    Married for at least 3 years, permanent resident for at least 3 years less 90 days. That's the first day you can apply. If the 90-day window opens before you have reached your third wedding anniversary, your application will not be accepted.

    I don't want to sound insensitive or cynical, but I'm not sure that your concern toward his lack of pain for being apart has anything to do with the scope of this forum. One week has almost passed since he left, 2 more to go and then he'll be back. The large majority of us has been apart from their significant one for several months, not just 3 weeks. We went through highs and lows, but we all survived. Hang in there, count down the days, stay put and wait for him to return to file AOS. That's all you can do right now. Good luck.

    OK, it may well be that you are not accruing overstay. Regardless, visitor visas are for visitors. if you enter as a tourist with intent to adjust status, that is called visa fraud. No good. Also, when (not if, when) the immigration officer at the airport will ask you about the reason of your travel, and you tell him that you want to come back and be with your husband (remember, NEVER lie), you will find yourself on the first plane home. If you say that you are just visiting but then in fact you file AOS, not only you will have had intent, but you will have also materially misrepresented your situation to obtain an immigration benefit. Intent alone is not sufficient to deny AOS, but material misrepresentation is, and with very harsh consequences.

    I'm sorry that my posts offended you, let me just say that from what you wrote it was totally unclear to me whether he did drugs once, repeatedly, whether such repeated use was disclosed or not. Please take the time to read your original post again and you will see what I am talking about. As to trolling or gaining pleasure from other people's pain, it's certainly not in my nature. I was just pointing out potential pitfalls that you may not have considered. Anyway, I'll take your advice and will stop worrying my pretty little head. Good luck.

    No, you didn't say it, but it was pretty easy to guess. I didn't fall off a turnip truck either, nor did the civil surgeon at the US consulate. Did they tell him anything about lying? If he admitted that he smoked once as a teen and then they found him positive now, they know for sure that he made use of controlled substances at least another time and he didn't disclose it. This could be a real problem, not having to undergo urine tests for another year.
