  1. hi

canadian wife in my opnion there is a lot of meaning about visa denied let supose if a unmarried boy or unmarried girl go and visit for non imigrant visa to america and then he or she married to a usa citizen he or she face a lots of problem because if you stay in us for non imigrant visa and your husband file petation for adjustment of status one day in night your husband not at home and suddenely imigration officer raid your home and imigration officer ask you a lot of question where is your husband you spending night togheter or not every time you togheter with your husband or not is your relationship is ok why you stay here in us why you dont go to your home country and why then your husband file petation for you what purpose did you marry to a us citizen if you confuse and your answer is improper and 50 50 imigration officer doutful about husband and wife relationship for example your answer is that my husband working or job at night let supose imigration officer satifay with your answer 100 percent then imigration officer check your every movement of your life where you go what you do you spend night with your husband togheter or not and these type of situtation will increase your tention day by day because you dont know when and where imigration officer always check your every moment of your life and you dont know what is going happen next until your imigration process is not over and you dont have to permission to do any kind of work or job and you always feel you are in hell because you dont have any gurantee your application denied or approve

rembember these kind of situtation is only for those person who visit usa for non imigrant visa and then marry to a usa citizen and stay there and then aplay for adjustment of status

if you have any question feel free to ask me

  2. hi ladyeralam

first of all i must say avoid all these kind of nonimigrant visa which is harmful for your CR1 PROCESS why you dont figured it out you are married to a us citizen you are now in imigration status THESE KIND OF VISA aplay for any purpose WILL BLOW UP YOUR REPUTATION IN CASE OF DENIED OR REJECTED AND REJECTION STAMP ON YOUR passport it will affect your CR1 process and it will slow up your imigration process this kind of visa activity is harmful for your future just relax and be patience and dont hurry up every thing done its own right time these type of try will affect your whole future

iam specially request all of the VJ and senior member of the forum please dont advise CR1 status couple to aplay for non imigrant visa like visit visa student visa ext ext i know not every time but most of the time visa approved and most of the time not approved or reject this rejection will affect new married couple whole future hope you understand

  3. Hi nbwords

sorry for the late answer if you go with kathryn41 advise you face lots of problems in usa if you stay in usa and your husband file your petation in uscis for example one day your husband in night not at home and imigration officer suddenly raid your home that night and imigration officer ask you a lot of questiom for example imigration officer ask you where is your husband why he is not with you you and your husband spending night togheter or not is your relationship ok or not if your answer is improper imigration officer doutful about your relationship let supose you satisfay imigration officer but there is no gurantee when and where imigration officer always check your every movement of your life and you are always in very tenseful situation and these type of situation will increase your tention day by day you dont know your application approve or denial and until your application is in process you dont have any permission to do job or any kind of work that why i am giving you the advise come to your home country and then file i-130 petation hope you understand the choice is in your hand

and please give me your reply what is your decision or program are you going to stay in usa or return back to your home country iam wating for your reply

  4. He didnt make lots of mistakes,, he made 2 mistakes. One in getting June and January confused in translation in his head to his mouth and the other in answering where my ex husband came from , not where he lives..... anyway she was very nice and told him at the very end that she needs 2 things to complete the case. his CV and the marriage paper of my previous marriage... she meant the marriage certificate as confirmed by the embassy.

The paper he was given is a new system in place by egypt's embassy. Its white and has our case number written on it as well as other small information, stating that the visa is not approved yet and is in administrative review and is very rare that it is not approved after this.

It gives a website to start checking for the status of the case starting from 2 weeks after the interview appointment and they did not take the passport, it states on the paper that when the site shows that the visa has been approved to send the passport to them DHL

so consular officer give your husband white slip - white paper mean conditionally approved but some adminstrative processing it will temperarly refused due to further investegation the adminstrative processing time minimum 45 to 60 days in some caseses it will take 6 to 8 month in imiragation law there is no time limit

and back to your question this is not the question about mistake 1 mistake 2 or 4 mistake this is the matter of nerveness person body language consular officer must check confidence level husband or wife husband or wife must sure 100 percent or his answer is 50 50 and which is very important and which is the key of these type of conversation is check commication gap between husband or wife relationship and this conversation decide your whole future

i hope the wait is toward the shoter end in your case unfortunately there is no clear cut time line sorry i certainly hope that in your case it is a very short time inshallaha soon

iam specially request all the forum member who is under this type of situtation beprepared yourself these kind of circumstances

and those newely married couple also be ready and educate yourself to face these kind of tricky question

  5. Husband went to interview. Did well with the questions except one, he always gets january and june mixed up in english and when she asked our marriage date he said january, its june..... but at the end she told him she needs 2 things to finish the case, his CV and my marriage paper to my last ex husband????? He gave her his CV right then and she said ok, can you fix this paper for me... he asked what paper and she said the ex marriage paper and he asked her who and she said the last name of my last husband..... what is she asking for exactly? The marriage certificate, the divorce papers?? No idea, i emailed them asking exactly what they are wanting. They had the divorce papers already, i mailed all of that before... I dont understand.

He did say she was very nice through it all. When he asked what he can tell his wife of the interview result she said whatever he wants to tell me lol. She didnt say approved or denied.

    questions asked are:

    how much support for kids

did she file immigration papers for this person

where is this ex husband from

    where do her parents live

what does she do for work

    where does she work

how do you keep in touch

    how did you meet

where did you meet in person first time

what is the name of the website you met on

what kind of web site, what is its purpose

    when you meet you wife

    when you married

    when here last visit

    where she live in usa

how you keep in touch with her

    did she marred before

she have kids what is kids names and ages

    what you is your work

did you have a big party it was family partys and frinds and neberhods

    who was there

what your family said about age

what kind of wrk you can do in usa

she live with her own or with family

    Processing

Estimates/Stats : Your I-130 was approved in 43 days from your NOA1 date.

Your interview took 175 days from your I-130 NOA1 date.

ok iam reading your husband interviw your husband done lots of mistake in his interview he confuse about marriage date and i think consular officer want only your ex husband certified copy of marriage paper for futher investation

and please tell me consular officer give any slip or paper as i told you in my last post blue green purple or pink ext ext

and consular officer take your husband passport or not

  6. after my response of that i didnt request status, that i requested to know what documents they needed they finally answered the proper answer. The CV or resume and the original marriage certificate from my previous marriage.

I sent them another email thanking them and told them the CV was given at the time of the request and that the marriage certificate arrived to embassy via dhl on thursday.. Please confirm that they now have all needed documents to finish this case hahahaha. Should hear sunday or monday.. if not i will email again... in any case i am leaving first of march to go live with my husband for 2 months.

dont worry every think goes fine you dont tell me the interview detail of your husband what type of a question consular officer ask to your husband

did consular officer take your husband passport or not

consular officer give any type of slip to your husband slip like green - blue -purpule or pink ext

and what is the last wording of consular officer

interview is just like a college exam if you prepared for all hard question you passed the exam if you not prepared you fail and loose the exam

this interview depend decide our whole future. and then i will will be able to analayasis a proper and right answer give to you inshallaha

and inshallaha you hear good news soon

  7. hi yohino yes you right iam sorry for wrong post that time iam reply 3 members at a time this done by mistake The forms are the same. The difference is, if one has been married for less than 2 years at the time of getting immigrant visa (CR-1) and entering the US with immigrant visa, a conditional green card will be issued. That person would have to remove conditions after 2 years of GC issuance. Person married for Difference between IR-1 and CR-1 is following.

    - IR-1 will receive 10 year validity versus CR-1 will receive 2 year validity.

    - IR-1 may need to renew their Permanent Resident Card (also known as Green Card) when 10 year validity (expiry) day comes, but even if you don't renew it, or you miss it, you don't loose Legal Permanent Resident Status. You just have a couple of restrictions such as Country In/Out (Foreign country travel), Naturalization... You can renew it whenever it is convenient for you even AFTER expiry date.

    - CR-1 needs to file I-751 to remove the condition for your Green Card for 2 year validity, and need to PROVE your marriage is indeed maintained with same person for those 2 years. There are some exceptions, but you have to file I-751 to remove the condition. You can file I-751 from 90 days prior to expiry date to expiry date, and if you miss it, you will loose your legal permanent resident status.

more 2 years, is awarded IR-1 immigrant visa.

  8. Hello VJ'rs,

My husband and I married in the US on January 1, 2010. I am a US citizen, and he is a German citizen currently living and working in Japan. He is back in Japan until we can sort out the Visa process. I noted that the CR1 Visa may have restrictions on entry into the US once we have applied. He is a director of international business for a japanese company, and as such, will need to travel freely between the US and Japan on business over the course of the next year. Should we be concerned that he will be denied entry when visiting the US on behalf of his current employer while our application is pending?

I really appreciate any help you all could give us! I've searched the forums and can't seem to find an answer to this question. We would prefer to go the CR1 route vs. the K3 if at all possible.

    Thanks!

your category is not CR1 your category status is IR1 first of all you applay for your husband i-130 foam you can go to usa japan consulate and applay for imigration visa for your husband and he can easily travel to usa without any problem and rembember you must need your usa domicile which is needed in your interview time and collect proof like phone record bills credit card statement bills your joint bank account your marriage photo your email chatting your voice chatting copy your property and lease document and after marriage you and your husband travel record and also which is very important you or your husband 2 releative affitdafit which mention in affitdafit your relative physically present and eye witness of your marriage ceremony and tell your husband go back to germany and collect your all document like birth certificate marriage certificate which is attesteded in your husband home country only ministery of foreign affair can only authorised to attest these kind of document if you have any other question you can feel free to ask me and please update to me time to time

  9. It is probably inadvisable for the OP to return to Canada. They would be better off petitioning and adjusting status from within the US. If returning to Canada, OP would have to follow procedure and be faced with enforced separation for the length of the visa approval process.

hi birdnerd in my past knowledge there is no law to seperate husband or wife without evidance or any proof. as your quuestion about procedure every person have equal method procedure i imigration law only there is littel bit difference not a huge difference and your question about my advise to return to canada is only for that time when i-130 petation is under process and when i-130 is finally approve she dont have any problem to visit usa but iam advise visit for a small time of a peroid and she also extend usa visit visa for future travel if at that time she dont want to visit usa she have a better choice to extend usa visit visa in case of length of the usa visa approval process

  10. you should come back to your home country and only your husband file i-130 petation for you at this time you marry to a us citizen you are enter in a imigration status your visa category is IR1 at this time you need your birth certificate your marriage certificate you both fill husband and wife G325A form and affitdafit of your relative eye witness who is present at the time of your marriage ceremony 2 relative requried remember birth certificate and marriage certificate attested by the ministery of foreign affair and bank pay order or money order 355$ pay order made by home land security and remember when you sumit your case uscis and your case is in process dont visit usa untill your case is not complete and please update for me time to time

  11. Thank you,

He knew the answers to many detailed things and had the photos of his family and his father was one of the witnesses signed on our marriage certificate, there was a stack of phone records about 10 inches tall for the year ,, she knew we talked well .. She isnt doubting him, the doubt is in my intentions and i have a feeling the marriage certificate i sent to them will clear this up as well as the letter showing when i was actually seperated to show the relation ending times.

so in your case subject line is that which i understand embassy dont need any further document with you they only trick you some time husband and wife has a lot of proof in interview time they even demand and ask any proof like marriage certificate photo email chatting voice chatting phone bill record credit card statement ect ect and without asking any proof they issue a visa the question is not a lot of or a bundel of proof in interview time some time consular officer use common sence to check the relationship between husband or wife is that real or fake if you give me detail of your husband interview then i will give you a proper answer and pls keep update for me

  12. in my opinion in this situtation you are married to a us citizen and you are enter in a imigration status there are so many way to applay for usa visa but all of these visa is non imigrant in my advise dont try to get non imigrant visa because these type of visa slow up your imigration process i suggest you to bepatient and relax and file for i-130 only not k3 your visa categary is ir1 and wait until your whole process is not complete you asking about passport you dont need any passport at this time you only need your passport at interview time in your home embassy in that time you only need your marriage certificate your birth certificate your reletative affitdafit which mention your reletative present in your marriage ceremony 2 reletative affiitdafit you fill up g325a and your wife and also g325a foam 355$ pay order and rembember convert your marriage and birth certificate in to english and send into uscis so please keep update for me

  13. you dont explaning us you got noa1 or not let supose if you got noa1 which is first stage and then second stage you got noa2 noa2 mean that uscis finally approved your i-130 petetation when your case is approved the uscis transfer your case to nvc

please explain me in detail about you case then i will give you proper answer

  14. i filed/paid the i-130 for my husband (in phils.)

    [/quote[/

please dont panic this is normal process some time noa1 recieved 3 days some time week or month i suggest you please wait atleast 1 month if that time you cannot hear anything from uscis you can call them 1-800-3755283 the subject line is you tell operator date of birth husband and wife your home address your telephone number mobile no and which courier service you send your i-130 and which bank you send your pay order or money orderand which usa state you send your i-130 and please tell me which document you send to uscis tell me in detail then i will give you proper answer

  15. the simple way is you can call dos dept of state 2026631225 press 1 and then 0 and then 0 the subject line is tell him your case number dos have a record of all over the world embassy and ask his what they really needed hope this will help you out

if its not work you have only choice to email him twice aday what exactly they needed in my opinion sometime consolar officer ask tricky question to check husband or wife confidend or not for example consolar officer ask your husband your wife not send us marriage certificate if your husband not confidend about document and said ok i send you the consular officer doutful about your relationship and he think there is a comminication gap about husband and wife or if your husband told consolar officer confidentaly no iam sure my wife send all necessary document to you this is only opinion

  16. please dont panic this is normal process it will take two to three week or more and then embassy call to your husband to collect your passport with visa inshallaha in other way your husband in AP process i think your husband case retun to dept of state for further inquiry and name check and then return to your husband home country and then embassy call to your husband
