So I asked my Hubby again for his taxes (men, they forget so easily), anyway he tells me the reason I dont have them yet is because he talked to a high priced lawyer friend of his and explained my situation (that I have no I-94) and the lawyer told him I would have to wait 6 months to file after returning to Canada and getting an I-94. At this point tears starting welling and I turned around to my computer.

    He yells "APRIL FOOLS" ......NOT funny! I told him I was about to start B+++++G him out! LOL.

    Apparently its a huge fun day for him and his family...me not so much.

  2. Hi there!

    I went ahead and got mine done to send in with the AOS package. I can recommend a great one here in Atlanta that thankfully was not too costly but highly effecient (I did the medical on WEd and got the results on Friday), just note you have 90 days to get it to the USCIS. So do it when you are just about ready to file.

    Yes, you can send off your AOS file without the medical, but you are sending an incomplete file. You are risking an RFE, and additional delays. So its up to you.

    I'd recommend getting a medical done & including it with AOS to make it complete, as the instructions say. Why risk haivng problems down the line.

    I was hoping to pay for the medical later if possible. I'm not familiar with the term RFE - would an RFE make the application invalid? If it would cause significant problems then yes I would have the medical now, but if it doesn't pose a major problem then delaying the medical could be an option for me.

    The fee for the I-485 now includes the fees for I-131 and I-765 so those I believe you do not need to send. I am sending

    1010 - which includes I-765 and I-131

    355- for the I-130.

    I am not sure about the Childs fee but I am pretty sure that those are included.

    I am sure some one will be along soon to clarify or confirm this.

    I am about to send off AOS applications for wife and step-daughter and would like to verify the fees.

    I am sending 2 checks: one for the two I-485 applications and one for my step daughter's I-130

    Check 1 - $2,640

    I-485 + Biometrics for mother: 1010

    I-485 + Bio for step-daughter: 680

    I-131 (2 for travel): 610

    I-175 Employment Auth 340

    I-824 (because we lost NOA2) 340

    Check 2 - I-130 for step-daughter: 355

    I think that it, but I am not sure if payment for I-175 is needed if filing along with I-485. Also, not sure if seperate checks are needed

    for I-824,I-131?

    Ok Hubby just came back with Wonderful fresh ground coffee and a few of my favorite cookbooks. So sweet, I've been on edge getting all this paperwork out!

  5. Well they did add my name HOWEVER, it wont show till next billing cycle (April 15th) and I am sending my AOS and all on the 8th come hell or highwater.

    So i basically refused to get off the phone with them till I got to somone with Higher Authority , (I am what they would consider a "difficult Client" my ### if I could get Customer Service I wuldnt be LOL). He finally told me to come in and he would see what he could do. Grrrrr

  6. I HATE COMCAST!!!

    I am in serious venting mood right now. ...I am trying to get all the paperwork to send out by next week, right after we got married I called ALL Utilities to add me on the bills.

    Oh but COMCAST! NOOOOO! We cant do #### but sit on our F'N asses all day and get paid. They WORTHLESS, WORTHLESS I tell you.

    I have been on the phone for 2 and a half hours now. They cant even send me out a letter with mine and my husbands name on it.

    I have talked to 5 people. 5 and no one can help me.

    USCIS no longer routinely requires submission of original documents or "certified copies." Instead, ordinary legible photocopies of such documents (including naturalization certificates and alien registration cards) will be acceptable for initial filing and approval of petitions and applications.

  8. Thank you all! Yes mine is already recorded, we had civil ceremony and got it the day of. We are doing "Big wedding" later on in the year as my family lives all over the world (Literally)

    I guess my question is if the Copy that I send with AOS need to be "certified"? AS in taking to get notarized or anything?

    Hi, I seem to be a bit confused. In the instruction I cannot find anywhere where it says the copies of the Marriage Certificate (that i send with my I-130 and AOS packet) need to be "certified". However I notice on VJ a lot of people have had the copies certified?

    I am sending mine out next week and I really really would like any advice on this?

    In many states you apply for a Marriage License - once you get married you either send it (the License) in or hand carry it to the proper authority (in Texas it is the County Clerk's office) and have it recorded - this makes your marriage official and turns your License into a Marriage Certificate (some states will send/give you a separate Certificate that looks different than the license). :thumbs:

    Ok so I had my Infopass today at the local Atlanta USCIS office and huge suprise I was helped in 20 minutes.

    Anyway while I was waiting I was chatting with the Officer that is in the Customer Service area. I casually asked her about coming in as a Canadian Citizen and not receiving an I-94 or stamp of entry. (This is as a visitor)

    She shrugged and said it happens ALL the time, it is kinda overlooked as far as USCIS is concerned. (I buttered her up after a difficult client and she spilled). She did mention however that some have gone to the Duty officer at their local airport and just asked for one.

    Then when I spoke with the Immigration Officer at the window she verified that I-94 is kinda overlooked as far as Canadian's go. She said to just put a letter and let them know the date and POE you came in and they didnt stamp you.

    So, there is my experience and maybe it helps

    LOVE this site......I've learned so much about htis process and I am just about ready to submit our forms!!!

    But...my fiance (love the way that sounds!) lives on his sailboat..and entered the US thru Lake Champlain in NY in the fall of 2006...he then sailed around the US and Caribbean with no problems. He visted family in Quebec in October and had no issues coming or going from New York....he was "red flagged" coming back into New York this month after a another recent visit to Canada to vist his sick mother...they pretty much advised him that he needs proof of job etc to come back to the US..

    So..he is now working in Canada............and we are doing the visa process!

    Question 12 on the I 129F petition asks for a I 94 number....we don't have such a number...should I leave it blank or do I need to explain the situation in seperate note along with the final paperwork...?

    Hi Stephy,

    Are you the Canadian citizen? If so, then you're probably fine to go on your own since you're the one that has the questions and can most probably respond to any questions they have. If you're not the Canadian, I'd make sure your Canadian husband is there.

  14. I dont use Checks, However I ordered checks with our married name, address and telephone (as shown on our joint bill). I use them for all things USCIS related (and make a copy of them with the receipt of what they were for.

    Medical Exam, photos, fees etc...

    And depending of the financioal institution, you must have either your address OR phone number.

    I am sure people will tell you I am going overboard, but I don't want any excuse for a RFE.

    I figure better to overuse in this case.

    So here's my current predicament:

    • I'm running out of personal checks. So, I should order more.
    • Since I'm getting married in a month, I might as well get new checks that have both our names on them (I have enough checks to last until then.
    • I'm also hoping to buy a house and move this summer, so it'd be silly to get checks that have my current address on them.
    So my question is: Do personal checks HAVE to have the address and phone number in the upper left corner? Or can I just put our names there? This is probably common knowledge, but again.. I am uncommon.

    Advice?

You don't need the I-102, based on the research I did - in fact, it seems to make things much more confused. Canadians are in a very unique situation. Your last I-94 would have no bearing - you left the states after that visit. Sometmes they issue them, sometimes they don't - and USCIS knows that. The rules are SO vague for Canadians - it makes the forms difficult to complete!

    Everywhere I was asked for I-94 on my application I just put N/A - Canadian Citizen. OR None - Canadian Visitor.

    There are plenty of Canadians on here who have adjusted from visitor status like we are doing - and as far as I could tell, most did not bother with the I-102 - I think that is for a replacement I-94 and they can't replace it if you never got one.

    You might want to ask in the Canadian forum too, although most people who post there regularly seem to have adjusted from a spousal visa.

    Just my opinion based on my research, but I would NOT got the I-102 route. I found a few useful threads about this my doing a really exhaustive search on this forum - it took ages and this is the conclusion I came to:)

    Very helpful! So even if I drove through the candian border within the last month and they didnt stamp me I would be overstayed?

    I have an apointment on Monday 3/24/08 with Infopass here in Atlanta, and plan to ask them then. Just a bit impatient.

    I got married while I had been here and have been living with him before we even got engaged. so...?

    Am I screwed?

    If you use and enter the USA on a K-Visa you should get an I-94 card. What visa are you adjusting from?

    I-94 is a requirement for adjustment of status, I-102 should get you one, the only wrinkle I see is if you have been in the USA longer than 6 months, they may have a problem with overstay.

  18. Ok, so I am looking all over for the answer to this. I am Canadian Citizen, the last I-94 stamp I have in my expired passport is from Oct 17th 2001 with N/C. (No Class). That was not the last date of Entry however.

    I am now filling out all my paperwork (I am a bit OCD about filling it out right and maybe giving more paperwork than needed to USCIS), I read on here that some just put "Canadian Citizen" in the appropriate boxes it asks for the I-94.

    I also read on here that I can fill out a I-102 to send with it. Wonderful IDEA! But that is another $320 and money is tight.

    I of course will do what it takes, but wanted to get the opinions and advise of the Pro's. I have noticed a lot of Canadians on here. :star:
