  1. Hi, My uncle, who's a US citizen, applied for her sister, who was divorced at the time in 2008. Two children born in 2000 and 1999 were added as dependents. Recently the I-130 got approved, and I got the email from the NVC to pay fees and upload required documents. My Question is that if the CSPA still applies to the kids or not?

Firstly you will need to upload all the documents that are expired (for Pakistan, that will be police certificate ) Update the new tax returns, tax transcripts, W-2/s You can also update the I864 form (just edit the yearly income part and new sign, same for i864A if you have joint sponsor/ upload everything new on the CEAC portal and take everything you uploaded to interview Get medical appointment for them
  3. Just my two cents on the topic. I was going trough the same dilemma last year to whether get married or apply for K-1 visa. The I-130 road takes up to 3 years, most of the wait time is to get interview at ISL embassy (almost 20 months after getting your i-130 approved). I have heard horror stories about k-1 visa getting denied (epically in Pakistan) and then they had to get married to apply for i-130. If you feel that you have good strong case you should be okay. I got my Nikah done on the second trip and applied for i-130 and playing this wait game. Best of luck with your case. keep us updated
