Support package. Please let me know your thoughts (if you think something is necessary/unnecessary):

    • I-864 from petitioner/primary sponsor (myself)
    • Letter from employer stating current annual income (estimated using average pay in a two-week period) and describing my role(s) within the company
    • A collection of pay stubs from the past few months (is it OK if they are not consecutive? There will be pay periods, for example during the holidays, for which I wouldn't have earned much, if anything, and I obviously don't want to include those)
    • Tax transcripts from 2009, 2008, and 2007

    • I-864 from joint sponsor (my mother)
    • A copy of my mother's US passport and naturalization certificate (to prove her citizenship)
    • Letter of self-employment (not sure exactly what needs to go in here)
    • Evidence of income (e.g. statements from property manager showing rental payments, statements from her stockbroker maybe?)
    • Tax transcripts from 2009, 2008, and 2007

Sorry for the super long post, and thank you so much in advance to anyone who can help. This community has been so incredible in helping to make sense of this whole horrible process. I've been apart from my husband for nearly a year now (except for the two weeks we had together in June, when we got married), and we still have several months to go. It really helps to know that other people are going through the same thing.

hi jennie ann you ask to many question i will try my level best and give you answer iam sorry if iam forget something or i cannot understand your question For tax issue, I’ll answer 2010 most recent year with zero income and attach separated sheet that saying WAS NOT employed or i work as a part time what ever your story is in 2010 therefore, income is zero. I will not even mention if you files the tax return or not till USCIS asks. I think it is better to avoid some points which are not necessary to speak out till they ask. let suppose for example Your should explain in a letter that- (1) i didn't work for those years,or i work part time so obviously i had no income in those years in order to file the tax returns, and (2) that i was not required to file income tax returns with IRS for those years because of not having income. you should print out the relevant information on 'which is required to file income tax returns' for those years by going into the IRS website and attach that with your explanation letter to make your case strong...so that nobody even dare to ask why you failed to file tax returns for those years.

you petationer has to fill I-864, even if you doesn't make enough money, and also,if your mother is going to be a joint sponsor, dosent matter if your mother is self employed she has to fill I-864. Now, if she is living with you she can fill I-864A as a household member, if only if she is living with you, otherwise she must fill I-864. I recommend you to read the i-864 instruction as many times as you can. I did that and every time I undertood that form better (In my case, this form was the most difficult to understand). Now, it doesn't matter if she is working or not. She only has to meet the 125% of the current Federal poverty guideline. How can you know if she meets the requierments, you just have to ask her for her tax 1040 forms of the last three years (2010, 09 and 08). There is a line which says Total income or gross income. That number has to be over the 125%. Now, if she doesn't have the tax returns (1040), she has to fill a form 4506-t to ask for the tax info of last three years. it takes 30 days to get that info and is for free. Now, if you are in a hurry, you can request via http://www.credit************.com/Ta...ation_4506.aspyour tax info, they will give you the info en less than 72 hours but it cost money.

Also, remember you have to send copies not only of the tax returns (1040), you also have to have forms w-2, and 1099. It is only necessary to send 1040, 1099 and w2 from the last years, but you must fill the information of the last three years,

  9. Assalamwalaikum Mustufa...

can u plz tell help me..i've sum questions

1-is it safe to submit original documents?

2-i've already got my police certificate just for safe side as u know dere is no consistency in our system, its xpiry date is feb-2011...n my NOA1 notice date is 17-july-2010.

3- my case is transfered to texas service center...does it effect total time of USCIS or wat?

4- at wat time I n my husband shud ready our documents for NVC....

i-130 for spouse...(my husband submit it for me)

    receieved by USCIS 8-july-2010

1st week of november 2010 received transfer letter to TSC

hi momi i dont know you got your noa2 or not if you got your noa2 and uscis approved your i-130 PETATION then you must send your original document with complete DS-230 to NVC because this is the reqiirement of NVC first you send your all original document to your husband usa home address and you use courier service in pakistan which is so save and reliable DHL AND FEDEX you can easily trust this servise and your question about police certificate if in case your i-130 petation is not approved and if uscis cannot approved your NOA2 before end of nov 2010 i think at this stage your police certificate is usless for you and you request another police certificate but there is a lot of confusition about police certificate issue because if you submit expired police certificate in NVC some time NVC except expired certificate and they cannot request another and some time NVC request new certificate but in my opnion i think NVC only request male person and NVC cannot request female and your question about when your husband send document to NVC and answer is when your i-130 finally approved and you got your NOA2 and please update your time line

hi wasmah congratulation to you for your wife visa please tell me which type of question consular officer ask to your wife please give me complete detail about your wife interview your details helpful for me and others members who wating for their interview

  14. Thanks Mustafa for sharing your knowledge, Really appreciate, this means Urdu (orginal) english (Certified Copy) Nikah Nama both papers are stamped and signed by Nikah registrar,,

hi ali baig yea send original marriage certificate which is already in urdu language and english translate attested or certified marriage certificate copy you dont need to go marriage registar office because you already have original marriage certificate you only need to attested english marriage certificate copy there is a lots of translate shop in karachi pakistan who already have a grade 1 notary officer they will easily attest your marriage english translate copy

  15. You mean i should send original Nikah Nama and birth certificate?

hi ali baig yes you send original (nigha nama ) which mean original marriage certificate and original birth certificate NVC save your original document in their immigration data base and dont send photo copy to NVC because NVC dont need photo copy because photo copy is useless for NVC because NVC have a million of million petationer every month and year NVC dont waste extra space or room to save petationer document photo copy file in their store room because NVC dont waste million of billion dollars immigration property or office to only save petationer document photo copy in their store room let suppose for example if NVC save petationer document photo copy file in nvc store room last 50 or 60 year so its mean nvc require 50 or 70 multi stroee building to only save petationer document photo copy record because NVC is the world biggest and largest immigration department in the world they use world latest technology they dont need photo copy

  16. Thank you Loto, You are always so helpful, but just one more question, One of my friend sent attested copies from notary Public both (Marriage certificate and Birth certificate) and they were accepted and he took the originals at the time of interview,

hi ali baig every person have a different case and different issue and matter with his or her case and some time people give wrong imformation because of enviousness and envy dont follow other person case please follow what nvc said to you iam strongly advice you please send original document to nvc if you dont follow the rules there is a 99 percent of chances that you get (RFE) from NVC and this thing delay NVC process so please avoid RFE and send original document to NVC

  17. Aha , i got what you meant but my lawyer wouldn't do that because i told him that i wouldn't pay him the rest of the money before i get the approval since he made 3 mistakes. so why would i pay him?..and all of my lawyer want is money so he would want the approval as same as me...he needs money and i want the approval ...so he can't do that.

But its really a good idea , Thanks a lot Mustafa :)

    El salam alikom

hi samonline i know you thinking positively about lawer but remember one thing lawers cannot thinking only positive side of the case or matter lawers always thinking negitative and positive both side of the case or matter because lawer have a sharp mind if lawer only thinking positive side of the case or matter he never never make a sucessful lawer so in that scnerio of your case when you cannot cooperate with your lawer and you directly contacted congressman senator without inform and without taking any advice to your lawer that time lawer know about your cause very well that you are not intrested to fulfill your promise with lawer and you trying to double cross his and which you make promise with your lawer that you pay lawer fees or charges after noa2 approval because you take every step of your case without talking and discuss to your lawer and cannot tell any of your future step to your lawer that why lawer cannot believe you any more because if you saw and read and study other forum member cases cr1 and ir1 60,000 out of 1or 3 cases is declined because uscis never never declined i-30 petation untill petationer cannot done mistake him self the i-30 declined reason is only some where and any where is only only petationer mistake that why petationer is responsible for is i-130 declined

  18. Thank you a lot for the response Mustafa :).and i admit that i made a mistake.

I do so feel better el hamdullah . don't worry bro ,I'm calm and thinking positively .

Thanks for your thoughts and feelings.

He is frustrated for me ..I really appreciate it...it's not his mother language..Am srry for him.

Yea , he is a nice guy.

hi samonline thanks for your explaination and iam sorry for all vjers to usings caps first of all this is not the issue of religion and husband order than wife and wife older than husband if you dont have mosque paper no problem uscis officer cannot consider these type of small issue if we consider and analaysis your whole case the main and important factor of your i-30 petation case is your lawer the main focus is your lawer who is the owner of your i-130 declined and approval case because on those day when you cannot cooperate with your lawer and you contacted congressman senator directly without involvement of your lawer those time and days uscis officer send official letter to your lawer stated as our record you are the petationer legal lawer please explain to uscis why your petationer cannot cooperate to you as our record show and indicates petationer directly contact congressman senator without you (lawer) involvement if your petationer cancel agreement with you please send cancel agreement copy to uscic or if petationer still hire you as a lawer please explain us why petationer cannot cooperate you. so here is the main reason of your i-130 declined because if your lawer is not a good guys or he is a very very bad lawer he (lawer) easily written a letter to uscis for example i think my petationer relationship is not real or true and my petationer not have a lot of evidence and proof because this evidence and proof is not real and gunine and when i talk to my petationer about that matter and i said to my petationer please give me more proof and evidence because this evidence cannot verify your HUSBAND OR WIFE RELATIONSHIP but petationer cannot respond to me or cannot cooperate me . so samonline i think this is the main reason of your i-130 petation declined

Hi VJ members.thank you all for your info.i met my wife through a friend online.she later visited me in Ghana and we started making arrangement for our wedding in the states.her family invited me to see them before our wedding but i was refused a visa.we later planed to get married and live in Ghana.we got married in oct.2009.she got pregnant a month after our wedding and she has to go back to the states because of her health implications. Her doctor asked her not to travel alone so i have to travel with her to the states and i was denied a visa again.so we made arrangements for her to go back to the states.

She filed for me and luckly the NVC approved it in May before she gave birth to a handsome baby boy in June.I have still not had an appointment and we hope and pray i get an appointment soon.

I want all VJ member who have been there and had some experience to tell me how long should i expect an appointment.what i should do for the medical test how the process goes and the right place to get the medical exams done.what should i expect should i expect on the day of the interview.? i want to know what to do and what not to do.I hope some one will be very kind and give me all the info.thank you all and God bless you all.[/size]

  21. hi every one

i filed i130 for my husband and i am waiting for the pettionals interview to be scheduled can i refile without withdrawing the first application.pls i need help

i think you are talking about petationer interview with uscis no you dont need to refile application again because if you recieved letter from uscis about petationer interview WITH USCIS so its mean your i-130 which mean (notice of action1) is in final stages if uscis satisfy wiith petationer interview which mean who is (LPR) legal permenent residense or usc united state citizen with EVIDENCE AND PROOF then uscis approved your i-130 and issue you noa2 which mean (notice of action2 ) and then transfer your case to national visa center (nvc) for further process in usa so in that case you have no need for panic just relax and stay cool and wait for your interview with uscis if you have any other question you can feel free to ask me

  22. Hi,

Need some guidance for form G325A (along with I-130).

I am the petitioner and I am filling it out for my wife.

Her mom had died, when she was quite young and she does not remember her birth-date.

Would that be ok to leave it blank in the G325A when they ask for mom's birth-date? Should we specify the reason for keeping it empty in the cover letter?

    Any suggestions?

    Thanks.

mother or father date of birth is not a big issue of uscis if your wife dont sure about her mother date of birth no problem write a letter to uscis explaining him about her mother that your wife dont have any document to prove about her mother birth date with cover letter remember when you write a letter to uscis write question number and page number to

  23. Thanks, Mustafa!

But I am a little bit confused as the DS-230 is a document that Aiko(beneficiary) had to fill out to send to the US Embassy in Tokyo...and I am the petitioner living in the United States. I was gathering that she would hear directly from the embassy first...as it is she that has the appointment...and that the NVC didn't have anything to do with anything after we received our NOA2 and they forwarded the case to Tokyo. We are hoping to set our appointment date soon (ideally for late December, as I do wish to accompany Aiko to the interview)...so I need to get a plane ticket soon...

Does anyone else have thoughts regarding any of this?

    Thanks so much!

hi toddaiko benefecery cannot send ds230 package to usa japan embassy this document is not for japan usa embassy . ds230 package is only for NVC this doc is only to send NVC IN USA ONLY I THINK YOU CAN READ THIS

Two paths in the NVC process.

    Path 1.

The fee that is generated after they receive the Choice of Agent is the IV Bill. Once that is received they will generate the DS-230 which is the Application for an Immigrant Visa. Who is the Choice of Agent? Whoever is the Choice of Agent will receive the DS-230 package. If it is not the visa applicant, the visa applicant should forward at least a signed DS-230 part 1 to whom ever is the agent. They should also forward any documentation that is required to be submitted with the DS-230. This varies depending on the country.

    ____________

    Path 2.

Once the AOS Fee Bill has been received, NVC will generate the Affidavit of Support Package and forward it to the Petitioner (who is also often the choice of agent for the DS-230)

    ____________

The NVC will then review the Affidavit of Support and the DS-230. Once this and any background checks are cleared, they will get 'Case Complete'.

If only the DS-230 part 1 and a copy of the visa applicants biographic page/s of passport were required to be submitted, then the case will be forwarded to the Consulate on 'Case Complete' where the consulate will schedule the interview.

If DS-230 part 1 & 11 and ALL documentation including police certificate, where required to be submitted, then NVC will schedule the interview.

An interview packet is sent to the visa applicant which contains a letter and interview appointment, with the day, date and time of interview, and information about what should be brought to the interview as well as info on the medical, etc.

Note: DS-230 part 11 is completed but not signed whether it is sent to the NVC, or is taken to the interview. This is signed at the interview in front of the Consular Officer.
