  1. I filed in May for my fiance. I believe those in my situation will go at least 15 months. So I go back to the Philippines and visit my soon to be family, (she has a daughter I will adopt). I'm leaving on November 30 and will stay for 45 days. I would rather visit there, then wait for 15 months or longer to hopefully see them. The money i spend is worth every dime.

It's one of those open secrets: everyone close to the family knows who the real bio-mom is, but to "save face" with society at large, they don't register the child's bio-mom on the BC.

Looking at OP's timeline, the K1 interview is scheduled on July 7. So the I-129F petition was approved but does not have any info about the child on it. I really don't know how the beneficiary is going to handle the visa interview if asked "Do you have any children?"

You can petition for a child later, stating that the BC was messed up and couldn't be filed at that time. Going though this with my fancy right now.

I am looking for guidance for a child of a K1 holder that was not on the original I-129F.    The son was birth-registered as a sibling due to restrictions where mother have no marriage certificate at the time of birth.   The birth certificate showed the parents were the grandparents.  Can the son be eligible for K2?   What is the process to include him as a K2?   Appreciate the response.

Going through this right now. Get an attorney and get the BC changed immediately. This will take like 6 months. And it will cost about 50,000 PHP. And probably a DNA test will be included in those costs. After that you can refile for a change.

As long as you have your final divorce decree from Idaho, you do not need the divorce to be legally recognized in the Philippines to be able to start the CR1 process.  You may get married anywhere outside the Philippines, or through Utah zoom wedding while in the Philippines.

We plan on getting married when she gets here, but i have already filed the K-1 visa. I would lose money to start over. And where would I be able to get married outside of the RP?

It will take closer to two years for her to even get the visa.   I120-F alone is taking 13 months for approval.

If she flies back before the AP is approved, she will have abandoned her AOS, and you will then need to petition her for a CR-1 visa if she wants to come back.

Maybe you should have considered doing a CR-1 visa initially?

Because my Ex=wife from a decade ago, was married to me in the Philippines, I am supposedly still married to her, although I am divorced long ago in Idaho. And it will take a year or more to get the "divorce" recognized in the Philippines. Courts there take forever.

We changed my wife's in less than 2 months...

Yeah, but her daughters was set as my finace's parents being the parents. She thought she was going to die and had no money. Young person giving birth and not sure if she will live or die. So who knows. She's near GenSan and knows only lawyers. Don't know how else to do it.

    Suggestions? [e-mail address removed]

There is no guaranteed timeframe, only estimates.  You can check the estimates for processing the I-485 at your local field office here -- https://egov.uscis.gov/processing-times/

What form did you file in Texas?  The I-485 package should be mailed either to the Chicago lockbox or the Phoenix lockbox, depending on the intending immigrant's residence.  For Idaho, the I-485 filing address is the one in Phoenix.

I filed the I-129f in Texas. But he NOA 1 says the address is California

From the timeline, it looks like they have only just filed the I 129f….

Yes, but timelines being what they are, I have to figure for far into the future months.

Okay folks, we have to do some things in the courts in the Philippines to bring my fiancé's daughter here, I.E. correction of birth certificate, which can take a year or more.

What I need to know, since my fiancé will have to stay in this country during the wait for the green card, is how long does it take for a green card to go through after filing? I'm not finding the answer here. I filed in Texas, but the NOA 1 came from California? I kind of need to know a timeline so she can be back in the Philippines to be in court.

    I am in Idaho.

Yes, she is still there in the Philippines, waiting. I filed in May for I-129f and have the NOA 1. I know it will take many months to get the visa, but the timeline for the Philippine courts can run from a year to 2 years. This is why I am asking what the timeline for the green card is, because everything might come together at the same time.

And she might have to fly back to the Phils after our marriage and before the green card is issued.

Can you confirm that you have just filed the I129f petition .. that your fiance is still in her home country ..  that will help us to reply with useful information .. thx

  11. She was never married, as he abandoned her as soon as she got pregnant and fled the country. Typical Pinoy. And yes I think a DNA test would be a great idea.

Because my "divorce" from a Filipina a decade ago was never recognized in the Philippines, I am going through that nonsense to get it straightened out on me, so we can't marry there.

  12. Okay, I tried to make the original story shorter. Really, it is A's daughter, but she was very sick at the time of birth and she also had  no money and no income, so when they filed the BC, late, her parent's names were put on it because they had insurance. She knows it was a stupid thing to do, now, but daughter N is now 13. So we are going through a lawyer to get this straightened out, but it's going to take a year, according to the lawyer. And yes, the family confirms that N is A's daughter, and they are trying to help all they can.

A, later went to college and became a teacher. She never thought she would ever marry, so wasn't too worried.

Now we have to pay the piper.

  13. Greetings good people,

As my Filipina fiancé and I are filling out paperwork for the K-1 visa, the one section asks if she has a child, which she does. BUT, the BC has her parents names on the BC, (they thought my fiancé was going to die) and will take a year to straighten out through through the VERY slow courts system in the Philippines. The question is; Do we still put it down as her having a child? Or wait until the BC is corrected to file separately. and not mention her at all on the K-1 visa. And if we do not mention her as having a child, will that cause a problem on later getting her here?

We have thought about just doing the adoption of her daughter from her folks.

    Any ideas will help.

    Thank you in advance

  15. Greetings nice people,

I am trying to figure out how to get my fiancé out of the Philippines to a country where I can meet her and get married. The paperwork for her passport was all but finished in Manila when the Fires, volcano, super typhoons and Covid hit. It's been over 2 years now since I was there and I am trying to figure out where she can travel to after she gets her passport, that I can travel to, also! So we can get married and file a CR-1.

Any ideas you have is appreciated. Thank you.

  16. Having left the Philippines over two years ago, I have not seen my little family in so long! After waiting for papers for adoption of am orphan, and having to track down her family line, having the orphanage burn down, (wife and daughter were both raised there until we took daughter out of the orphanage for school and family love!), fires in Manila damaging government buildings, volcano erupting, and then the freaking Cat 7 typhoon ruining things, and finally Covid, I am at an end to what to do! The adoption papers and passports were almost done, when the poop hit the fan!

At this point, am I going to have to go back to the Philippines to make like we just met, or get married, or meet her in another country? Any suggestions?

I have been keeping them both fed and clothed and daughter in a fast school, since orphanages don't school much.

  17. Okay, smart people. I am just starting a fiance visa for my intended and her adopted daughter. Both were raised in an orphanage. Fiance just finished adopting daughter, legally. I am wondering if anybody else has done this, because there are no known parents involved for my fiance. Is there anything I need to know about filling out the form 129f, in this case?
