have you gone through your visa interview at the embassy in Argentina? if not you still have that to do before receiving the visa. NOA2 means the United States has approved your USC fiance's petition (i129-f), the embassy in Argentina still has to approve your visa (K-1). I would also say not to have a party like that. the marriage is just a signed piece of paper you can have the party whenever, AFTER you've signed that paper in the US

they all get sent to the lock boxes in texas but i believe the majority get sent to be processed in California. they go to the other offices for different reasons.

that's why evidence of married life isn't a requirement for AOS from K-1, because it is hard to get really anything in such a short time frame. we can't get my husband a bank account until he has a state id/drivers license, and we cant get that until we have at the very least an NOA1 from the AOS. but I also agree, the notarized letter from FIL about your living situation would be good also encourage just getting your own place together. depending on the landlord, whether its one person or a company, they should only need one person to meet whatever financial stuff they require. they didn't even need an SSN for my husband when I added him to the lease.

this is for a K-1 visa? after the interview, whether you receive a verbal approval or not, your case will go through more administrative processing which can take days or weeks but you will not get your visa right after the interview, it will take some time for them to process it. getting the visa in hand will also take days or weeks, depending on how long it is in administrative processing

i believe the co-mingling of finances and stuff is more asked for during the removal of conditions process. including it as part of AOS isn't required, but some people do as just extra evidence of a bona-fide relationship. I included a photos from our wedding, a copy of our joint apartment lease, print outs showing my husband as a dependent on health insurance (medical, vision, and dental), and a print out of my life insurance (2 different ones, both employer provided) showing him as the sole recipient. but none of that is required, the only thing required to show your marriage is real is the certified copy of the marriage license.

I INTEND TO PROVIDE HOUSING, FOOD & MONEY WITHIN MY RESIDENCY AND FINANCIALLY SUPPORT HIM WITH ACCESS TO MY ANNUAL EARNINGS FOR AS LONG AS NEEDED & UNTIL HE IS ABLE TO SUPPORT HIMSELF FINANCIALLY IN THE UNITED STATES, FIRST AS A FIANCE AND THEN AS MY SPOUSE AFTER HIS ARRIVAL IN THE UNITED STATES. sorry its in caps, that's just how i typed it on the form lol -

they only require the one year of tax return transcripts i wouldn't worry about it if he makes well above the poverty line i only included 2023, but I also included my W2 for 2024, 6 months of pay stubs, and an employment authorization letter -
as someone who is a chronic over thinker, I don't blame them for thinking about the worst possible scenario. it's a valid reaction imo. but yea as of right now it's not something you can really worry about cause it hasn't happened yet. just try and keep positive and keep preparing for the next steps of your K-1 process as if nothing will change. that's all you can do right now. IF it does happen, your best bet would be to seek out a really good immigration attorney. Good luck and i hope the best for you both!

your marriage certificate is the proof of legal name change so you don't have to do anything before hand either just what @Edward and Jaycel said -
but i would say yes the answer would be "no", because technically it hasn't been issued. but i think the answer to the question "do you want them to issue you a SSN" would also be "no" i think, and i could be wrong, that answering yes to the second question could cause an issue and he ends up with 2 different SSNs. maybe if it were me, personally i would just wait to get the number. then you can answer yes to both questions and it not be a problem. especially since you still have time on his I-94

hmm you could either wait until you receive his card. or wait 14 days from the day he applied and if you haven't received it go into the SSO and see if they will verbally tell you what his SSN is. we ended up doing that because we didn't receive his card after 2 weeks. they were able to tell us verbally and mark the card as no receipt. we got the card about a week after that. also if you haven't signed up for informed delivery through USPS, you should. it does a pretty good job of showing when stuff is supposed to show. it showed my husbands card both times

so if he doesn't pass the substantial presence test, can i file MFJ at all? or for example, with TaxSlayer, it doesn't ask me at all if my spouse is a NRA, whether setting the filing status as MFJ or MFS. with OLT, i can only mark him as NRA if I change the filing status to MFS, but I can't add his social security number with 1040.com with either MFJ or MFS, it lets me mark him as NRA, and I can add his social security number, but it automatically assumes that marking him NRA means he doesn't have a SSN or ITIN even though I input it and it tells me i have to mail in it in to file. or should i just go the H&R Block and have them tell me what to do 😂😂

*deleted paragraph* the 2024 tax info was found thankfully but this questions still stands, if this would be the correct place for it, or if I should look somewhere else in this program the program i'm using only has an option for "foreign employer compensation". I can't find anything else that would apply I don't think and this is all it asks from under neath that

i assumed resident meant that he has a greencard. which at this point he does not. and he more than likely won't when I file.

hello all, with the filing of taxes coming up, I was looking for some guidance cause I can't really find any information other than what Google AI tells me and various other things that aren't exactly what i'm looking for. I have zero understanding when it comes to taxes as i've always had very simple taxes to file (single,W2 only, just recently includes a 1099-INT and 1099-SA) background: my husband (then fiance) moved here on a K-1 in november 2024, we got married in december 2024. He has a SSN. So I am filing my taxes as MFJ. I know we need to submit a statement along with the taxes to state my husband should be treated as a resident alien for tax purposes. using the IRS free file tool, i found a filer that allows me to mark him as a nonresident alien, but treat as a resident alien, and lets me add in a statement as such. it doesn't however attach like an e-signature to the statement. can I e-file this way? If i can avoid filing through the mail I would love to do that. as it takes so much longer. and feels much more stressful lol whenever I try to look this up the only thing I see is referring to a nonresident alien spouse who doesn't have a SSN or ITIN. But I swear I feel like I can find nothing for a nonresident alien spouse who does have a SSN. I've only found thing that says a SSN is required for e-filing, but it doesn't specify if that applies to a nonresident alien as well. I know I still have awhile to file taxes, but I like to get it done and over with because it stresses me out lol any clarification is appreciated!
