    I suppose it would work but they probably prefer one check. I would see about getting replacement from the bank as it hasn't been cashed. In the future just write personal checks as it is easier to track and write a replacement if necessary

At that time we were told travel was fine providing we had proof of UK residence - i.e. mortgage statement. Does anyone know if I can still travel on my ESTA if we cannot get an appointment before we are planning on going? All the information I have seen suggests that I do not travel until everything is all approved.

    You can travel. Each entry is at the discretion of US CBP

    I would get a new money order or cashier check. Or submit a personal check. That way it's easier to track

I have started an application on the USCIS website, and I selected 3 year rule since I received my GC through marriage. But looking through this forum it seems like I can choose between the 3 and 5 year rules. Is one better/easier than the other? My application is not submitted yet, but I've already uploaded evidence for our marriage. Would it look suspicious if I changed it to a 5 year and deleted my uploads?  

    Any trips outside the US for more than 6 months? Are you still married or divorced?

    So what does this actually mean, is it approved? Hence it is sent for visa processing? We thought it would say one of the three Approved/Rejected or Denial. 

    Isn't it suppose to be sent to NVC

    What are we to do next? and what should we expect in the next coming weeks/months?

    Please update your timelines. If you got NOA2 the petition was approved and sent the petition for processing at nvc who will in turn forward the case to the embassy. Start bugging the nvc for the case number in a couple of weeks so you can schedule interview and medical.

    I am currently in the midst of compiling evidence to bring to the future consulate interview and was wondering what the top pieces of evidence are for the Ho Chi Minh City Consulate/Embassy. I know the Consulate Officer usually only has about ~5 minutes to review everything prior to interviewing, and I only included photographs (non-dated) and proof of meeting (scanned passport pages), flight itineraries (2 trips made so far), scanned copies of boarding passes in my I-129F packet, and plan to bring more evidence to the future interview. I also plan to make one more trip sometime by the end of this year/Tet next year before the interview. 

    We had a Dinh Hon (engagement party) so I think I will bring loose photos of that, we traveled to Thailand after our Dinh Hon/Engagement (tour package itinerary), and we have a TON of chat messages and call logs with one another on Facebook Messenger and on Zalo (Vietnamese messaging app). I'm Vietnamese-American and my Fiancee doesn't speak a lick of English, so will she have a hard time with the CO? If our messages to one another are primary in Vietnamese, should I also provide English Translations as well (not sure if they would need to be certified translations). I am not entirely sure what other proofs of relationship will be good to bring along to the future interview.

    You may already be considered married in the view of the embassy rendering the k1 void. Not sure of this particular embassy but others have considered an engagement party as already married.

    We just got our NOA2 approval (woo!). I do have a question about later on steps. My fiancee is unable to stay in the country after our 90 days (ailing relative that needs care in home country), is it still possible to file for Adjustment of Status and have her wait in her home country rather than in the US? Otherwise would we just have to file for the marriage green card? I ask because the processing times are so much shorter with the former. Hopefully this isn't too dumb of a question.

    You must be present in the US to file and remain in the US until advance parole is approved. If you were to marry now then the K1 is void

    I wanted to share this for those of you that have been asking "how long until x...". Our AOS package had a priority date of 2/22/24 and we received an RFE a few days later, on 2/29. I sent the RFE response (an entirely new Affidavit of Support package) on 3/12 and afterwards checked the online account for updates on a daily basis. Even this afternoon (4/1) I checked and it only changed the status of step 2 (biometrics) as completed for the I-765 EAD and the I-485, but not for the I-131 AP application, but nothing showed "complete."  Also, the estimated time for EAD completion was at 2 weeks, which has been the same since 3 weeks ago.

     

    Well, TODAY 4/1, USPS dropped an envelope from the NBC with a I-797 approving the EAD. All in under a month -with the RFE delay.

     

    I must say I am impressed.

     

    Technically, USCIS approved my wife's EAD in TWO weeks since they had to wait for my RFE response for the remainder two weeks to continue the process. WOW.

     

    Anyway, keep up the hope.

    She filed for the K-1 visa in December 2023. Now, I’m wondering if the relatively short duration of our relationship before getting engaged could affect our visa process. Also, does anyone know how long it typically takes to get the K-1 visa approved? By the way, we recently had an amazing trip to Paris together this month!

    It's about 1.5 to 2 years to complete the process. Strongly suggest you spend more time in person. 

     

    Additionally others recommend going the spouse visa process instead. Cue crazy cat with the comparisons.

    They have to pick up their mail. You can relax for now. It's postmarked for today and the receipt you have confirms that

    What airport are you arriving at? You must clear immigration and collect checked baggage before exit the customs area

    Could this have any impact on her application?  Or would they view this as that she was young and immature? Should she mention it in the petition? What if she was arrested at the time for this issue for less than a day or something until she saw the judge the next day to pay the fine?

    Any traffic fines under 500 dollars does not have to be mentioned unless it's drug or alcohol related. Ask your friend if it shows up on driving record. Sounds like it was handled in traffic court.

    The post mark is the day you hand it off to the clerk at the window at post office. Obviously send certified mail return receipt. Retain slip showing post mark.

    • Copy of the vaccination worksheet from the exam overseas
    • Copy of my passport's bio page
    • Copy of the stamps in my passport
    • AOS + biometrics fee payment
    • Cover letter
    • Copy of the I-129F NOA 2 (approval)
    • Copy of the I-94
    • Copy of my birth certificate with translation
    • Certified copy of our marriage license
    • 2 passport-style photos

    Better file and have shipment postmarked before April 1st or you will have to pay higher fees. Also effective April 1st separate payments are required for 485, 765, 131.

    I don't think it's a rolling year. Each trip is treated separately but the total days outside the US factors when applying for citizenship. As I understand it any time spent longer than a year causes concern when coming back to the US. Also you mentioned you have a 2 year card so something to keep in mind because you don't want to miss any potential interview for removing your condition

    Due to weddings, funerals, honeymoon and other family plans i will be spending 6months 3weeks outside of the US between July 2023 and July 2024. 

     

    1 - the 6 months in a year thing.... my greencard is valid for 2 years. Can I be out for 6 months within each year or 6 months total between may 2023- may 2025?

     

    2. If I can be out for 6 months within a year and then another 6 months when does that year start and restart? I'm assuming my year starts and reboots in May but have read different things. For example I spent 4.5months out between May 2023- May 2024 so would my trip this summer count as a new batch meaning i'd only be spending 7 weeks out of the year out?

     

    As I have a remote job from the uk and we don't own property in the states I've read that being out of the country for more than 6months in a year (again, not sure if thats a rolling year or from when my greencard was issued) without the proof could be risky. 

     

    Any help and advice would be apprecaited and sorry if the questions don't make much sense, been trying to figure this otu for hours.

     

     

    There is no hard and fast answers. Just remember the green card is for living and working in the US. With a travel pattern you have described an argument could be made by cbp that you have failed to establish the USA as your residence. Are you planning to apply for citizenship?
