    I think OP is confused and doesn’t realize that VJ is separate from US immigration.
     
    also, to the OP:  prolonged AP for Pakistan is extremely common, due to poor record-keeping, which is so bad that a police report isn’t even required for Pakistan.   The U.S. embassy does its own background checks, rather than rely on your country to provide legitimate ones.

    I think you are getting way ahead of yourself.
     
    The opportunity to file a waiver would be a massive improvement to your current situation.
     
    Let us take a positive view and that the case does get sent back to the Consulate, I do not know enough about your case to know what the Consulate would then do, I would have the waiver in mind and see what happens.

    At this point, we are going into circles.I have a good case and I promise to share it once everything is settled. They will hit me with misrepresentation but the other won’t stick. I expect the director to deny it and we will go for sure on the appeal. Wait and we will see.

    In preparation of this case, I already read hundreds of these cases. Non precedents and precedents ones. These are not new to me.

    This is so different from what I have on my hands. I didn’t say that my case is easy. The misrepresentation charge gonna hit me hard but I am so certain that the charge of my wife is not freely married to me because he was married to another guy won’t stick. So certain that I am even willing to bet $50K.

    Nahh!!! When I posted this, I saw how many VJ members overthink stuff. One member said case is over, no NOIR you are ######.The other king 👑 member said that what was I trying to achieve filing a writ of mandamus… obviously people here overthink, Every individual case is different.I will come back here to show that the original charge didn’t stick. Thank you too

    No you are good. I don’t get Angry that easy. I have been working on this case for quite a bit. I am pretty darn good that this charge won’t stick. The misrepresentation yes. If someone want to be bet, I am so down.

    My wife has openly acknowledged that her representative provided false information during her interview. Specifically, she admitted that the agent who handled her application misrepresented her marital status. That Upon discovering this misrepresentation, the agent allegedly informed her that the information could not be corrected, and she was advised to proceed with the inaccurate details.
    As non-immigrant visa applications at the US embassy typically do not require proof of marital status, my wife initially perceived the situation as inconsequential. Unfortunately, she used the same DS-160 form when reapplying. I recognize the gravity of the situation and am actively devising a strategy.
    In line with @Boiler suggestion, my plan involves having my wife admit to the misrepresentation in a sworn affidavit. I aim to support this admission with evidence, including any communication records with the agent who encouraged the misrepresentation (she mentioned that this occurred on WhatsApp). I am exploring options to recover messages from iCloud.
    Additionally, I am in the process of gathering affidavits from her neighbors, community leaders, and various government officials who are familiar with her. I plan to include employment contracts from that period, along with documents from the Rwandan government confirming her single status at the time.
    Once I establish the admission of the misrepresentation, I will assess the necessary steps moving forward. I appreciate the guidance from everyone, and I will keep you updated on the progress.

    I am sorry but you clearly don’t understand it. I recommend you read this order  https://www.justice.gov/sites/default/files/eoir/legacy/2012/08/17/2711.pdf . Rwandan government recognizes our marriage as valid  and Rwanda is where our marriage happened. No records shows that she has ever been married.Try and spend more time to help VJ instead of negativity

    I am sorry guys.. I am still waiting the document. The USCIS online account changed the status saying this
    “On January 10, 2024, we mailed you a notice explaining our intent to revoke our earlier approval of your case, Receipt Number[removed]. The notice explains what we will do. Please follow the instructions in the notice and submit any requested materials. If you do not receive your notice before January 24, 2024, contact the USCIS Contact Center at www.uscis.gov/contactcenter. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.” I usually receive the document in my online account the same day the status changes but they didn’t attach the notice  for some reasons. So I have to wait 7 days to put in a request if it doesn’t show up or I don’t receive it in the mail. I will keep you posted.

    I think of it as a step by step process with many potential routes, you have the WoM which should move it on, quite which direction it takes is another matter.

    Thank you all for your valuable inputs.I am committed to pursue every legal avenue available until all options are thoroughly exhausted.policies have been changing a lot and some Judges interpreted the law differently for non precedent cases. I acknowledge that many cases that went before the board of appeals were dismissed… and showing extreme hardship was tough in case of the waiver but I will try everything until I can’t. Your support and encouragement means a lot, and I will keep you posted on the progress.I am grateful for the insights from all of you VJ members.

    As already stated, we have not seen a single successful case of this on VJ so keep us updated. This shows up many times and nobody comes back to update us. Usually how this plays out is USCIS or the embassy will come back and ask for a termination document from the previous marriage and you won't be able to supply one. You seem to know your next steps so good luck. Hopefully you'll be the first on VJ.

    The way I read it is that they have done nothing and the WoM would be to get them to do something.
     
    All a High Court could do assuming they could do this at all would be to document they have no records of her being married, which is not the same at all.
