    It's possible they could bring up the issue at her interview. Consulates do not like issuing immigrant visas to someone who has no intention of immigrating. A green card is not supposed to be used as an alternative to a visitors visa. In fact, there are specific rules that will result in a green card being revoked if they determine it's being used that way. Misuse of a visa is a crime under title 18 USC, section 1546.

    This is definitely a legitimate requirement. The Consular Officer is evaluating what the family income will be once you are in the USA. If you won't have a job at that time, your current income means nothing. A job offer is not "current income". Unless you have at least three times the income requirement in "LIQUID" assets, you'll need a joint sponsor who does qualify based on their own family size plus any intending immigrants.
    I take it this is a CR1 or IR1 and perhaps CR2 and IR2 visas you are pursuing, not K3.

    Where is that? Sole custody does not eliminate the non-custodional parent right in any state within the USA.

    Then go to court and have his parenting right re-voke. This is going to be your only way around this not here on this board, but in the court of law. You have enough evidence if what you have printed above is the case. Then move on from there,you need a family lawyer.

    Lets not get on a high horse about non-custodial fathers. In my experience there are many custodial moms whose desire is to erase the ex from her "new" life, which she then extends to the child by default. The "rights" you speak of are to protect the CHILD, and allow the child to develop an independant relationship with the father. Are there bad apples, of course, but those bad apples exist on BOTH sides! We have only heard ONE side of this story from the OP, yet everyone bashes a father who is not here to defend himself. I only hope for the sake of the child that the CHILD'S rights are protected through a court hearing to determine what is BEST for the CHILD.

    something is not right there.. there is no way (and i consulted with a lawyer) that his friend got a work authorization out of nowhere... something is fishy there. According to what my lawyer said when i first consulted with her, an overstay only has 2 options.. either return home or marry a US citizen.. the only other time the lawyer can get you out of this mess is if you had been picked up by immigration and detained and are under deportation proceedings.. and then and only then lawyers will charge you up to 10 grand and get you out of it...
    but as far as i know, an illegal can't just come to a lawyer and ask him for the help with some kind of authorization.

    Correction, at the time of divorce if before the 2 years the immigrant must Remove Conditions with a wavier. If green card is received, the USC is still held responsible for the 864 finance obligations.

    And I answered correctly as well.....providing a truthful and realistic response ...how is that an 'attack?' Just because I told it like it is instead of some pie-in-the-sky answer? The border officials will see her F1 denial, will see her husband's GC application pending....and so the question remains....what possible story could she produce that is the truth about her true intentions of returning to India after her studies instead of staying put with her GC husband?
    And a visa is NOT an entry pass to the US...all it is is an object with which to ask permission to enter the US. Oh gosh....now I said something factual.....shame on me.

    I am always slightly surprised that people studying in the US have such a poor grasp of the language. There was a post yesterday from someone who wanted to invite his Parents to his Graduation and it read like it had been written by a 5 year old.
    Anyway:
    There is no need for the OP to tell us anything.
    I do not know if she has any other issues like a ban, struck me as being possible.
    Just wondering how the PoE would take somebody married to a USC with a USC child turning up on a Student Visa... Might be an interesting conversation.
    Can not say I know much about baby food, but like many foods it does vary by Country. Pretty sure I have seen the same comment about not being able to get in the US what you were used to in the UK.
    If the child is not thriving and the speculation is that the child would fare better in the US then time for Daddy to get on a plane pronto. Which begs the question where Daddy is in this process. He sounds absent.
    I would strongly suggest Daddy gets some Legal help.
