Ok so this number needs to be factual and needs to have evidence backing it up... Take the gross earnings from a pay stub and multiply it by the number of paychecks received in a year (26 if paid every other week, 52 if paid weekly, etc.) Then back this up with copies of paystubs (the most recent 6 months as per the instructions on the I-864) Re-do the I-864, base that number on what the paystubs show as the current income, put the correct numbers in for the total income for the tax returns and include the tax return transcripts with no W-2s or 1099s. Include the required proof of citizenship, make sure household size is correct and come back here for any questions.

Ok... so reading the RFE, my suspicion is that it is a combination of a couple of things. As @Dashinka indicated above, there have been examples of people getting RFEs for submitting tax return transcripts along with W-2s/1099s. My big question for you guys is, in part 6, item 7 "My current individual annual income is:" What did you base this number on if you did not submit pay stubs or an employer verification letter?

Yes you would file the I-130, I-485 and the I-864 all together (Mandatory Forms). Optional forms are the I-765 if you want to get her Employment Authorization ($260 filing fee when filed concurrently with the I-485) and the I-131 if you want to get her Advanced Parole (Ability to travel while the application is pending) ($630 filing fee)

I-129F completion help please?
Edward and Jaycel replied to Joe Bear's topic in K-1 Fiance(e) Visa Process & Procedures
Glad to do it -
This happens to pretty much all K-1 AOS applicants as well. When you have an I-485 pending, you are in a period of "Authorized Stay" while it is being adjudicated. As long as she entered legally (which your wife did under humanitarian parole), and she does not have any deportable offenses on her record, the concern level should be low.

April 2025 Filers
Edward and Jaycel replied to smilingstone's topic in Adjustment of Status Case Filing and Progress Reports
Hoping for smooth sailing for you guys! -
As long as the immigrant medical exam was done within 1 year of filing the I-485 then yes, just include a COPY of the DS-3025 with your other supporting documents in the filing and leave it at that If you want to see the table of contents that Jaycel and I included with our filing, you can go to the first post for the November 2024 Filers Thread we started here

@Dashinka is 100% correct here - As long as the DS-3025 is marked complete and is complete, there is no need for a civil surgeon / I-693. The immigrant medical exam performed abroad is good as long as you file the I-485 within 1 year of it being completed. You should include a copy of the DS-3025 with your AOS filing to remind USCIS that you had an exam abroad and to look in your A-File to get it.

The question is, on his DS-3025 form he should have received from the immigrant medical provider, was he provided a blanket waiver code for the Hep-B vaccine for "Insufficient time to complete series" (Blanket Waiver Legend "B") and on the back of the form was the box checked that says, "K Visa applicant voluntarily completed vaccine requirements" ? If so, he does not need a new medical exam from a civil surgeon.

Looking at the statistic trends, it appears that interviews for all Adjustment of Status applicants are on a sharp increase since the new administration took over. The last time Trump was the president, there were very few interview waivers for green card applications and it appears that they are going back to that policy.

I'm a firm believer that it can't hurt to go on "Ask Emma" ask to chat with a live agent and explain that your biometrics appointment for the I-765 was almost a month ago and the case status never changed to "Being Actively Reviewed" like it did for the I-485 and if they could check on it for you. We have done that before for our I-129F and for the I-485/I-765 when it was almost a month with no biometrics appointment scheduled. Both times we got movement on the case within a couple of days. Coincidence? Who knows? but using Ask Emma is free and open for anyone to use
