I wasn't referring to any one case specifically; I was wondering based on what was written about the CO's not returning a case unless they became aware of more evidence that the DHS did not have. Just wondering if cultural norms, values and judgements of a specific country are considered "evidence" that the CO has but the DHS doesn't necessarily have.

    I agree with the other post also. As difficult as it is, try to take the emotion out of it, and review everything from their perspective when devising your response to the situation. It's not easy; I know, but the reality is that they probably already view us as emotional, head over heels, vulnerable women who have let our emotions lead us to a foreign country to get married, involved, etc with foreign men. Therefore, I think the poster is right. We'll all due well to try to take the emotions out of it, as difficult as it is, when developing plans to overcome denials, etc.

    I agree...thats why i'm trying my hardest to focus on the facts...like u said...easier said than done with all of the emotions involved...helps having everyone who has been through it to talk to :)

Btw, Senator's office is on the case...i told her about everything & forwarded her all the emails between the embassy, refusal form & interview questions...she said she will do whatever she can to stop it & if not she will atleast find out the reason for denial. She was a little disturbed as well about how they seemed to make sure & call before we left & then denied as soon as we were gone.

The reason they don't care is because if it is a fraud relationship constructed solely for the purpose of securing immigration benefits, then, it's no surprise that the Moroccan family is more than happy to be kind, generous, loving and very accepting of the American wife and her child (from a previous marriage/relationship). It's their ticket to the U.S.A in the near future, after all. I'm not saying this is true in your case or in any other case but you have to think like a CO sitting at the highest-fraud consulate. Would these Moroccan families be just as accepting of their sons marrying an older woman from their community who has a child from a previous relationship/marriage?

    Now--you have to sit and think about ALL your red flags (and you'd probably know them best), how you can address them and eventually overcome them. Focus on the response. Good luck.

    I guess u r right...its just hard when u know its true and not just a show...they don't need a ticket to the US...he has a brother there...his family doesn't need a meal ticket...they have money...so i really don't know. The only other things they really questioned about was him working for the government & my financial status (but they never asked for any papers to confirm or deny any assumsions) :wacko:

  4. I wonder if the fraud level, perceived or accurate, in a specific country (such as Morocco) is something the consular officers consider as evidence of which they are aware, and DHS is not. Also age differences, previous marriage/s and/or children from previous relationships, etc, etc, etc, and the cultural norms in Morocco connected to these - I wonder if these are things that the co's are allowed to consider "evidence" that they have and the DHS does not. Does anyone know?

    I would think if they r basing it also on "out of cultural norms" then they should also take in to consideration how the Moroccan family feels about it, because every family is different on their views. If it was because of my daughter, then its because they didn't try to get any information about the relationship...they only asked her age...if they saw even one pic of her with him or his family, they would see that they accepted her whole heartedly & were devestated when we left.

  5. Ok, isn't there a document you can file under the freedom of information act? Actually, I know there is because USCIS told me about it. You have to pay a fee and it does take a little bit of time but you would at least have that information before another interview for the CR1. Call USCIS and get that filed as soon as you can because you will get copies of everything and it is illegal for them to keep it from you.

    yeah...i found it...got it filed out, just have to get it in the mail :) Still trying to figure out what is best to do...wait, refile k1 or get married & do CR-1??? Maybe i should start a poll...that could be interesting to see :)

  6. Monica I am so so sorry that you are going through this. I know exactly how you feel because this happened to me and my husband. Please try to keep it at Casa I pray pray that this can turn around for you guys. I know you have already waited so long to be as a family...but be strong. I was not so lucky and our case was sent back to uscis and they took four months to let me know they had received it..and took them over a year to even touch it..and we are still waiting for news from Casa..insha allah things will turn out for you..please know if you need someone to talk too I am here. (F)

    Thank u so much...from what i keep reading it seems like unless we can stop it at Casa (which my congressman's office said we can't...ugg) then it would probably be better to just go back and get married...since we would be waiting probably almost a yr to hear back anyway. Its so frustrating...atleast my daughter hasn't fully realized what's going on yet...I dread when she starts asking why she will see Hicham again...she has been so excited about us getting married so, as she says "when u marry my mom i can call u daddy" :(

    Not sure if that link works, but it's in the pinned thread. It was Kiyah's response to tany's post about being denied. It might help you cut through some of the other pages in the pinned thread. Anything from the senator?

    Well...congressman's office was USELESS...said they can't do anything right now...that the COs are protected from being contacted by the or something, so they can't affect their decision :bonk: Writing up requests for the consular notes with the DOS & USCIS, which i found in Kiya's info...and the guy at the congressman's office said a letter should be generated that i should receive soon in regards to why our case was denied...doesn't sound like anything anyone has mentioned here...was hoping for more assistance...he said to call back if i get stuck & can't get info...HELLO...CAN'T GET INFO!!!! that's the reason why i called!!! So they can't stop it from coming back...will try Senator now...Inshallah THEY can do something!!

  8. faxed release to senator...the person at the congressman's office is back in today...will call when they open in 1 hr...will be a LONG hr...so there is a chance to get it turned around there? From what i've seen, if it gets back to the US it takes many months to get anything done on it...am i thinking right? :help:

    Thank you for your email inquiry. Mr. XXXXX’s visa has not been denied. His petition was returned to the Department of Homeland Security's Bureau of Citizenship and Immigration Services (USCIS) on June 14, 2010 for further review. In order to seek information on the status of the case, you should contact the USCIS National Customer Service Center at 1-800-375-5283. However you are advised to wait a few weeks before contacting USCIS to allow them to receive and review the file.

    Due to the personal nature of the information, the file was sent via registered diplomatic pouch.

  10. What he actually said was, "We are sorry, we can not give you the visa. But this is not the end, you can get the visa under other conditions" The first statement is what i understood over the phone...i have sinse spoke with Hicham online...easier to get exact words that way :)

  11. Take the energy from being pissed and use it to get stuff done. The above it right - you need to work to get it turned around before they send it back. It really sucks that they delayed the denial so you couldn't get married while you were over there. Seems like you gave them a little info and they used it against you, maybe?

    There is also a lady out of an Ohio senator's office who is looking into the reason that there are so many denials out of Casa. She can't do the inquiry for you, but it might be good to give her the info of your case, especially since you and your daughter lived there for a while. She may be interested. Let me know if you (or anybody else) wants her phone #.

    Hicham is getting the paper scanned...and i would like to have the # for the Ohio senator. We r still trying to figure out what happened...will let u know as i find out more.

  12. They are amazing. Been there..... They just did not want you coming to the Consulate so they knew to wait until you left. Try to get your Congressman/Senators on them now before the case gets sent back. BTW they will tell you they sent the case back but usually it sits in Casa for at least 1 to 2 months. I hope you can get some results soon.

    k...good to know...i'm trying to call them both now...one at Senator's office is out of office till tomorrow :angry: I'm still a LITTLE pissed...lol

  13. Ok...i'm going to try to write this calmly & retionaly, excuse me if I don't. Hicham was DENIED this morning...no questions asked or anything. They brought him back and said, We are not approving your case, we will be sending it back to the US and you can move on with the next step of marriage." Excuse my language, but #######!!! Why not tell him over the phone BEFORE we left...why make sure he brings his passport?? They gave no reason, just that. I'm trying to contact my congressman to see what the options are, but i know our case expires June 25th, so we don't have much time...any suggestions would be greatly appreciated...I'm just fumming right now!! They meant to make us think he was approved RIGHT before I left...they knew when we were leaving :angry: Ok...trying to breathe...I guess I should calm down before I write anymore or say something i might regret...lol Thanks everybody for the support.

Well, I head back to the US tomorrow & this afternoon the embassy called :dance: They asked him to bring his passport & come Monday at 3pm, and to tell them to let him through to speak to the Counsular....not sure what that means. He said they are supposed to let him in the back (not just where they do the interviews at the windows)...Anyone have any experience with this??? Why would they have him come in the back?? So glad we got a call before we left...makes me feel a little better...they didn't call & say denied & they did say bring the passport...still haven't said approved, and bring your passport so we can get u your visa...i know...never happens that way, but i can dream :) So it will be a weekend full of wondering again...atleast i will be busy with flights...and by the time i wake up on Monday Inshallah Hicham will have some good news!!!
