And I noticed u said u haven't seen eachother in 2 yrs? that may be an issue with applying for the CR1 (marriage visa) also. And as it has been said...a visitor's visa for your husband will be pretty much impossible. Best of luck.

If the Moroccan government wasnt cutting fishing deals, oil deals and phosphate deals with Europe and taking all their resources and money, they would have the support they needed and the money they needed to self govern...
So in other words, leave them alone & let them figure it out themselves?

Glad to help. As for doing the NOID...well i was luck to get it from CSC to start with & also I had just gotten back from spending 3.5 mths there with my daughter & couldn't afford to go right back to get married, so we figured we'd wait & see what happened with our case & we got lucky enough to get the NOID & able to rebuttle. As for the NOID being denied..from what I read by Marc Ellis, a pc6 marker (fraud marker) is put on the case when refused at the consulate & if the Service Center also denies the case (in other words, agrees with the consulates findings), the pc6 marker is found to be valid & so bans entrance in to the US. I read that you can try to fight the pc6, but its very difficult. I just rather not think about it though. Focus on what you do have control over. The questions should show u the exact reasons for the denial. I wrote a rebuttle letter just based on the interview questions & when i received the NOID, the exact reasons were exactly what I thought they would be. Did your fiance ask why they denied him?

Almost forgot....as for DOS saying the case is still in review...the consolate can deny giving a visa, but they can't deny the actual petition without the Service Center (CSC or VSC) also denying it. So they send the case back with the 221(g) recommending that the service center revoke the original NOA2 approval. There r usually a few things that can happen with these cases: u can stop it & get it reopened at the consulate (VERY rare), the service center will review the case & send u a NOID so u can rebuttle the case (and they decide to deny or reaffirm), you can go get married (which will make the K1 useless, but the reason for the denial can still come back when u file for CR1), or they will just let the case expire (at while time u can refile the K1, or get married & file CR1...but the reason for the original denial will probably still be brought up). Hope that's not too confusing. This whole process is crazy.

Just got off phone with dept of state. According to them, a 212g means a decison has not been made, the case is still under review. She said there is nothing in the computer that states our visa was denied......could still be denied but as of right now it is still under review. Any experience or comments???
Ok Nicole...first off BREATH...many of us have been through this...we got our 221(g) in June. 1st thing u need to do is call & email the consulate...find out what they tell u, see if the case has been returned yet. Also u need to contact your senator or congressman. We r working with our Senator. Also, has your fiance sent u a copy of the form they gave him yet? I'm assuming it is a refussal worksheet marked 221(g). If the consulate replies back that your case as been returned to USCIS & give u the diplomatic pouch #, then u can call the pouch tracking # (i believe i posted it on here: Sent Back to USCIS thread (If u can't find it, feel free to msg me) If there is a pouch #, then the case should have left the consulate (according to how they r handled...no pouch # is assigned till the case is leaving). If not, call and try to speak with the conular chief, get as many details as u can, go through the questions asked at the interview (everything is asked for a reason). Also, if its still at the consulate you can try sending in a rebuttle letter (after u figure out the reason from the interview questions) & get letters of support from family & friends. Don't let up...do the same with the Senator's office, each office has an individual that handles visa cases...find them & send them all your info. The more u push, the more serious u seem, and hopefully the quicker the case will be reviewed. Are u through CSC or VSC? (i don't remember...sorry) CSC seems to be reviewing the returned K1s now...u can also make sure that they renew the expiration on your case to give it time to be reviewed, etc.

The saddest part of this debate for me is that the people (Sahrawi) are being propped up and "supported" by the Polisario who don't want them to be free either. Their ultimate goal is to have control over that region. Algeria supports the Polisario because it would give them access to the Atlantic Ocean. If tomorrow Morocco gave up possession of the Western Sahara it would be a huge vaccum, because there is no infastructure, no sense of governance or even much industry. They would rely heavily on the outside countries. Without a doubt Algeria would step in and be a new colonial master in the region.
For starters, I'm still learning about all of this...most of what I know is what I've been told. But how can they have an infastructure & sense of governance as u put it if they haven't had the indepependence to do so? And don't many new or struggling countries "rely heavily on outside countries"?

yeah...sounds like AP, which has no set time frame of being done. And another note, a 221G can be used for a variety of reasons, we received one on a refusal worksheet, but also know that the consulate/embassy can not officially deny a visa. They make seperate deicisions from the Service Center (VSC or CSC) in the US. So what happens (for any interested) with refusals from the consulate is that they refuse the case & return it to the Service Center with a recommendation that the Service Center withdraw the original approval & officially deny the visa. So both the consulate & Service Center must deny or approve a case for a visa to be issued or denied. Best of luck with your AP...hope is goes quickly & smoothly.

Yeah...from what I found the American schools are very expensive. I'm not sure about the french schools either, but any specialized schools seem to be more expensive. Best of luck. My daughter luckily got to go to my fiance's brother's school for the 3 mths we were there for free...so I'm not sure what the actual price would have been. I can ask my fiance to find out though.

for the op (that's you, yassinerabat11) - i strongly suggest you consider the advice offered by the members in here about the timeliness of visa delivery from interview to in hand. many of them have been in the same boat you are in, and they are not offering you their opinions on this subject to play games with you.

Thanks charles. I think that's why so many are getting frustrated, cuz they have been in that position, and it feels like the OP asks for advice and then says they don't want it. Many of us have had the run around & know that unless the visa is IN HAND...there is no guarantee in MENA land (or many others). Best of luck to everybody. That's all I'll say for now

No problem.. I hope you're feeling better and that you get reaffirmed..
As for me, I'm starting with a new company on Monday, and it promises double the work.. But that also means half the sleep, and two 19 hour days every week. If I make it, we'll be in good shape. Unfortunately I can't drink the RedBull anymore, it gives me heart palpitations and makes my panic attacks worse (which are a new thing for me lately, so I'm just learning how to deal with them). So I don't know how I'm going to do it.. Just pray for me.

Yeah...u need to take care of yourself!! And I hear ya about the panic attacks...been having those too since I was reminded about the fraud marker & him being banned for life if we don't get reaffirmed...trying to stay positive. And sending prayers your way Sarah...hold in there...hopefully things will get better soon!!

Do you know any statistics on cases that get reaffirmed?
How much time do they take to make a decision once you send all of the info back to them?
I have NO CLUE
I haven't heard of many ppl getting NOIDs for the K1s....so not much to compare to. I'm assuming the review will be done within 30 days. And my Senator's office said to let them know as soon as I mail it in so they can contact them...so that should help.

Just a word of advice....BE WELL PREPARED...you are dealing with Casablanca. You don't want to be another statistic on the denied list

And many of us felt the same way you r about there being no way they will deny us...and we were wrong, so that is why we are telling you all of this. You may not be worried or nervous now....neither was my fiance...until you step in front of the person who is in control of your life...then things change. So best of luck & we all can't wait to hear (hopefully) some good news.

also look at the "hoping not to get denied" topic here on MENA...there r lots that have been through recently & tons of info out there. You should have copies of passport showing entrance & exit for each trip, so that should cover not having the plane tickets. Also looking at the Morocco consulate reviews could be helpful...most ppl that review list the main questions & issues that come up during their interviews. The biggest pointer I can give you is to stay calm & speak from the heart. From the sounds of it, the more you know about your fiance the better, so in other words the more you talk about what you know the better. This was a mistake we made...my fiance didn't expand enough, so they believed he knew nothing about me. But it is a fine line....you also don't want to give too much information either that could bring up issues they weren't originally concerned about (another of our mistakes...lol..we provided too much evidence). Also, be sure to know the information sent in the original application by your fiance...this is all of the info they have about your relationship, so they know everything from it & it is what they base their first impressions & questions on.

As for us, we r doing good...almost have everything together to send the NOID in...just waiting on some final relationship support letters from friends & then I'll be sending it in. Kinda excited & scared at the same time. I keep reading over the NOID, hoping I covered every point well enough to be reaffirmed....
Looks like there is an interview next week...hope everything goes good for you guys & feel free to ask anything here...I think we have a pretty well rounded group here
