  2. We asked few people who are tax experts but all of them have different explanation to tell. Some of them says SSD and third party long term disablity payed by his employer 100% is taxable. Some says not...

    But ....

    1. Why his third party insurance don't even send a tax form and W2 since 2004?

    2. If his SSD become taxable bcoz of that little amount of $129 that he is getting from his third party disablity insurance, how is he going to start to file all these? We need 3 recent years to show them right, so, 2007,2008,2009. On the current income , we can put the amount of his SSD plus fromhis third party and show the SSA-1099 2009 and for next eyar 2010.

    3. Will it matter to the USE Manila if he file or not a tax even we have a co sponsor that can meet the poverty guidelines?

If we will write an expalantion letter saying his SSD and third party disablity insurance are non taxable , they might check it and found out we lied . But homestly ,My USC husband knew from the start that it is not taxable thats why he never filed tax for it.But as i read on the internet about this matter to make sure, it is taxable. Others says it is not because third party disablity is very lettel only $129 each month. But will it really matter to them even we have a co sponsor? Pls help. We will appreciate any suggestions and ideas.

  3. Hi to everyone. I got this answer also from one of the tax law expert. And this is what she said about the SSD and third party disablity. Any comments and suggestions are open...

This is what was explained :

Social Security Disability income can be taxable BUT if that is his ONLY income it will not be taxable.

From a third party - receiving $129 a month- That would be other income but the amount would not cause any of his social security benefits to be taxable. In fact he would not pay any tax on that amount of income.

  4. Just print from his PC.

Ok thanks for the respond. Do you have any idea how do they background check the USC petitioner on DCF procedure because they say NVC is not inolved on this procedure. One last thing, he has a 3rd party disablity insurance that he is receiving every month but it is only more or less $129 a month aside from his SSD. Is that considered other income to make the SSD taxable? Says on the form that IF no other income the SSD is not taxable.....

  5. SORRY What i meant is 14k a YEAR. Each month is a gross of like $1,068 net pay and $129 from a third party disbality.

Sounds like he will need a co sponsor.

Since he's doing a DCF he will need to explain why he didn't file the most recent years taxes.

More important is he has to have evidence of domicile in the US.

Yes ,the co sponsor will be my brother who lives in CA and can meet the rqmts for the required income in poverty guidelines. My husband is on SSD and no other income. Do you think that the USE Manila will focused so much on my husbands earnings and SSA-1099 in his disability eventhough we already have a co sponsor? Yes, he has a US domicile and can prove it,he has his mom's US address, he still have the US bank account, he is paying his bills each month online transaction, he still have his driver's license. By the way how do you show or prove that you still have a US bank account, do you have to request a certificate from your US bank to show the USE ot can simply print the transaction that you are making online and show them?

  6. it is over a certain amount.

Question Do I have to pay income tax on my Social Security benefits?

Are Social Security disability benefits taxable?

Some people who get Social Security will have to pay taxes on their benefits. Less than one-third of our current beneficiaries pay taxes on their benefits.

You will have to pay federal taxes on your benefits if you file a federal tax return as an "individual" and your total income is more than $25,000. If you file a joint return, you will have to pay taxes if you and your spouse have a total income that is more than $32,000.

    ssdi and taxes

    I hope you meant 14 a year and not 14k a month.

Yes i mean 14k a YEAR. Each month is a gross of like $1,068 net pay. So its non taxable right? He has a third party but he is only receiving a $129 each month.

  7. Hi to all. Im a newbie here. Need help how to know if SSD is taxable or non-taxable. My Husband is receiving a gross income from his SSD of $14,000 each month and no other income. He got divorced year 2008 but eversince he was paying tax seperately before he got disabled. He started to have his SSD year of 2003. On 1-864, how we gonna do it or fill it up. What are the docs we need to show. Filing DCF in USE Manila Philippines. Is USE very particular on the filing tax thing if we already have a co sponsor? Can show 2008 income tax return that he filed. He is planning to make a letter of explanation for those 2006 & 2007 no other income and SSD non taxable..Any advise will be appreciated pls....
