  1. Yay!! Congrats. You are going to have sooooo much fun shopping :)

Thanks!! I've had some fun this week looking at all the pretty little dresses!

Congrats HuggleBuggles on the baby girl. DH and I are still trying to conceive. Found out DH has very low sperm count so we have an appointment with a fertility doctor on June 12.

Good luck! Hopefully the doctor can help you guys out :)

  2. Sorry, to be clear...I do or do NOT need the DS-260? Not on the checklist sent by the Consulate...

    No, you don't.

As for signing things beforehand, unless something has changed (someone please correct me if I'm wrong) the only thing you shouldn't sign is the DS156k. Everything else you can sign before the interview. At least, that's how I did it in 2009.

  3. Ok, something I have been unsure/nervous about for a while.

My last visit to the states was 173 days long, from September '11 to March '12. Before that, I was in the US for 2 weeks in July '11 and 2 weeks again in August. These 3 trips were separated- but could it still count as an overstay? I have been told for the most part that the 180 day rule is PER trip or per calendar year, so I should be fine. But now that we are applying for a K-1, I'm worried about this posing a problem.

Furthermore, should I avoid trips south of the border until the visa is approved?

Thanks in advance.... and sorry for the thread hijack.

There has been some debate on here if it is 180 days per trip, or 180 days per calender year. Personally, I interpret it to mean 180 days per trip. But, either way, you're fine. You didn't stay more than 180 during any 1 trip, or more than 180 days in a calender year. No overstay. They will probably ask you about your trips during your K-1 interview, and they may ask why you were there for so long, so i would be prepared to answer that. But I don't anticipate any issues.

I don't see why you should avoid trips while the visa is in process. There is nothing preventing you from visiting. Just keep in mind you may face some additonal questioning with the pending visa application. Come prepared with evidence of strong ties to Canada.

  4. If you absolutely have no proof, you need to start saving EVERYTHING. Even if you just buy a bottle of water. I'm still saving everything for when I file for AOS. It's habit now *just in case* they try to question things.

That will come in handy when you do ROC in a couple of years. After 3 years of saving everything, I constantly remind myself I can stop saving things!

thanks everyone.... I appreciate it all..... I just don't want an RFE ;)

I was reading that most if not all banks have a notary and even thought of writing up a letter and both of us going in so they can notarize a letter saying that we are in fact there in person..... along with any receipts I get in the next few days...

Sigh, why can't they just take our word for it hehe

Wouldn't that be nice? Who is talented enough to fake all those pictures anyways? But I actually think the notary thing is a really good idea. Its impossible to deny you were both together with that.

Have you ever gone to any sporting events or concerts together? Ticket stubs with seats next to each other could help. And then if you had any photos to back them up, even better.

  5. Hives are the worst! When I was 12-13 I had a serious issue with hives. I would seem to break out at random times, and could never quite pinpoint what was causing it. I took some allergy tests and everything came back normal. After about a year it stopped and I haven't had an issue since. I still have no idea what it was from.

  6. Unfortunately there seems to be no shortage of human error with USCIS. It only takes one person out of the many who touched your file to screw things up... I feel for you, I can only imagine how frustrated you must be!

Unfortunately, you may not have much luck getting a copy of the medical from Toronto, but its worth a try. I remember a member who tried this in recent years, and Toronto would not send the information out (maybe it was colleens?) If you can't get this, I think your onmly other option would be to get a new medical done. There really isn't a process to follow to have USCIS locate the information, unfortunately.

  7. Thanks gals!

Its hilarious you all say you had a feeling about the sex, because I was convinced this baby was a boy! I felt her move really early and she's a rough tumbler, so in my mind that was a boy trait. I was shocked. But also excited! There will be pretty pink dresses galore.

I am sending you girl vibes canadiandggal! I know 3 other girls who are prego right now, and only 1 is having a boy, so i say the odds are in your favor.

  8. little story... I am great at not being overly hormonal when pregnant except during labor then the gloves come off... However With Levi at 36 weeks when I was all big and swollen, I was eating a banana in our kitchen when My husband walked in and I looked at him and started to ball. He asked me what was wrong and I replied with "you dont like me anymore!, you just dont like me". He hugged me covered in banana and tears.

Omg! That's awesome! I see myself in that, right down to the bananas. I love bananas all the sudden. Today I got upset and told Bill I was feeling neglected. Poor guy, he spends every hour hes not at work with me.

its suposed to be OUR house, yet i'm feeling like im suposed to do everything, while he talks about spending more and mroe money on pc parts and games and going out with his friends. And when i say anything about how i feel, i get the "you dont have a job" stuffed down my throat. and thats really hurting me. he keeps doing that lately and i've told him how i feel but its like he doesn't care. And hte minute i complain he says i'm trying to control him and wont let him see his friends or play games or spend money.

Sorry you're going through that Kimbear, that's tough. If you don't mind me asking, are you looking for a job, or are you just planning on not working? I only ask, because this sounds exactly like my parents relationship. My mom does everything around the house from cooking and cleaning to mowing the lawn and taking out the trash. My mom has never worked, she was a stay at home mom, and when we grew up, she decided it was to late to start a career. So my mom is bitter because my dad doesn't help around thr house, and my dad is bitter because my mom won't work and doesn't help pay the bills. So my dad thinks since he makes the money, he can spend what he wants. Well after many years of this, they are now in drowning debt. My mom complains about his spending, and is always upset she doesnt have the money to do what she wants, but she still refuses to work. Unfortunately your hubbys attitude, although really unfair, seems kind of common among the men in my life.

Bill and I had a little rough patch right after we bought our house. I wasn't working yet, and spent my days working on setting up the house. After about 2 months we had to have a serious conversation about, basically, what the heck I was doing with my life. So the next day I put in several job applications and everything was a lot better. He just wanted to see the effort. With that said, finding a good job can be really tough and take some time!

  9. I would email Montreal and ask about rescheduling more then once. I don't think this is an issue.

Yes, your son faces the same issues as you. He has a visa in his passport with the intent to immigrate to the US.

Flames is right. It doesn't matter if you get it in writing. The decision is completely up to that one CBP agent on the day you cross. The president could write you a letter and it still isnt a guarantee.

  10. Like SF said, if you have an interview, you may be able to get the IO to change it. Someone recently had luck with this. If there is no interview, you're stuck with the name in the forms, unfortunately.

  11. You can always call your border crossing, explain the situation and see what they say. However, I wouldn't put a ton of faith in the answer you get. The person answering your call is likely not going to be the person you talk to at the booth the day you visit. This is really discretionary. One CBP may have no issues with it, while another will refuse you entry. There are absolutely NO guarantees, so if you are looking for that before you try to cross, unfortunately you won't get it, from anywhere. With that said, many people have done this without any issues. Its really up to you. You just need to weigh the risk.

Sure its inconvienent, immigration is all very inconvienent, don't you think? I'm from a border town and felt the same way. There were many before you and will be many after you who experience the same thing. I think you need to decide how important the trip/trips are and go from there. I have never heard of rebooking more than once being an issue I don't think it is. Maybe someone has done it and can confirm. If you're worried about it, you can email Montreal and ask.

  12. You can post whatever you want in the Canada forum! No need to move the thread unless you want to.

Personally, I waited until I received the visa in the mail. But my boss totally lost it on me. She was mad because I didn't tell her my intentions to move soon. I gave her 4 weeks notice, but apparently that was not enough! I was a college student working part time at Tim Hortons... yeesh. So anyways, I told her to kiss my you-know-what :)

But I planned on moving 6 weeks after I received the visa, so I had some more time. Still, I would wait until I knew I was approved before leaving your job.

  13. Ewww Flames, no... I can't stand it.

Milk of magnesia works OK, but I didn't realize they make it in pill form. I'll look for that, thanks Ontarkie!

Usually I can fight through the heartburn, so its not that bad. I think the hardest part of sleeping is waking up every 2 hours to pee...

I'm only just halfway- 20 weeks. Its not THAT bad, but its not really fun either. I just think I have the right to be bitchy without having to explain myself. I'm usually pretty good, but I have my moments... just let me have them. And then if I decide I was to mean I cry after because I feel bad. What the heck is that all about?! Its weird because I'm not an emotional person in my normal form...

  14. Lewiston sucks!! I always cross at the Peace Bridge. I agree with Udella. And I wouldn't worry about it, either. You're visiting your parents and you're returning to Canada. You've not done anything illegal.

Totally agree, on all points! I've never had an issue at the Peace Bridge.

Really, the consulate is most likely not going to research your crossings any further than what you tell them. It would be insane for them to do that for all the people they cycle through in the year. You never lied, you were visiting family. Honestly, how many of us have been guilty by ommission at the border? I certainly have.

  15. You know what irritates me? I'm thrilled to be pregnant, but its no walk in the park! You moms out there know. I'm blowing up like a balloon, my feet hurt, my back is sore, I pee constantly, sleeping is awkward, I'm constipated, everything gives me heartburn, my clothes dont fit... I can go on. But I'm the bad guy for being moody! I think I have that right! :bonk:

  16. it was just forwarded to the nvc...she probably doesnt have a case number yet let alone an interview..several steps before she gets to that point

Clearly inky was simply pointing out the next steps. There is no suggestion she has an interview yet. She is a K-1, so NVC does not set her interview, the Montreal consuate does. If her petition was approved over 2 weeks ago, there is a very good possibility she already has a case number. Her next steps are consulate specific, so perhaps lets let the people with experience working with the Montreal consulate direct her forward

    ?

  17. I thought that Dr. Seiden's office in Toronto sends them direct to the consulate but I'm not certain. It'd still be 2 trips might be better/cheaper to just hang out in Montreal.

Unfortunately not. You need to pay to have them sent to you, or pick them up yourself.

  18. If your green card expires on July 7th and you are going to file the second week of June, that's fine. Your card won't be expired, it expires July 7th. If you were to file AFTER July 7th than yes, that could be a problem.

Your foreign passport has nothing to do with ROC. It is up to you if you want to renew it. Of course, not having a valid passport prevents you from travelling out of the country.

You don't have an EAD if you have a green card. After you file for ROC you will receive an extension letter that extends your status for 1 year while your ROC is in process. Your expired GC along with the extension letter is your proof of status until the ROC is approved.
